PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, Public Works Director Zech Prouse (via teleconference), City Attorney Andrew Rawlings, Treasurer Amy Sullivan and City Clerk Keri West. ABSENT: None. VISITORS: Neahl Johnson, Ron Larsen, Kylie Anderson, Dustin Haderlie and Steve Heath. Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. Mayor Gubler acknowledged the retirement of Treasurer Sullivan, thanked her for 8 years of service to the City of Iona and recognized her with a gift. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of June 16, 2020 were reviewed. Council reviewed the finance reports for the period ending June 30, 2020 (75% of the fiscal year elapsed). The City had $874,346.28 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Thompson seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Public Hearing, Preliminary Plat Application, HLE, Inc; Pam Addition on the NW corner of 49th North and 55th East — Steve Heath with Harper Leavitt Engineering approached the podium and introduced the preliminary plat for the Pam Addition. He stated they would like to split the mentioned parcel into 4 lots. He continued and stated 3 of the lots would be 1/3 acre lots and the one corner lot would be approximately 1 acre. He continued and stated he has been working with Director Prouse and there is currently sewer and water ready to be connected. Mr. Heath stated there were comments brought up at the P&Z Meeting regarding the distance from the driveways to the arterial intersection and the speed limit on 55th East. He stated they will review Bonneville County' s regulations on these topics and address them before the final plat is submitted. Mayor Gubler discussed the size of the water line necessary and the fire hydrant locations. Mayor Gubler stated there was a well on the corner of this property that he does not believe was properly abandoned according to the requirements of the Department of Environmental Quality (DEQ). He continued and stated according to Idaho Department of Water Resources (IDWR) there is no record of the well. However, residents can attest the well has been there for over 70 years and was previously used by multiple homes close to the well. 1 Mayor Gubler opened the Public Hearing portion of the meeting and asked if anyone in the audience is in favor of this subdivision. One person raised his hand in favor. Mayor Gubler then asked if anyone in the audience opposes this subdivision. Two people raised their hands in opposition. Mayor Gubler invited those audience members who oppose this subdivision to come to the podium and state their concerns. Dustin Haderlie of 5543 E. 49th N. stated he lives across the street from the proposed development and is not in favor of this subdivision. He presented a petition signed by 12 nearby residents to the proposed property that also oppose the proposed plat. The majority of the homes in that area have 2+ acres of land and they do not want to have this lot split into 4 small lots. He continued and stated the nearby residents would prefer to see only 2 homes developed with equal lot sizes to maintain the general feel for the area. He also expressed concern of having 3 driveways right off 55th East with the current 50mph speed limit. Ron Larsen of 4790 N. 55th E. stated he also opposes this subdivision. Mr. Larsen stated there are many nearby neighbors that oppose this that have not had a chance to voice their concerns. Mayor Gubler assured Mr. Larsen for all Public Hearings, notices are sent out to all neighboring property owners within 300 feet of the property. Clerk West confirmed this was done 15 days prior to the meeting. Mr. Larsen also stated the previous owners of the land also used a portion of it as a dump site. They dug into the ground and burned many different types of material on the property. Mayor Gubler stated that is something that would also need to be addressed by the new property owners. Council President Geray questioned whether the new property owners could discuss this situation with the neighboring property owners to come up with a compromise on the size and number of lots this subdivision would include. Neahl Johnson introduced himself as the new property owner and developer of this subdivision. He stated his desire to develop a subdivision with smaller homes that are more affordable for young families in this market. He continued and stated he would not have purchased the property to build only 2 homes. Mayor Gubler informed the City Council and the audience members that when a property is annexed into the City, the City Code and Zoning for said property then become the law by which that land is governed. This property is zoned R-1, which has a minimum lot size requirement of 1/3 acre. Mayor Gubler continued and stated the City Council cannot arbitrarily deny an application that meets the requirements of that zone simply because the neighbors do not want it. He did encourage the neighboring property owners to have a conversation with the developer and try to reach a compromise privately. Kylie Anderson with Forsgren Engineering, the City's Engineering firm, approached the podium and stated there is a possibility of this being denied by Bonneville County due to the distance of the driveways from the arterial intersection