A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 4309 WEST
NATIONAL ROAD
WHEREAS the zoning map designates 4309 West National Road, Richmond, Indiana,
as R-2 One -Family Residence District, and
WHEREAS it is desirable to change the zoning designation to C-2 Commercial District,
to accommodate its use as a retail gun and sports shop,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the real estate described in attached Exhibit A be and is hereby
changed to C-2 CommerciA District.
Passed and adopted this day of October, 1993, by the Common Council of the City of
Richmond, Indiana.

A part of the Southeast Quarter of Section 21, Township 16 North, Range 14 East
In Center Township, said County and State, being more particularly described as
follows:
Beginning at a point in the south right of way line of United States Highway
Number 40 412.45 feet, measured along said right of way, west of the intersec—
tion of said right of way with the East line of the Southeast Quarter of Section
21, and running thence south at right angles to said right of way 175.5 feet to
a point 3 feet north of the northeast corner of a concrete block barn; thence
west, at right angles and parallel to said barn, 33 feet; thence south, at right
angles and 3 feet west of the west side of said barn, 108 feet; thence west,
right angels, 84.6 feet; thence north with an interior angle of 89 degrees and 8
minutes 283.2 feet to the south right of way line of U.S. 40; thence east, along
said right of way line 112.65 feet to the place of beginning, containing an area
of 0.76-acres, more or less.
ALSO, a part of the Southeast Quarter of Section 21, Township 16 North, Range 14
East in Center Township, Wayne County, Indiana, being more -particularly
described as follows: the.beginning point of the real estate herein conveyed is
found as follows: Beginning at a point in the south right of way line of the
U.S. highway #40, 412.25 feet measured along said right of way west of the
intersection of said right of way with the east line of the Southeast Quarter of
said Section 21, and running thence south at right angles to said right of way
175.5 feet to a point 3 feet north of the northeast corner of a concrete barn,
the same being the beginning point of the real estate herein conveyed; thence
west at right angles and parallel to said barn 33 feet; thence south at right
angles and 3 feet west of the west side of said barn 108 feet; thence east at
right angles 33 feet; thence north at right angles 108 feet to the place of
beginning, containing .082 of an acre, more or less, together with the right to
come on the real estate immediately east of said barn above referred to for the
purpose of painting or making necessary repairs to said barn. �1*

RE: Ordinance No. 85-1993
Dear Ms. Lundy:
Please advise the members of Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Tuesday, September 28, 1993, on the
petition of Gene and Martha Spencer, owners; Richard D. Lee, agent; requesting a
rezoning from R 2 One -Family Residence District to C-2 Commercial District for the
purpose of retail sales on property located at 4309 National Road West.
Four notices were sent to surrounding property owners, none were returned.
Planning Staff recommended approval of the request since it is compatible with
existing zoning districts in the immediate area and is in conformance with the
Comprehensive Plan, which denotes this area as a Special Development Area.
The Commission voted 10 in favor, none opposed, 1 absent, to recommend the
passage of Ordinance No. 85-1993.
