Chairman Scrivner called the meeting to order at 7:30 a.m. A quorum was present at this time.
The following guests were present: Gerald Kendrick, 1732 Tanner Bridge Road, David Treece and
Frank Kartmann with Missouri American Water Company, Jim Wisch, Brian Bernskoetter, Heath
Clarkston, Residents from Georgetown Subdivision: Joan Cage, Joyce Lewis, Bob Chiles, Carol Bell,
Carolyn Silvey, and Don & Edna Zehnder, Olivia Ingle with News Tribune and Madison Conklin with
KOMU 8 News.

Those present introduced themselves.
2. Approval of the March 20, 2014 and April 24, 2014 Committee meeting minutes
Councilman Schulte moved and Councilman Prather seconded to approve the March 20 and
April 24, 2014 minutes, motion carried.
3. Old Business
1. Building and Fire Code Appeal Commission (Janice McMillan)
Ms. McMillan explained the revisions included membership qualifications and residency
requirements.
There was discussion among Committee members, staff and those present regarding member
qualifications, sealed drawings and safety issues.

Chairman Scrivner requested this item be brought back with changes to the May Committee
meeting for further discussion.
2. Country Club Drive (David Bange)
Mr. Bange explained that he and Mr. Morasch had visited the properties and did observe
settlement. Staff has spoken informally with a structural engineer who explained the damage was
caused by a consolidation of the material under the concrete slabs which has allowed the floor slabs
to settle. Analysis of the traffic in the area of Georgetown found the average speed of vehicles to be
approximately 37 mph. The options of additional improvements that could be performed are diamond
grinding of the pavement at an estimated cost of $35,000 or a mill and overlay of the pavement with
an estimated cost of $215,000.
There was discussion among Committee members, staff and those present regarding
foundation settlement, speed of traffic (especially truck traffic), the possibility of lowering the speed
limit, and making Edgewood a truck route.
Mr. Crowell explained staff would study the issue further.
4. New Business
1. Water Company Maintenance Update (David Treece) (Matt Morasch)
Mr. Morasch explained there were still items not being addressed by the water company.
Mr. Bange explained staff has noted the Water Company’s main replacement activities.
There was discussion among Committee members, staff and representatives from Missouri
American Water, regarding public perception, maintenance activities, water main leaks destroying
subgrade of streets, and leak detection versus trenching.
2. Snow Removal and overtime Cost and Chemical Status (Britt Smith)
Mr. Smith explained due to the severe winter weather, staff is requesting a supplemental
appropriation of $200,000 to be used to fill our stockpile with salt and cover overtime expenses
incurred during the winter season.
There was discussion among Committee members and staff regarding cost of snow removal
and budgeting appropriately for costs.
Committee members will discuss the issue further with Mr. Crowell.
3. Cole Junction Pump Station Opening (Eric Seaman)
Mr. Seaman gave an update on the Cole Junction Pump Station. Staff is proposing an open
house the week of May 19th.
Councilman Schulte requested signage “completed as promised” be put up for the finished
project.
4. Insurance Proceeds for Damaged Structures (Jeremy Cover/Janice McMillan)
Ms. McMillan explained the draft ordinance would provide the City the ability to retain
insurance proceeds to ensure the property owner takes care of the structure prior to insurance
payment.

Councilman Schulte moved and Councilman Prather seconded to refer the draft ordinance to
the City Council with recommendation to approve, motion carried.
5. Cancellation of the Governor Hotel Parking Lease (Drew Hilpert)
Mr. Smith explained the State lease of 150 spaces within the City’s parking garage for the
Hotel Governor.
Committee members agreed to send notice to cancel the current lease and renegotiate a new
lease.

Ms. McMillan referred Committee members to the reports included in the packet

Issues
Gerald Kendrick,1732 Tanner Bridge Road, spoke requesting sidewalks along the even
addressed side of Tanner Bridge Road.
There was discussion among Committee members, staff and Mr. Kendrick regarding the
sidewalk master plan and requesting a neighborhood improvement project.

