A GENERAL ORDINANCE PROHIBITING OHIO DEPARTMENT OF LIQUOR CONTROL
SURVEILLANCE ACTIVITIES WITHIN THE CITY OF RICHMOND
WHEREAS the Constitution of the United States of America, Article 1, Section 8, provides
that the Congress shall have the power to regulate interstate commerce, and
WHEREAS the State of Ohio Department of Liquor Control conducts surveillance activities on
the streets and public ways of the City of Richmond and on the parking lots of
legitimately established and operated businesses within the City of Richmond,
Indiana, and,
WHEREAS these surveillance activities inhibit, threaten and impede interstate commerce
and, in particular, the purchase of liquor, beer, or wine by Ohio residents at
stores located within the City of Richmond, Indiana;
NOW, THEREFORE be it ordained by the Common Council of the City of Richmond, Indiana, that
Chapter 123 be added to the Richmond Code as follows:

All surveillance activities by the Ohio Department of Liquor Control which inhibit,
threaten or impede interstate commerce and, in particular, the purchase of liquor,
beer, or wine by Ohio residents at stores located within the City of Richmond, Indiana,
are hereby prohibited.
Section 123.02
The prohibited activities described in the preceding section shall constitute an
ordinance violation subject to a fine of not less than fifty dollars nor more than five
hundred dollars. Each activity shall constitute a separate ordinance violation.

A verified complaint for such an ordinance violation may be filed with the Department
of Law by a person who has observed such surveillance activity, which complaint will
be filed in Wayne Superior Court No. 3, Wayne County, Indiana, as an ordinance
violation.