of 55th East and 49th North. Steve Heath with Harper Leavitt Engineering stated they have complied with Bonneville County's requirements and all driveways will be at least 150' from the intersection. He confirmed there will be three driveways facing 55th East and one driveway facing 49th North. Mayor Gubler stated the building requirements for this subdivision will be dictated by the City, but the road requirements will be dictated by Bonneville County. Mayor Gubler also stated the City will move the 50 mph sign north of this subdivision on 55th East. 2 Mayor Gubler entertained a motion. Council President Geray made a motion to approve the preliminary plat application as presented. Council Member Thompson seconded the motion. Attorney Rawlings stated the wording needs to be changed for this motion. Council President Geray made a motion to approve the preliminary plat as presented, subject to the writings to be issued as a result of this decision. Council Member Thompson seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Public Hearing, Ordinance to Amend Iona City Code §§ 11-6-5(A) and 11-6-9, Commercial Zone, relating to side yard requirements and landscape buffers (Ord. 238-07-20) — Council President Geray stated this section of the City Code was amended to allow for trees taller than 6' to be used as landscape buffers. Attorney Rawlings confirmed. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 238-07-20, an Ordinance of the City of Iona, Idaho; amending section 11-6-5(A) of the Iona City Code; clarifying side yard requirements; amending section 11-6-9 of the Iona City Code; allowing certain landscaping buffers taller than six feet; describing methodology; providing for severability; and establishing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Public Hearing, Ordinance to Amend Iona City Code § 11-11-19- Fences, relating to public or utility property interests (Ord. 239-07-20) — Attorney Rawlings confirmed this is regarding fences in public rights -of -way and utility rights -of -way. Clerk West stated she discussed this with Director Prouse prior to the meeting and they are both in agreement that a fence permit would be appropriate. She continued and stated Director Prouse has confirmed his department will physically inspect the location for each fence permit to approve or deny placement prior to installation. She suggested tabling this discussion to allow Attorney Rawlings an opportunity to edit this section to include a permit requirement. Mayor Gubler and Council Member Thompson agreed a fence permit is necessary. Clerk West suggested a permit fee of $50 to cover all City employees' time to process the permit. Director Prouse agreed and said if the ordinance is concise and simple it will be easier for residents to adhere to and for the City to enforce. Council Member Wadsworth asked if this permit would be required to redo a fence. Director Prouse stated it would only be required in that situation if they are altering the existing fence lines. 3 Mayor Gubler entertained a motion. Council Member Thompson made a motion to table the proposed Ordinance No. 239-07-20 regarding fences relating to public and utility property interests. Council Member McNamara seconded the motion. All in favor. Motion carried. Public Hearing, Ordinance to Amend Ordinance No. 231-08-19, Appropriations Ordinance for the 2020 Fiscal Year, Appropriating Additional Monies that have been received by the City of Iona — Mayor Gubler stated this is an ordinance to amend the FY2020 budget to include the additional monies received from the Local Highway Technical Assistance Council (LHTAC) for the bike path project on Denning Avenue. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 240-07-20, an Ordinance of the City of Iona, Idaho; amending Ordinance No. 231-08-19, the Appropriations Ordinance for the fiscal year beginning October 1, 2019, and ending September 30, 2020; appropriating additional monies that are to be received by the City of Iona, Idaho, in the sum of $40,942.79 and providing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Public Hearing, Resolution No. 2020-02, Reserving the Forgone amount for Fiscal Year 2021 — Mayor Gubler stated the City is now required by state law to reserve the forgone amount by resolution each year. He continued and stated this allows the City to continue to accrue forgone property tax monies to potentially receive at a later date. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Resolution 2020-02, a Resolution of the City Council of the City of Iona, Idaho, reserving the forgone amount for Fiscal Year 2021 for potential use in subsequent years as described in Idaho Code § 63-802, with the amount being $80,955. Council Member Thompson also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Approval of Fiscal Year 2021 Preliminary Budget — Mayor Gubler stated this preliminary budget includes $1,301,800.00 in revenue and expenses for the General Account and $2,754,800.00 in revenue and expenses for the Water Account, for a total budget of $4,056,600.00. Treasurer Sullivan confirmed this does include the money to finish the water tank project. Council President Geray stated he does have some questions regarding this budget. He is concerned that the Council and Mayor have