Councilman Prather moved and Councilman Schulte seconded to adjourn the meeting at this
time (9:35 a.m.), motion carried.

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, creating the Building
and Fire Code Appeal Commission
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. Chapter 8 (Buildings and Building Regulations) Section 19
(Amendments) is amended as follows:
Section 113.1: MEANS OF APPEAL:
Any owner, agent or other person shall have the right to appeal a decisi on of the code official refusing to grant a
modification to the provisions of this code covering the manner of construction and/or materials to be used in the
erection, alteration or repair of a building or structure. An application for appeal shall be bas ed on a claim that the
true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of
this code do not fully apply, or an equivalent form of construction can be used. The appeal shall be to the Building
and Fire Code Appeal Commission as provided in chapter 7 of the City Code circuit court of Cole County as
established in Article 536 of the Revised Statutes of Missouri.
Section 2. Chapter 13 (Fire Prevention and Protection) Section 108 APPEAL is
amended as follows.
108.1. Any owner, agent or other person shall have the right to appeal a decision of the code official refusing to
grant a modification to the provisions of this code covering a claim that the true intent of this code or the rules
legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply or an
equally good or better method of fire prevention is used. The appeal shall be to the Building and Fire Code Appeal
Commission as provided in chapter 7 of the City Code circuit court of Cole County as established in Article 536
of the Revised Statutes of Missouri.
Section 3. Chapter 7 (Boards and Commission) is hereby amended by the
addition of a new article XXII (Building and Fire Code Appeal Commission ) as follows:
Sec. 7-740. Established/purpose
There is hereby created the Building and Fire Code Appeal Commission whose purpose shall be to rule on
requests for variances to the Building Code and Fire Code which allege the true intent of the code or the rules
legally adopted thereunder have been incorrectly interpreted, the provisions of the code do not fully apply, an
equally good or better form of construction can be used, or undue hardship is created by strict compliance
with the letter of the code but has no significant effect on the health, safety and welfare of the public or any
individual. The Commission may not grant a variance when the appeal is based upon an ordinance being an
incorrect policy for the City. The Commission shall also be charged with reviewing proposed building and
fire code changes when requested.
Sec. 7-741 Members; Terms; Appointment; Officers
A. Membership. The Commission shall consist of five (5) members and three (3) alternates.
B. Appointment. The first appointments to the Commission shall be as follows: two regular members
and one alternate shall be appointed to serve for three (3) years, the second two regular members
and one alternate shall serve for two (2) years and the final one member and one alternate shall serve
for one year. Thereafter, each new member & alternate shall be appointed for three (3) years or until
a successor has been appointed. Appointments to fill vacancies shall be for unexpired terms only.
C. Qualifications. The commission shall be composed of persons with the following qualifications:
1. Professional engineer (experience in electrical/mechanical); or
2. Professional engineer (experience in structural/civil); or
3. Fire protection engineer or person with five years’ experience in fire prevention; or
4. Registered architect; or
5. Commercial general contractor; or
6. Person currently employed as a commercial (non-residential) building facilities
manager/director.
The Regular members shall consist of at least four members from categories 1, 2. 3 and 4 with not
more than two members shall be from the same category, unless no member can be found serve with
said qualifications. The final regular member and alternates may be made up of any combination of
the above referenced categories. Persons residing within the City shall be given preference; however,
if no qualified City resident is available, non-residents may be appointed to the Commission.
D. Commission chair, vice chair, and secretary. The Commission shall select from its members a
chairperson and vice chair. The vice chair shall chair the meetings in the absence or disqualification
of the chairperson. The Director of Planning and Protective Services or his/her designee shall serve
in ex-officio capacity as secretary to the Commission, who shall keep a detailed record of all
proceedings on file in the Planning and Protective Services department and submitted to the City
Clerk.
E. Quorum. A quorum of members shall be three.
Sec. 7-742. Alternates.
During the absence of a regular commissioner, an alternate shall be appointed by the Chair to sit on the
commission for the hearing before the commission. The most senior alternate shall be appointed or if there is
no senior alternate the Chair may appoint the alternate he/she feels is best suited to the appeal. In such
circumstances the alternate shall have the full power and authority of the regular commissioner.
Sec. 7-743. Application for appeals.
A. Definitions for this section. As used in this section, code official shall mean any person charged or
authorized to enforce or interpret the Building Code or Fire Prevention code, but shall not include
the Board of Adjustment.
B. Who may appeal. The owner of a building or structure or any person directly affected by a decision
of a code official may appeal to the Commission any decision of the code official refusing to grant a
modification, variance, or waiver to the provisions of the Building code or Fire Prevention code
covering the manner of construction or materials to be used in the construction, erec tion, alteration,
or repair of a building or structure.
C. Grounds for Appeal. Application for appeal may be made when it is claimed that the true intent of
