ORDINANCE NO. 71 -318
AN ORDINANCE OF THE CITY OF TEMPLE CITY
ENACTING AN INTERIM ZONING ORDINANCE
PURSUANT TO SECTION 65858 OF THE
CODE, ESTABLISHING A NEW "C-1.1'_.: EXCLUSIVE
COMMERCIAL ZONE IN THE CITY AND IMPOSING
THE REGULATIONS THEREOF UPON CERTAIN
PARCELS. AND AREAS OF THE CITY, PENDING
CURRENT STUDIES FOR PERMANENT AMENDMENT
OF THE ZONING CODE.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City does hereby find and determine that
the amendments hereinafter set forth in Sections 2 and 3 hereof
have been undertaken for consideration, in good faith, by the
Planning Department and Planning Commission of the City and
that said Planning Commission is, or will be, holding public
hearings thereon; it is further found and determined that it
is necessary to protect the public health, safety and welfare
that this City enact, as an emergency ordinance, a prohibition
against all persons from violating the said proposals of
the Planning Department, all in the manner provided in Section
65858 of the Government Code.
SECTION 2. New Regulations.
Section 9399. "C-1" Retail Commercial Zone.
The following regulations shall apply in the
"C-1" Retail Commercial Zone unless otherwise
provided in this Chapter. This zone is established
in order to guide and promote proper land use and
development of commercial property for intensive
retail establishments in order to realize the full
potential of public parking districts and pedestrian
mall type shopping centers.
Section 9399.1. Uses Permitted.
A. The following retail uses may be conducted
provided the same involve the sale of new products only,
at retail and not for resale, and are conducted entirely
within enclosed buildings:
1. Appliances, household (retail sales arid
minor repairs).
2. Art stores.
3. Automobile supply stores (retail sales
of new parts only) .
4. Bakery and confectionary shops
(processing shall be permitted only
when incidental to retail sales).
5. Banks, savings and loan associations.

6. Barbers, beauticians and cosmetologists.
7. Bicycle stores, unmotorized cycles only.
8. Book or stationery stores.
9. Camera shops.
10. Clothing or millinery stores.
11. Department stores.
12. Dispensing opticians.
13. Drapery stores.
14. Drug stores and prescription pharmacies.
15. Dry goods or notions stores.
16. Florist shops.
17. Food markets.
18. Furniture stores.
19. Hardware stores.
20. Health food stores.
21. Hobby shops.
22. Jewelry stores.
23. Liquor stores, off -sale only.
24. Locksmith stores.
25. Music stores.
26. Paint stores.
27. Parking lots, commercial, provided that
a conditional use permit is first obtained.
28. Pet shops.
29. Photograph studios.
30.a. Radio and T.V. stores, (retail sales and
minor repairs )
30a Restaurants subject to CUP requirement in any.
31. Shoe stores.

32. Sporting goods stores.
33. Tobacco stores.
34. Toy stores.
35. Travel bureaus.
36. Other retail sales uses as the Planning
Commission and City Council may deem
to be similar and not more obnoxious or
detrimental to the public health,
safety and welfare.
B. The following uses are permitted provided,
however, that they shall not be located on the ground
or main floor of the building:.
1. Business and professional offices.
2. Lodges or meeting halls.
3. Medical clinics.
C. Products made, and services rendered,
entirely incidental to a permitted use may be sold
at retail, and dispensed, on the premises.
Section 9399.2. Prohibited Uses.
The permitted :''!C4°!:` uses shall not include, and
there shall ::he excluded therefrom the following uses:
1. Wholesale business establishments.
2. Any enterprise or use which produces,
causes or emits any dust, gas, smoke,
glare, noise, fumes, odors or vibrations
or which is or may be detrimental to the
safety, welfare, health, peace and
morals of the City and its residents.
3. Billboards and off - premise advertising
structures.
4. Any use not specifically authorized in
Section 9399.1.
Section 9399.3. Standards of Development.
The standards of development shall be the same as
those standards in the "C -2" zone as specified in
Section 9391 et seq. of this Code.

SECTION 3. The regulations prescribed in Section 2 hereof
are hereby imposed upon those areas, parcels and lands described
as follows:
All of those properties, within the City of
Temple City, presently zoned C -2, fronting upon
Las Tunas Drive between Oak Avenue on the west and
Kauffman Avenue on the east.
SECTION 4. Any and all provisions of the existing Zoning
Code inconsistent or contrary to the provisions of Sections
2 and 3 hereof are hereby suspended during the term of this
Ordinance.
SECTION 5. From and after the date of the adoption of
this Ordinance, no use shall be permitted nor shall any permit
or approval be issued to any lot or parcel of ground in any
of the areas described in Section 3 hereof, except in compliance
with the provisions of Section 2 hereof.
SECTION 6. It shall be unlawful for any person to violate
any of the proposals of the Planning Department as set forth
in Sections 2 and 3 hereof.
SECTION 7. This Ordinance shall remain in effect until
May 1, 1971, whereupon it shall expire and be of no further
force or effect.
SECTION 8. This Ordinance shall become immediately
effective pursuant to the provisions of Section 65858 of the
Government Code and for the reasons above stated, and is
adopted pursuant to the authority of Anderson vs. Pleasant
Hills, 229 CA 2d 79; Metro Realty vs. Co. of El Dorado, 222
CA 2d 508; Hunter vs. Adams, 180 CA 2d 511; Los Angeles vs.
Superior Court, 221.ACA 151; 44 A.G. Ops 14; and Slater vs.
Los Angeles, 238 ACA 937.
SECTION 9. The City Clerk of the City of Temple
City shall certify to the passage and adoption of this
Ordinance and to its approval by the Mayor and shall cause
the same to be published in the Temple City Times, a
newspaper of general circulation, printed, published and
circulated in the City of Temple City.

ordinance at a regular meeting of the City Council of the
City of Temple City, -held on the 2nd day of February
1971, and was duly passed, approved and adopted by said
Council, approved and signed by the Mayor and attested by
the City Clerk by the following vote of the Council:
