A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 3041 EAST
MAIN STREET
WHEREAS the zoning map designates 3041 East Main Street as R-3 One to Eight Family
Residence District, and
WHEREAS it is desirable to change the zoning designation to R-4 Multi Family Residence
Special Use District to accommodate the establishment of a dental clinic,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation at 3041 East Main Street, being lots 10 and 11 in Ravina Park Addition
be and is hereby changed to R-4 Multi Family Residence Special Use District to accommodate the
establishment of a dental clinic pursuant to Section 23.014 and in accordance with the provisions
of Article 48 of the Zoning Ordinance. The site plan is attached as Exhibit A. The following
- conditions shall apply.
1. Notwithstanding the definition of a dental clinic in article 13.17 of the Zoning
Ordinance, the special use herein shall be limited to two dentists and their support staff.
2. The existing curb cut on U.S. 40 shall be used only for ingress to subject premises.
3. The surface water drainage plan shall be approved by the City Engineer. Drainage from
the roof of the building shall be to the north and east. Drainage to the south which
exceeds the present natural drainage shall be diverted by underground drain to the
existing storm sewer in Southeast Parkway opposite the ingress and egress curb cut
onto Southeast Parkway.
4. The dental clinic shall observe customary business hours and shall not be open during
evenings, Sundays or holidays.
5. The landscaped buffer area shown on the site plan shall be designed and installed in a
manner which shall prevent automobile lights shining directly into the residential
property immediately south of subject prenuses.

Dear Ms. Lundy:
Please advise the members of Common Council that the Richmond Advisory Plan Commission
conducted a public hearing, Tuesday, October 26, 1993, on the petition of Keith W. and Virginia
L. Hodgkin requesting a rezoning of property located at 3041 East Main from R-3 Multi -family
Residence district to R-4 Multi -family Residence district to permit a dentist office as a "Special
Use".
Notices of the proposal were mailed to surrounding property owners. Two letters were returned,
one in favor and the other wanting more information. The neighbor wanting more information
appeared at the hearing in person and with counsel. Their concerns about the development have
been addressed, to their satisfaction, with the conditions imposed on the proposed development.
The Planning Staff recommends approval of the request. The 1990 Comprehensive Plan Map calls
for this area to be rezoned to commercial business. The proposed use as a dental office, for the
practice of not more than 2 dentists and their support staff, is allowed in the R-4 district as a special
use. A " special use" can be conditioned by Council to ensure its compatibility with the
surrounding neighborhood and to lessen the impact of the transition from residential to commercial
over the next several years.
The Planning Commission voted 10 - 1 to recommend that Council approve this request with the
following conditions:
Curb -cut to the site from US 40 be entry only; a site drainage plan be prepared to the satifaction of
the City Engineer, which will direct roof drainage to the north catch basin, if possible, and that
drainage to the south be taken to the catch -basin opposite the east entry/exit curb cut in Southeast
Parkway. Also, no run-off water in excess of what presently occurs will be allowed to run onto the
residence to the south.The dental office is to maintain reasonable business hours. A landscaped
buffer area shown on the site plan will be arranged and designed in a manner which will ensure
that automobile lights cannot shine through the fence into the property at 3112 Southeast Parkway.
The site plan is to be made a part of this ordinance.
