MAIN STREET
WHEREAS the zoning map designates 3641 East Main Street, Richmond, Indiana,
as R 4 Multi -Family Residence District, and
WHEREAS it is desirable to change the zoning designation to C-2 Commercial District,
to accommodate its use for retail business,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the real estate described in attached Exhibit A be and is hereby
changed to C-2 Commercial District.

The fol.lowi.ng,desczibed real estate situate in Wayne County,
in the State of Indiana, to -wit:
Being a part of the Northwest Quarter of Section 2, Township
13 North, Range 1 West in Wayne Township, Wayne County,
Indiana, and the Northeast Quarter of Section 3, Township 13
North, Range 1 West in the City of Richmond, Wayne County,
Indiana, and being more particularly described as follows:
Beginning at an iron rod found at the southeast corner of a
tract of land owned by Wal-Mart Stores, Inc., as recorded in
Deed Record 471, Page 611 in the Office of the Wayne County
Recorder, Wayne County, Indiana, said iron rod being more
particularly described as follows: Commencing at the
northwest corner of the Northwest Quarter of said Section 2,
and running thence south 00 degrees, 15 minutes and 00 seconds
east, along the west line of said Northwest Quarter, 533.00
feet to a point on the south line of said Wal-Mart tract;
thence north 89 degrees, 51 minutes and 00 seconds east, along
the south line of said Wal-Mart tract, 79.13 feet to the
beginning point of this description, and running thence from
said beginning point, north 00 degrees, 00 minutes and 00
seconds east, along the east line of said Wal-Mart tract,
111.1G feet to a point of curve; thence along the west line of

Dear Ms. Lundy:
Please advise the members of Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Tuesday, November 22, 1993, on the
request of Dorothy Thorman, et al, owners; Gayle Gardner, representing the
petitioner; to rezone from R-4 multi family residential district to C-2 retail
commercial district on property located at 3641 East Main Street. Adjacent property
owners registered no objections to the staff or at the hearing.
The planning staff presented the following recommendation;
State statutes set forth 5 factors for the Commission to consider in recommending changes in
zoning as follows:
a The Comprehensive Plan.
b. The current conditions and character of current structures and uses in each district.
c. The most desireable use for which the land in each district is adapted.
d. The conservation of property values throughout the jurisdiction of the Commission.
e. Responsible growth and development.
Much of this area is proposed in the annexation ordinance for C-2 zoning and was approved by
the Plan Commission and Council at that time. It is presently tied up in a court challenge
although this particular land area is not a part of the dispute. All five points mentioned above
have been found in favor of this request by the staff, the Commission and the Common Council at
previous hearings.
The Planning Commission voted 8-1 in favor of recommending approval of this rezoning to
Common Council.
