A General Ordinance Amending Chapter 154 of the Richmond Code, commonly
known as The Zoning Ordinance
WHEREAS the Plan Commission considers site plans showing the proposed use of
land, the arrangement of all buildings and structures, the location of streets
and driveways, parking and unloading areas, utility lines, sewage and water
facilities, drainage, buffer landscaping and other pertinent features as part of
the Special Use District, Article 48, of the Zoning Ordinance, and
WHEREAS visual enhancement of development sites is desirable whether it be new
construction, expansion or rehabilitation of existing structures, or
demolition, and
WHEREAS it is desirable to establish a Site Review Committee of the Plan Commission
to apply consistent and flexible standards to improve the appearance of the
City,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the Richmond Code, Chapter 154, be amended as follows:
A. Article 37 entitled "Airport Industrial Park District" is repealed.
B . Article 36.10 - An airport industrial park shall be a principal permitted use in the
Airport Zone District.
C. Article 36.11 n r : Any use which will not conflict with the operation of the
airport because of its proximity to the airport facilities and which use does not violate
the rules or regulations of the Aeronautics Commission of Indiana or Federal Aviation
Administration is a permitted use in an airport industrial park.
D. Article 36.12 Accessory Uses: Accessory uses, buildings or structures customarily
incidental to the principal use described in Article 36.10 shall be permitted
in conjunction with such use so long as the accessory uses, buildings or structures do
not violate any rule or regulation of the Aeronautics Commission of Indiana or of the
Federal Aviation Administration.
E. Article 36.13 Height. Lot Area, Frontage and Yard Requirements: Height, lot area,
frontage and yard requirements for all principal and accessory buildings, structures or
uses shall be regulated by and in accordance with the rules and regulations of the
Aeronautics Commission of Indiana and the Federal Aviation Administration.
F. Article 37 shall be entitled "Visual Enhancement District."
G . Article 37.01- The Commission shall appoint a Site Review Committee to conduct
hearings and approve applications on behalf of the Commission for Improvement
Location Permits in any area designated by the Zoning Ordinance as a Visual
Enhancement District.
H. Article 37.02 - The Committee shall consist of three members of the Commission
appointed by the President for a term of 1 calendar year with no limit on the number
of successive terms a person may serve.
I. Article 37.03 - The Commission may remove a member of the Committee without
cause upon the concurrence of six members of the Commission. Vacancies shall be
filled by appointment by the President for the unexpired term.
J. Article 37.04 - All actions by the Committee shall require 2 concurring votes and said
Committee shall meet on call after 48 hours notice by the Commission staff.
K. Article 37.05 - The Commission shall adopt development guidelines including the
species of plant material permitted, the density of plantings, the landscaping of water
run-off structures, and the requirements for visually enhancing the site consistent
with the manufactured materials chosen by the developer to be installed upon the site.
L. Article 38.05 -The Commission shall recommend to Common Council each area of
the City to be designated a Visual Enhancement District. Such District shall not stand
by itself but shall be combined with an existing zoning district. Land hereafter
designated as a Visual Enhancement District by Special Ordinance resulting in an
amendment of the Zoning Map, shall be identified by the symbol "VE" succeeding
the applicable symbol of the existing zoning classification.
M. Article 38.06 - An application for an Improvement Location Permit under Article
60.021 of the Zoning Ordinance which involves property located in a VE district shall
be referred promptly to the Commission staff for purposes of convening a meeting of
the Site Review Committee. The applicant shall submit a site plan to the Committee
and be personally present or represented by an attorney at the Committee's meeting
to review the site plan.