previously stated the upcoming fiscal year will be a "lean" year, yet many of the budgeted line items have drastically increased from the current year's budget. Council President Geray specifically discussed the Equipment Reserves account in Revenue that went from $75,000 to $117,000 and the Reserves account that went from $82,783 to $236,681. Treasurer Sullivan stated she needed to increase these areas and designate 4 borrowing more from savings to balance the budget with the expenses. Council President Geray stated he understands the need to balance the budget between the revenue and expenses. However, he is also concerned about the increase on some of the expense line items. He specifically questioned why the Capital Improvements budget jumped from $121,000 in FY2020 to $350,000 in FY2021. Treasurer Sullivan stated it is difficult to know how much the chip sealing and other projects are going to cost for the upcoming year. She continued and stated it does not have to be expended, but it is good to have a buffer. Council President Geray stated he understands being conservative, but he feels this is excessive. Mayor Gubler asked Director Prouse for his plans for capital improvements in the upcoming year and his input on the budgeted expense amounts for the Public Works Department. Director Prouse said there will be curb and gutter work done on Main Street and yearly chip seal. There are no large projects scheduled for next year. Director Prouse did say he does not see an immediate need for $350,000 in capital improvements, but it is good to have it there when we do need it. Council Member Wadsworth stated the need for improvements to be done on the City Building. Director Prouse agreed and stated that will be an ongoing project. Council President Geray expressed his desire to at least reduce the capital improvements down to $300,000 to better align with the "lean" year mentality the Council has agreed to previously. He continued and said this would allow them to reduce the reserve revenue by $50,000 as well to keep the budget balanced. Council President Geray also asked about the Civil Defense expense amount of $895 that was previously budgeted annually that is showing as $0 for 2021. Director Prouse stated that is for the Swiftreach phone system to notify Iona residents of emergencies. Treasurer Sullivan said she removed that from the upcoming budget because she was under the impression the City would be canceling this service. Director Prouse encouraged the City to continue this service at least one more year and to have the City Office & Public Works Department utilize it more consistently. Treasurer Sullivan agreed to add it back into the upcoming year's budget. Treasurer Sullivan confirmed the requested changes and calculated the new total budget to be $4,006,600.00. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the preliminary budget for Fiscal Year 2021 of $4,006,600.00. Council Member McNamara seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Business License Application, John Empey, Ernie's Cafe — Clerk West stated Mr. Empey has requested to be on the agenda every month, assuring he will have all inspections passed by the Council Meeting date. However, as of today, all inspections are still not completed and passed. Council President Geray recommended removing this item from the agenda until all of the inspections are passed before placing back on the agenda. Attorney Rawlings suggested denying the application and requiring Mr. Empey to reapply for a business license when all inspections are completed. Clerk West agreed and stated his application was submitted over one year ago. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to deny the Business License Application for John Empey of Ernie's Cafe, based on the business not being awarded occupancy. Council Member McNamara seconded the motion. All in favor. Motion carried. 5 Ordinance to Repeal and Reenact Title 3, Chapter 1 of the Iona City Code, relating to the Police Division (Ord. 241-07-20) — Attorney Rawlings stated the intent with this ordinance is to update the City Code and wording to match our contract with Bonneville County Sheriffs Office (BCSO). Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Ordinance No. 241-07-20, an Ordinance of the City of Iona, Idaho; repealing and reenacting Chapter 1, Title 3 of the Iona City Code, relating to the Police Division; preserving prior ordinances in each instance; providing for severability; and establishing an effective date. Council Member Thompson also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 242-07-20, an Ordinance of the City of Iona, Idaho; amending Section 4-1-4 of the Iona City Code; specifying information to be included on Business License Applications; providing for methodology and severability; and establishing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Thompson seconded the motion. A roll call vote was taken: Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Ordinance to Enact a New Section 8-3-14 of the Iona City Code, relating to landowner's liability of encroachment or interference with public or utility right-of-way (Ord. 243-07- 20) — Attorney Rawlings stated this is a new ordinance to establish the process and liability if a landowner places any