ORDINANCE NO. 71317
AN ORDINANCE OF THE CITY OF TEMPLE CITY
ADDING NEW SECTION 9278.1 TO THE TEMPLE
CITY MUNICIPAL CODE RELATING TO NON-
CONFORMING STRUCTURES.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The Planning Commission of the City has
heretofore determined and declared as follows:
(a) That a request has been made for the
establishment of appropriate zoning regulations
to allow certain expansions and additions to non-
conforming structures; and
(b) That the present zoning regulations do
not allow such additions and expansions; and
(c) That the public interest, convenience
and necessity require the amendment of said
zoning regulations of the City to allow such
expansions and additions in the manner herein-
after prescribed.
SECTION 2. The City Council, based upon the procedure
prescribed by State law, concurs therein.
SECTION 3. Section 9278.1 is hereby added to the
Temple City Municipal Code, to read as follows:
Section 9278.1. Additions to Non - Conforming
Structures.
Notwithstanding any other provisions of this
Zoning Code, any residential unit, or units, includ-
ing accessory uses, located on any residential (R)
zoned lot, may be altered, expanded, extended or
remodeled with said alteration, expansion, extension
or remodeling encroaching into any required yard
area, if:
(1) Any outside wall of the proposed
addition shall encroach no farther into any
required yard area than any existing wall
and at least one wall of the addition shall
be substantially a straight line continua-
tion of an existing wall; and
(2) Said encroachment, other than an
encroachment by an accessory structure having
setback requirements established by Sections
9334.4, 9334.5, 9353.4, 9353.5, 9364.4 or
9364.5 of this Code, maintains a minimum
distance of at least three (3) feet from any
side or any rear lot line, where said encroach-
ing structure is of a single story nature, or
