ORDINANCE NO. 44 992
A SPECIAL ORDINANCE VACATING A PORTION OF THE RIGHT-OF-
WAY OF ALLEYS LOCATED BETWEEN NORTH 12TH AND NORTH
13TH STREETS AND NORTH F AND NORTH G STREETS.
WHEREAS, Primex Plastics Corporation, Paul J. and Norma V. Bertsch and
William G. Martin, Sr., have petitioned the Common Council of the City
of Richmond, Indiana, requesting vacation of a portion of a public way in
alleys located between North 12th and North 13th Streets and North F and
North G Streets; and,
WHEREAS, the Common Council, pursuant to I.C. 36-7-3-12, conducted a public
hearing on said vacation petition on February 3, 1992; and,
WHEREAS, a public hearing pursuant to R.C. 155.04(B) was conducted by the
Richmond City Plan Commission on the 28th day of January 1992; and,
WHEREAS, the Richmond City Plan Commission voted in favor recommending
passage of the requested vacation,
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana, that, subject to the preservation of an easement for
existing utilities, the public right-of-way described below is hereby
vacated.
Part of the 20 foot alley running north and south from
North F Street to North G Street lying in the City of
Richmond, Indiana and being more particularly described as
follows:
Beginning at the southeast corner of Lot 3 in that part of the
City of Richmond laid out by Hugh Moffitt; thence in a
northerly direction 171 feet more or less to the northeast
comer of Lot 14 in said Hugh Moffitt's Addition; thence in
an easterly direction 20 feet more or less to the northwest
corner of Lot 7 in said Hugh Moffitfs Addition; thence in a
southerly direction 171 feet ' more or less to the southwest
comer of Lot 4 in said Hugh Moffitt's Addition; thence in a
westerly direction 20 feet more or less to the place of
beginning.
Also; all of the 10 foot alley running east and west from
North 12th Street to North 13th Street lying in the City of
Richmond, Indiana and being more particularly described as
follows:

Beginning at the southwest comer of Lot 14 in that part of
the City of Richmond Iaid out by Hugh Moffitt; thence in a
easterly direction 350 feet more or less to the southeast
corner of Lot 7 in said Hugh Mofiitt's Addition; thence in a
southerly direction 10 feet more or less to the northeast
corner of Lot 6 in said Hugh Moflitt's Addition; thence in a
westerly direction 350 feet more or less to the northwest
corner of Lot 1 in said Hugh Moflitt's Addition; thence in a
northerly direction 10 feet more or less to the place of
beginning.
PASSED AND ADOPTED this 3rd day of February, 1992, by the Common Council of
the City of Richmond, Indiana.