the code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions o f
the code do not fully apply, an equally good or better form of construction can be used, or undue
hardship is created by strict compliance with the letter of the code but has no significant effect on the
health, safety, and welfare of the public or any individual.
The appeal may not be based upon whether the ordinance adopted is the correct policy for the City.
The City Counselor is authorized to reject any appeal application which does not conform to the
grounds for appeal stated above. Any appeal o f the City Counselor’s decision shall be to the circuit
court.
D. All appeals must be in writing on a form developed by the City.
1. The appeal application must enumerate all issues and alternatives which the applicant
wishes to raise.
2. If the appeal is based upon an alternative which is claimed to be equally good or better form
of construction, the appeal cannot be granted without a condition precedent that requires an
architect or engineer to seal the proposal.
E. A fee as provided in schedule Y of the City Code shall be submitted with the application.
F. This appeal is in lieu of any appeal process created in the International Building Code, the
International Fire Code, or any appeal to the Board of Adjustment.
Sec. 7-744. Appeal Hearings.
A. Date of Appeal Hearing.
1. Appeals shall be heard within 15 working days of the filing of an appeal.
2. In order to hear an appeal the chairman shall call a meeting of the Commission to hear the
appeal at any time in which a quorum may be gathered.
3. The Director of Planning and Protective Services shall notify the applicant of the date of the
meeting at least five (5) days before the date of the hearing. The applicant may waive the
five (5) day notice requirement in writing.
B. Continuances. If less than four (4) members are present to consider a specific appeal, the appellant
shall be entitled to a continuance of the meeting. Either side may be granted a continuance if a
necessary and proper person cannot be available for the hearing. The Chair shall rule on any such
motion.
C. Exemption of members. A member of the Commission shall not vote on any question in which that
member is engaged as contractor, material dealer, or in the preparation of plans or specifications, or
in which the Commission member has any personal interest.
D. The Hearing procedure for all hearings brought under this section shall be as follows:
1. Procedures:
a. The Hearing shall be open to the public and on the record and all meetings of this body
shall comply with Missouri’s sunshine law.
b. The Chairperson shall conduct the hearing and shall rule upon all motions by the
parties.
c. Any party to the Hearing may be represented by counsel and have the right to present
evidence.
d. The technical rules of evidence shall not apply in the hearing. Any relevant evidence
may be admitted and considered by the Chairperson if it is the sort of evidence of which
responsible persons are accustomed to rely in the conduct of serious affairs. Objections
to evidence shall be noted and a ruling given by the Chairperson.
e. All testimony shall be under oath, which may be administered by the Chairperson.
f. A recording shall be made by the City or a written record of the hearing may be made
by a court reporter to be employed by the City, the cost of which shall be paid by the
City should the proceeding be eventually held against the City and by the applicant if it
should not.
g. The burden of proof shall be on the party filing the appeal.
h. All decisions by the Commission must be made upon substantial and competent evidence
presented at the hearing.
2. Conduct of the Hearing.
a. The Chairperson shall proceed in the following manner. The City will be allowed to
present its evidence first. Witnesses called by the City will be directly examined with an
opportunity for the opposing party to cross-examine, followed by an opportunity for the
City to re-direct. The Chair may then allow questions to be asked by Commission
members. Once the City’s case is presented, the appellant will have an opportunity to
present his or her case. The same procedure for questioning witnesses will be followed.
Then the City will have an opportunity for rebuttal, if it so chooses.
b. At the conclusion of the evidence the Commission shall, by motion, affirm, modify or
reverse the decision of the code official by a concurring vote of three (3) of its members.
c. The appellant may request that the Commission issues findings of facts and conclusions
of law explaining the decision based upon the evidence presented. Upon such request
the Chairman with the assistance of the City Counselor shall issue such findings fact
within 30 days of the date of the hearing. If the appeal is granted the building permit
shall be issued within a reasonable time after issuance of the findings of fact.
d. Notice of the decision shall be provided to all parties pursuant to Chapter 536 RSMo.
e. Any person aggrieved by this decision, including the city, shall, within 30 days after
notice of the ruling as required by Chapter 536 RSMo., file his or her administrative
appeal pursuant to the rules established in Chapter 536 RSMo., for review of a contested
case in the circuit court of Cole County. If no action is taken to appeal the decision of the
administrative hearing officer as required by Chapter 536 RSMo., the decision shall be
final.
Sec. 7-745. Other Duties of the Commission
A. Code Revisions.
1. The Commission shall, at the request of the Director of Planning and Protective Services,
review currently adopted building and other codes periodically for updating and
recommending changes.
2. The Commission shall, at the request of the Director of Planning and Protective Services,
review and make recommendations of new building and other codes being considered for
adoption.
Section 4. Appendix Y is amended as follows:
Sec. 7-740. Appeal to Building and Fire Code Appeal Commission $120.00
Section 5. This Ordinance shall be in full force and effect from and after the
date of its passage and approval.

