AN ORDINANCE, declaring the necessity for the acquisition of easements and
temporary easements in certain real property within The Metropolitan St. Louis Sewer District for
the purpose of construction of sewers and related appurtenances in the project known as E. Watson
Sanitary Relief (Rusdon Ln to Richview Dr) (12152) in the Cities of Crestwood a nd Sunset Hills,
Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further
condemnation efforts related to the project, including but not limited to the purchase and/or the
filing of all necessary court pleadings or documents to commence and prosecute formal legal
proceedings for the acquisition of said easements and temporary construction easements .
WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area
of Sunset Hills and Crestwood, St. Louis County, Missouri within the Gravois Creek Watershed
wherein numerous people live and work;
WHEREAS, sewage gathered from such area will have no adequate means of
disposition, and will constitute a menace to public health and welfare of the general public and the
residents of The Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer
District to protect the public health and welfare by construction, reconstruction, maintenance or
repair of sewers and related appurtenances on, over and across said area in order to relieve and
alleviate these conditio ns.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and relieve dangerous conditions,
it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise
easements and temporary construction easements in real property for the construction of sewers
and related appurtenances in the project known as E. Watson Sanitary Relief (Rusdon Ln to
Richview Dr) (12152) hereinafter set forth, said easements and temporary easements being more
particularly described below:
Parcel #13
A SEWER EASEMENT, being part of Lot 56 of Eddie Estates Plat 1 as recorded in Plat Book 81,
Page 16 of the St. Louis County Records and located in the City of Crestwood, St. Louis County
Missouri, being more particularly described as follows:
COMMENCING at the Southeast corner of said Lot 56; THENCE along the Southerly line of Lot
56, South 52 degrees 49 minutes 12 seconds West, 106.81 feet to the POINT OF BEGINNING;
THENCE continuing along the Southerly line said Lot 56, South 52 degrees 49 minutes 12 seconds
West, 13.94 feet to the most Southwest Corner of said Lot 56; THENCE departing said Southerly
line and along the Westerly line, North 53 degrees 55 minutes 18seconds West, 82.21 feet to the
Northwesterly corner of said Lot 56; THENCE departing the said Westerly line and along the
Northerly line of Lot 56, North 54 degrees 50 minutes 42 seconds East, 18.86 feet to a point;
Thence departing the Northerly line of Lot 56, South 50 degrees 42 minutes 29 seconds East, 80.53
feet to the POINT OF BEGINNING, Excepting therefrom that portion covered by the existing
easements recorded in Plat Book 81, Page 16 of said St. Louis County Records, containing 870
square feet or 0.020 acres more or less.
Also, a 5 FOOT TEMPORARY CONSTRUCTION EASEMENT, for use during construction of
any sewer in the above described SEWER EASEMENT, said 5 FOOT TEMPORARY
CONSTRUCTION EASEMENT being more particularly described as follows:
A 5 FOOT TEMPORARY CONSTRUCTION EASEMENT
A 5.00-foot-wide TEMPORARY CONSTRUCTION EASEMENT being parallel and adjacent to
the North side of the above described SEWER EASEMENT, containing 402 square feet or 0.009
acres more or less.
THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion
of the above described sewer construction.
Parcel #15
A SEWER EASEMENT, being part of Lot 54 of Eddie Estates Plat 1 as recorded in Plat Book 81,
Page 16 of the St. Louis County Records and located in the City of Crestwood, St. Louis County
Missouri, being more particularly described as follows:
BEGINNING at the most Northerly corner of said Lot 54; THENCE along the Easterly line of said
Lot 54 also being the West Right of Way line of Rusdon Lane 50 feet wide, South 37 degrees 10
minutes 48 seconds East, 5.00 feet to a point; THENCE departing said Easterly line also being the
said West Right of Way line, South 52 degrees 49 minutes 12 seconds West, 87.14 feet, THENCE
South 21 degrees 42 minutes 18 seconds East, 72.93 feet to a point on the Southerly line of said
Lot 54; THENCE along the Southerly line of said Lot 54, South 59 degrees 50 minutes 27 seconds
West, 17.19 feet to the most Southerly corner of said Lot 54; THENCE along the Westerly Line
of said Lot 54, North 21 degrees 42 minutes 18 seconds West, 76.19 feet to the most Westerly
corner of said Lot 54; Thence along the Northerly line of said Lot 54, North 52 degrees 49 minutes
12 seconds East, 103.33 feet to the POINT OF BEGINNING, Excepting therefrom that portion
covered by the existing easements recorded in Plat Book 81, Page 16 of said St. Louis County
Records, containing 866 square feet or 0.020 acres more or less.
Also, a 5 FOOT TEMPORARY CONSTRUCTION EASEMENT, for use during construction of
any sewer in the above described SEWER EASEMENT, said 5 FOOT TEMPORARY
CONSTRUCTION EASEMENT being more particularly described as follows:
A 5 FOOT TEMPORARY CONSTRUCTION EASEMENT
A 5.00 foot wide TEMPORARY CONSTRUCTION EASEMENT COMMENCING at the most,
Northerly corner of said Lot 54; THENCE along the Easterly line of said Lot 54 also being the
West Right of Way line of Rusdon Lane 50 feet wide, South 37 degrees 10 minutes 48 seconds
East, 5.00 feet to a point; THENCE departing said Easterly line also being the said West Right of
Way line, South 52 degrees 49 minutes 12 seconds West, 81.95 feet to the POINT OF
BEGINNING, THENCE South 21 degrees 42 minutes 18 seconds East, 73.57 feet to a point on
the Southerly line of said Lot 54; THENCE along the said Southerly line, South 59 degrees 50
minutes 27 seconds West, 5.05 feet; THENCE departing said Southerly line, North 21 degrees 42
minutes 18 seconds West, 72.93 feet to a point; THENCE North 52 degrees 49 minutes 12 seconds
East, 5.19 feet to the POINT OF BEGINNING containing 366 square feet or 0.008 acres more or
less.
THE TEMPORARY CONSTRUCTION EASEMENT will become null and void upon completion
of the above described sewer construction.
Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is
hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue
with the condemnation process by preparing and/or filing all necessary court pleadings and
documents to institute and prosecute legal action s in condemnation to acquire all easements for
the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St.
Louis Sewer District and the laws of the State of Missouri for the appropriation of private property
rights as hereinabove set out.
The foregoing Ordinance was adopted on July 9, 2020.
