A SPECIAL ORDINANCE VACATING THE FIRST ALLEY NORTH OF SOUTH
A STREET ]JETWEEN SOUTH 2ND STREET AND THE CSX RAILROAD
WHEREAS Smarrelli General Contractor, Inc. owns lots numbered 147 and 148 in John
and Samuel W. Smith's Addition to the City of Richmond, hereafter called
"Smith Addition"; 41.41 feet off the east side of lot number 3 in J.P. Plummer's
Addition to the City of Richmond, hereafter called "Plummer Addition", and 29.54
feet off the east side of -lot number 4 in Plummer Addition, and petitions for the
vacation of the first alley north of South A Street between South 2nd Street and the
CSX Railroad, which alley is shown by diagonal lines on attached Exhibit A, and
WHEREAS Smarrelli General Contractor, Inc. has petitioned the Common Council of the City
of Richmond, Indiana, for the vacation of a public alley bounded on the south by
the north lot line of lot number 4 in Plummer Addition, on the south by the nortb lot
line of lot number 1.48 in Smith Addition, on the east by the west line of South 2nd
Street, on the north by the south lot line of lot number 147 in Smith Addition, on the
north by the south lot line of lot number 3 in Plummer Addition and on the west by
the east right-of-way line of the CSX Railroad, and
WHEREAS Common Council, pursuant to Indiana Code 36-7-3-12 conducted a public hearing on
said vacation petition on August 2, 1993, and
WHEREAS a public hearing pursuant to Richmond Code 155.04 (B) was conducted August 24,
1993, by the Richmond Advisory Plan Commission, and
WHEREAS the Richmond Advisory Plan Commission voted in favor of recommending adoption
of the proposed vacation,
NOW, THEREFORE, be it ordained by Common Council of Richmond, Indiana, that subject to the
preservation of easements for existing utility services, the public right-of-way over, upon, and across
the following described real estate is hereby vacated, to wit:
Beginning at the southeast corner of lot number 147 in John and Samuel W. Smith's
Addition to the City of Richmond, Indiana; thence west along the south lot Iines of said
lot 147 and lot number 3 in J.P. Plummer's Addition to the City of Richmond,173,41 feet
to the east right-of-way line of the CSX Railroad; thence south along said east right-
of-way line 10 feet; thence east along the north lot lines of lot number 4 in J.P. Plummer's
Addition to the City of Richmond and lot number 148 in John and Samuel W. Smith's
Addition to the City of Richmond, 173.41 feet to the west line of South 2nd Street;
thence north 10 feet to the place of beginning.