A RESOLUTION REGARDING
THE USE OF CIP SALES TAX
FOR THE LAFAYETTE ENHANCEMENT PLAN
RS2014-
Sponsor:
WHEREAS, the County and MoDOT are proposing to spend $1.5 Million dollars on
enhancements of the Lafayette interchange in an effort to beautify the overpass and
surrounding area; and
WHEREAS, the County and MoDOT need a funding plan to be adopted by June 2014;
and
WHEREAS, the funding for these enhancements is proposed to be as follows: County
$1,000,000, City $500,000, while MoDOT funds the interchange; and
WHEREAS, MoDOT will contract with the County for the enhancement funding directly
and the County and City would have a separate agreement; and
WHEREAS, the City's funds would come from the portion of the sales tax dedicated to
City County projects; and
WHEREAS, the Council believes this is a proper and appropriate use of Sales Tax funds;
and
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Jefferson
hereby approves the use of Sales Tax for this project and directs staff to move forward
with agreements necessary to accomplish this purpose.

RE: Emergency Solutions Grant (ESG)
Staff has been approached by a State agency representative asking the City to
consider applying for Emergency Solutions Grant (ESG) funds on behalf of three local
nonprofit agencies. Staff proposes to submit a resolution to the Council authorizing the
City’s application.
The Missouri Housing Development Commission administers the State of MO
ESG program. The ESG program funds are used for homelessness prevention, rapid re-
housing, street outreach, emergency shelter, and administrative activities. These funds
are provided through a federal grant from the Department of Housing and Urban
Development (HUD).
The City would be eligible to apply for up to $50,000 per sub-grantee totaling
$150,000. The Notice of Funding Availability is expected to be released in September;
with applications due in late November and funds awarded in February.

