A GENERAL ORDINANCE AMENDING CHAPTER 91 OF THE RICHMOND
CODE
WHEREAS the dog and cat population of the City of Richmond, Indiana, is unacceptably
high, and
WHEREAS it is the policy of this Common Council to encourage dog and cat owners to
neuter their animals unless they are engaged in the business of selling cats and
dogs, and
WHEREAS certain amendments to Chapter 91 are required for administrative purposes,
NOW, THEREFORE, be it ordained by the Common Council of Richmond, Indiana, that the
Richmond Code be amended as follows:
A. Section 91.01 (C) shall read as follows:
AT LARGE - an animal shall be deemed to be "at large" when it is off the property
of its owner and not under restraint as defined in sub -section (I) of this Section.
B. Section 91.01 (G) shall read as follows:
OWNER - any person or persons owning, keeping or harboring a domestic animal as
defined in sub -section (E) of this Section.
C. Section 91.02 shall be amended as follows:
(A) First senLence unchanged,
&cond sentence:
Application for such registration shall be made to any of the following: City
Controller, veterinarians registered for this purpose with the City
Controller, any premises designated by action of the City for the purpose of
impounding and caring for animals found at large, and pet shops registered
for this purpose with the City Controller.
Third Sentence:
Such application shall state the name, address and telephone number of the
owner and the name, breed, color, age, sex and reproductive status of the
dog or cat.
D. Section 91.02 (B) shall read as follows:
The yearly registration fee shall be $10.00, unless a certificate by a veterinarian
stating the dog or cat is neutered is furnished to the person_ issuing the license tag, in
which case the fee shall be $4.00.
The second sentence is unchanged.
E. Section 91.02 (G) shall read as follows:
Any premises designated by action of the City for the purpose of impounding and
caring for animals found at large in violation of this ordinance and properly licensed
pet shops are exempt from the registration requirements of this section.
F. Section 91.04 shall read as follows:
(A) Dogs shall be kept under restraint, as defined in Section 91.01, (I), at all times.
G. Section 91.05 shall read as follows:
(A) Dogs at large and all other animals at large and appearing to be abandoned shall
be apprehended by the Animal Control Officer and impounded in an animal shelter
for a period of not less than five days, and therafter such animals may be
adopted out or disposed of in a humane manner. The Animal Control Officer shall
attempt to contact the owner of any tagged animal by telephone within 48 hours of
picking up such animal if the telephone number appears on the tag. The animal
shelter holding any impounded animal shall attempt to contact the owner of any
tagged animal by telephone a minimum of three times prior to adopting out or
humanely disposing of the animal if the animal displays current city registration tags
or other identification.
(B) When an animal is found at large and its ownership is known to the Animal
Control Officer, such an animal does not have to be impounded. The Animal
Control Officer may cite the owner for violation of the Richmond Code and return
the animal to the owner.
(C) The Animal Control Officer shall maintain a record of all animals found at large
and upon the third such finding at large within a calendar year, the animal shall be
neutered prior to returning the animal to its owner or permitting the owner to pick it
up at the animal shelter where it is impounded. The costs of neutering the animal
must be paid by the owner before such animal may be returned by the Animal
Control Officer or released by the animal shelter where it is impounded.
H. Section 91.06 shall read as follows:
(A) An impounded animal shall be returned to its owner upon compliance with
Sections 91.02 and 91.07 of this Chapter and payment of all charges for care and
medical treatment incurred by the animal shelter in holding such animal provided
that any animal that has bitten a person may not be returned to its owner unless
authorized by the Health Officer.
(B) Not withstanding any other section of this Chapter, any animal shall be
promptly destroyed for public health considerations or humane reasons upon the
written order of the Health Officer or a licensed veterinarian by the animal shelter
holding such animal.

Richmond, Indiana.
