ORDINANCE NO. 97-1993
A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 44 SOUTH 2ND
STREET
WHEREAS the zoning map designates, 44 South 2nd Street, Richmond, Indiana,
as M-1 Light Industrial District, and
WHEREAS it is desirable to change the zoning designation to C-2 Commercial District,
to accommodate its use for the construction of office buildings,
NOW, TBEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the real estate bounded on the north by East Main Street, on the east
by South 2nd Street, on the south by South A Street, and on the west by the right-of-way of the
CSX Railroad be and is hereby changed to C-2 Commercial District.
Passed and adopted this 6th day of December, 1993, by the Common Council of the City of
Richmond, Indiana.

Dear Ms. Lundy:
Please advise the members of Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Tuesday, November 22, 1993, on the
request of the Planning Director on land located at 44 South 2nd street.The area
involved includes the one block parcel of land West of the Wayne County jail to
the railroad tracks to the West, and from East Main street South to South "A" street.
The land is presently zoned M-1 light industrial.
A permit to construct an office building on the former. Pardo wrecker property was
issued, in error, by City officials. An office structure is allowed in an industrial
district only as a" special use."
The Planning staff recommended that the property be rezoned to C-2 retail
commercial which is a logical extension of the existing C-3 zoning located on the
Jail, Courthouse and City Building land. Land to the North and South is zoned
industrial.
Two (2) letters were sent to adjacent property owners. Only Charles Robinson of
Swayne Robinson replied and he has no objection to the request.
The Planning Commission voted 9-0 in favor of recommending Common Council
approve this rezoning request.

VACATION PETITION NO.2-1993
A PETITION TO VACATE THE FIRST ALLEY NORTH OF SOUTH A STREET BETWEEN SOUTH
2ND STREET AND THE CSX RAILROAD.
Comes now the Petitioner, Smarrelli General Contractor, Inc., owner of lots numbered 147 and 148 in John
and Samuel W. Smith's Addition to the City of Richmond, hereafter called "Smith Addition"; 41.41
feet off the east side of lot number 3 in J.P. Plummer's Addition to the City of Richmond, hereafter
called "Plummer Addition", and 29.54 feet off the east side of lot number 4 in Plummer Addition, and
petitions for the vacation of the first alley north of South A Street between South 2nd Street and the
CSX Railroad, which alley is shown by diagonal lines on attached Exhibit A.
This petition is filed pursuant to Indiana Code 36-7-3-12.
Common Council of the City of Richmond, Indiana, is requested to conduct a public hearing on this
petition within 30 days of the filing hereof and initiate an ordinance to bring about the vacation of the
public alley bounded on the south by the north lot line of lot number 4 in Plummer Addition, on the south
by the north lot line of lot number 148 in Smith Addition, on the east by the west line of South 2nd
Street, on the north by the south lot line of lot number 147 in Smith Addition, on the north by the south
lot line of lot number 3 in Plummer Addition and on the west by the east right-of-way line of the CSX
Railroad.
Wherefore petitioner requests the vacation of said public way as described herein.