CITY OF JEFFERSON
DEVELOPMENT AGREEMENT
THIS AGREEMENT (hereinafter “Agreement”) entered into this ____ day of ________,
20____, by and between the City of Jefferson, Missouri, a municipal corporation, hereinafter
referred to as “City,” and GTLR Development Corp., hereinafter referred to as “Developer.”
WITNESSETH:
WHEREAS, City may enter into agreements from time to time to ensure the orderly
development of property in and around the City; and
WHEREAS, City and Developer have held a series of meetings and negotiations in order
to advance their mutual interest as it relates to the development commonly known as Covington
Gardens Subdivision, hereinafter referred to as the “Property;” and
NOW THEREFORE, in consideration of the mutual promises and covenants hereinafter
set forth, and for other good and valuable consideration, City and Developer do hereby covenant
and agree as follows:
1. Developer shall:
a. Construct and complete all remaining sidewalks within the Property pursuant to
the following schedule:
i. Newcastle Lane and Newcastle Court by May 31, 2015;
ii. Hampshire Drive and Hastings Road by May 31, 2016;
iii. Westminister Drive by May 31, 2017.
b. Mow and maintain all unsold lots according to the following specifications:
i. Newcastle Lane and Newcastle Court, from lot line to lot line;
ii. Hampshire Drive and Hastings Road, any portion that is within ten (10)
feet from any house lot line and thirty-five (35) feet back from the curb;
iii. Westminister Drive, any portion that is within ten (10) feet from any curb,
until any lot on Westminster Drive is sold, at which time unsold lots shall
be mowed thirty-five (35) feet back from the curb and ten (10) feet back
from the lot line adjoining sold lots.
iv. Mow grass and weeds at a frequency that maintains the height at twelve
(12) inches or less;
v. Maintain lots free of construction debris unless an active building permit
has been issued.
c. Complete sanitary sewer and access road to detention basin at the Property in
accordance with the approved plan by August 31, 2014.
d. Maintain erosion and sediment control measures, including established
vegetation, on unsold lots until lots have been sold.
e. Maintain stormwater inlet protection until lots are built out.

2. City shall:
a. Accept rights-of-way, easements, and all improvements thereon upon completion
of sidewalks and other infrastructure required by the Cit y Code and approval by
the City Engineer.
b. Not issue any building permits for lots on Westminister Drive if there is any
deviation from the sidewalk schedule stated in Paragraph 1(a).
c. Allow improvements to occur as stated in Paragraph 1.
3. General provisions.
a. All elements of development and infrastructure at the Property shall comply with
the ordinances, regulations, and standards of City that are not inconsistent with
this Agreement.
b. The parties acknowledge and agree that the Developer’s agreement to perform
and abide by the covenants and obligations of Developer set forth herein is
material consideration for City’s agreement to perform and abide by the
covenants and obligations of the City set forth herein.
c. This Agreement shall not be binding on either party until after the agreement has
been approved by passage of an ordinance by the City Council and the signature
of the Mayor has been affixed.
4. Continuation of obligations.
a. The promises and covenants herein shall run with the Property and shall be
construed as real covenants running with the land.
b. The provisions of this Agreement shall be binding on the parties’ agents, assigns,
and successors in interest, provided however that nothing in this paragraph shall
be construed as requiring a successor in interest to less than the full property to
perform any work or fulfill any obligation except those which apply to the parcel
that such successor owns.
5. Modification of Agreement.
This Agreement shall not be modified or amended except by a written instrument
approved and signed by the parties hereto.
6. Severability.
Any illegal or unenforceable provision of this Agreement will be severed here
from and will not render invalid the remaining provisions of this Agreement.
7. Law to govern.
a. This Agreement shall be construed according to laws of the State of Missouri.
b. Developer shall comply with all local, state, and federal laws and regulations
relating to the performance of the Agreement.

Any communications between the City and the Developer, payments and notices
provided herein to the given or made, may be given or made by mailing the same
to City at City of Jefferson, Attn: City Engineer, 320 East McCarty, Jefferson
City, Missouri 65101 and to Developer at GTLR Development Corp., c/o Greg
Bemboom at 114 E. High Street, Jefferson City, Missouri 65101, or to such other
addresses as either party may in writing hereafter indicate.