object, including sheds or fences, that encroaches upon public or utility rights -of -way. No questions or concerns mentioned. Mayor Gubler entertained a motion. Council Member McNamara made a motion to adopt Ordinance No. 243-07-20, an Ordinance of the City of Iona, Idaho; enacting a new Section 8-3- 14 of the Iona City Code; establishing landowner's liability for removal of encroachment or interference with public or utility right-of-way; describing methodology; providing for severability; and establishing an effective date. Council Member McNamara also moved to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. A roll call vote was taken: 6 Council Member Wadsworth: YES Council President Geray: YES Council Member Thompson: YES Council Member McNamara: YES Discussion of Iona City Code § 10-1-9, Small Subdivision Process — Mayor Gubler stated this item was discussed during the Work Meeting prior to this meeting. Discussion of Code Enforcement — Mayor Gubler stated this item was discussed during the Work Meeting prior to this meeting. Discussion of COVID-19 Response — Mayor Gubler stated he does not want to close the City Office to the public. However, if Eastern Idaho Public Health (EIPH) issues mandates that would make it difficult to adhere to in the City Office, he will close it to the public. Mayor Gubler also stated we have someone who has reserved the park on Saturdays for a summer craft market and has now requested to hold a larger event in the fall. Mayor Gubler continued and said as of today, EIPH has issued a mask mandate when social distancing is not possible and to limit gatherings over 150 people in Bonneville County. Council Member McNamara stated these craft markets bring in very large crowds, definitely over 150 people. Director Prouse stated he is opposed to any large gatherings behind held in the City Park due to COVID-19. Council President Geray reiterated allowing the July 25th event to take place as scheduled, adhering to the mandates imposed by EIPH, but only allowing the fall event to be scheduled at risk of cancelation, due to unforeseen circumstances. Director Prouse suggested allowing the organizer to continue with the July 25th event and canceling all future events. Clerk West stated the City Building is also used by a dance company and a preschool. She has been notified with concerns from those organizations over the City Building being closed without enough notice for them to efficiently notify all of their students' families. Clerk West asked if there are any indicators the dance company and preschool can watch for to help them plan ahead, if possible. Mayor Gubler stated the only reason he would close the City Office is if there is a massive spike in Iona. He does not have a number in mind and would have to continually evaluate. Director Prouse urged the City to be proactive on this topic and close the City Building. General Water System Discussion — Mayor Gubler stated he has signed the contract with the Army Corp of Engineers and they are in the process of reviewing all the plans. The amount of money they will be distributing to the City of Iona is $475,000. The total amount for the well house and the well is approximately $1,226,000. Mayor Gubler stated they cannot use any of that money until it has been processed and is in our possession. Kylie Anderson with Forsgren Engineers stated she spoke with the representative from the Army Corp today and was advised the allocation was approved; it just needs to be pass the environmental review. Council President Geray asked whether the flow was achieved with the added depth they approved at last month's meeting. Mayor Gubler confirmed the goal was 1375 gallons per minute and we achieved 1500 gallons per minute, over 24 hours. He also stated the current depth is close to 400'. Mayor Gubler also stated the City has completed the letter to Congressman Simpson to begin the process for the City to acquire the Bureau of Land Management (BLM) land on Iona Hill. 7 STAFF REPORTS: Lt. Casper with BCSO stated the calls for service have been very consistent. He continued and stated the three summer months are always the busiest months for service calls. He also stated the BCSO is aiming to increase their code enforcement with feedback from the City Council discussed during the previous Work Meeting. Lt. Casper also added the Idaho Falls Community Hospital has been great to work with and has helped to reduce processing time on more complex calls. He continued and stated there have been two officers consistently in the City of Iona during the summer months. Council Member Wadsworth thanked Lt. Casper and BCSO for their service and stated that he has received a lot of good feedback from residents regarding police coverage. Clerk West and Treasurer Sullivan both stated nothing to report. Director Prouse stated the annual chip sealing will be taking place this week on Rockwood, Hansen and Denning Avenues. Council Member McNamara reported the Iona Historical Museum had a good turnout for their fundraiser and that all visits are now by appointment only. Council Member Wadsworth, Council President Geray and Council Member Thompson stated nothing to report. Mayor Gubler reported there have been no volunteers for the Iona Historical Preservation Committee.
