AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING SECTION 9202(33) OF THE TEMPLE
CITY MUNICIPAL CODE RELATING TO NATURAL
RESOURCES.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council finds and determines:
1. That on March 11, 1969, pursuant to notice thereof
duly given as provided in the Planning and Zoning Law of the
State of California, the Planning Commission of this City held
a public hearing and adopted its Resolution 69 -331PC recommend-
ing to the City Council a change in the zoning regulations
pertaining to the exploration for and production of natural
resources;
2. That on June 3, 1969, the City Council held a public
hearing upon such recommendation, proper notice being given
as provided in the Planning and Zoning Law;
3. Thereupon the Council adopted Ordinance 69 -288,
substantially modifying, albeit inadvertently, the
recommendation of the Planning Commission without further
report therefrom.
4. That on March 3, 1970, the City Attorney advised
the City Council that Ordinance 69 -288 had been adopted
without the following requisite procedures set forth in
Section 65857 of the Government Code, which provides that
before the City Council can adopt any modification to the
Planning Commission recommendation, the proposal for modi-
fication must first be referred to the Planning Commission
for report, which said referral and report was not done in
this proceeding;
5. That accordingly, this City Council did on March 17,
1970, give first reading to an ordinance which would repeal
Ordinance 69 -288, which when effected will leave the City
Council with respect to the Planning Commission recommendation
set forth in Resolution 69 -331PC in status quo as of July 1,
1969, and in position to take effective action with respect
to said Resolution 69- 331PC; and
6. That the City Council has now given additional
consideration to such Planning Commission recommendation,
and has proposed a modification thereto in the form herein-
after set forth in Section 2; that on March 3, 1970, such
proposed change was referred to the Planning_ Commission for
its report; and that on March 10, 1970, the Planning Commis-
sion reported its recommendation with respect to said
proposed modification.
SECTION 2. Section 9202(33) of the Temple City Municipal
Code is hereby amended to read as follows:
Sec. 9202(33). Natural Resources.
(a) Coring, testing and exploration for (but
not production of) oil, gas, minerals, rock, dirt,
or other products, including such operations in
any zone of the City; and

(b) Surface and sub - surface excavation,
extraction, drilling, slant drilling, production,
processing and removal of oil, gas, minerals,
rock, dirt, or other products in the C and M
zones only.
SECTION 3. The City Clerk of the City of Temple City shall
certify to the passage and adoption of this Ordinance and
to its approval by the Mayor and shall cause the same to be
published in the Temple City Times, a newspaper of general
circulation, printed, published and circulated in the City
of Temple City.
