HomeMy Public PortalAbout02/16/99 CCM31 MEDINA CITY COUNCIL MEETING MINUTES OF FEBRUARY 16, 1999 The City Council of Medina, Minnesota met in regular session on February 16, 1999 at 7:35 p.m. in the City Hall Chambers. Mayor John Ferris presided. Members present: Ferris, Zietlow, Johnson, and Smith. Members absent: Hamilton. Also present: Police Chief Ed Belland, Attorney Ron Batty, Public Works Director Jim Dillman, Planning & Zoning Administrator Loren Kohnen, and City Clerk -Treasurer Paul Robinson. 1. Additions to the Agenda A. Ice Cream Social. Moved by Jim Johnson, seconded by Carolyn Smith, to approve the agenda as amended. Motion passed unanimously. 2. Approval of the Minutes from February 2, 1999 Two corrections. A. Page 5, paragraph 3, middle of the sentence, erase 1.2 and add after candle power, "requirements of the glare ordinance". B. Page 6, item 14, change "Planning Commission" to "Communications Commission". Moved by Jim Johnson, seconded by Phil Zietlow, to approve the minutes as amended. Motion passed unanimously. 3. Consent Agenda A. Resolution 99-11 Approving the Preliminary Plat for C.C.&M. Moved by Jim Johnson, seconded by Carolyn Smith, to approve the consent agenda. Motion passed unanimously. 4. Comments from Residents in Attendance on Items Not on the Agenda Madeline Link from Morgan Road said she wanted to comment on the straw vote taken at the last planning commission meeting on a proposed change to the rural residential subdivision ordinance. She said it seemed pretty much unanimous that the planning commission was not interested in changing the soil requirements from five acres to two and a half acres. She encouraged the city council to keep the center of the city rural and go forward with as slow a growth as possible. She thanked the planning commission. Patrick Zilverberg of 1392 Medina Road said that he seconded that opinion. 5. Park Commission Comments There were none. 6. Planning Commission Comments There was some discussion about the implications of the Polaris project concerning the paving of Chippewa Trail. Carolyn Smith said the city needs to look into a feasibility study for upgrading Chippewa Trail. There was some discussion about the timing of the project. Medina City Council Meeting Minutes February 16, 1999 32 Jim Dillman and Loren Kohnen suggested they could place that issue on the next agenda since the Polaris CUP would also be addressed at that meeting. 7. Blackfoot Trail Ron Batty said before the city council meeting, the Blackfoot Trail residents held a neighborhood meeting. Five of the seven owners living on Blackfoot Trail were in attendance. He said it was a successful meeting and the residents all agreed that the current agreement does not work. They would like to ask the city to nullify the current agreement. Batty said if the city council agrees, the paving of the Blackfoot Trail would proceed, at some time in the future, as any other road project within the city. John Ferris said that this road probably would not have the same priority as others. Ron Batty said that Jim Dillman pointed out that this project would not take place for several years. Ron Batty said he would draft an agreement nullifying the existing agreement and bring it to the city council at a future meeting. 8. Summer Position Jim Dillman requested approval to hire a temporary employee for the summer as has been done in previous years. Moved by Phil Zietlow, seconded by John Ferris, to approve the summer position. Motion passed unanimously. 9. Road Materials Jim Dillman said that plans and specifications were included in the council information. He said the city council would need to authorize advertising for bids and setting a bid opening date. Moved by Jim Johnson, seconded by Carolyn Smith, to set the bid opening time at 10:00 a.m. on March 16, 1999. Motion passed unanimously. 10. Resolution 99-12 Approving the Preparation of a Feasibility Study for a Sewer and Watermain Along Mohawk to Service Polaris Moved by Jim Johnson, seconded by Carolyn Smith, to Approve Resolution 99-12 approving a feasibility study for a sewer and watermain along Mohawk Drive. Motion passed unanimously. 11. Final Payment Request for CSAH 101 Watermain Moved by Jim Johnson, seconded by Phil Zietlow, to approve the final payment request. Motion passed unanimously. 12. Ice Cream Social Jim Dillman said that the West Hennepin Pioneers Association was still planning to hold an ice cream social and fireworks display to commemorate the Wolsfeld Log Cabin. He asked if someone on the city council would volunteer to work with the museum and on planning this event and potentially raising funds for the fireworks, refreshments, and entertainment. Jim Johnson and Carolyn Smith volunteered to help out on this event. Jim Dillman said they were looking to hold this event in June. Medina City Council Meeting Minutes February 16, 1999 33 13. Resolution 99-13 Accepting Donation of Carwashes from Mayer Mobil Ed Belland said that Randy Mayer called and would like to donate $250.00 worth of carwash passes to the City of Medina for washing of city vehicles. Moved by Jim Johnson, seconded by Phil Zietlow, to approve Resolution 99-13 accepting donation of carwashes from Mayer Mobil for city vehicles. Motion passed unanimously. 14. Planning Commission Openings Loren Kohnen referenced a memo from Sandie Larson concerning Susie Mackay and Elizabeth Weir's interest in reappointment to the planning commission. He said they were recommending that the city council reappoint them to the commission to keep the continuity of the comprehensive planning process intact. Jim Johnson said in the past we have always advertised for these positions. He said he believed the council should continue this practice. The consensus of the council was to advertise for these positions. 15. Septic Ordinance Loren Kohnen said that state statutes required cities to adopt Rule 7080. He said the planning commission reviewed this ordinance on two occasions and recommended its approval. There was some discussion about several of the provisions in the ordinance. Kohnen said that septic systems, considered failing by the ordinance, would not necessarily need to be replaced. They would be required to be maintained and inspected and eventually replaced when they were determined to be an imminent health hazard. Phil Zietlow asked if the allowing of up to 10 months for replacement was too long. Loren Kohnen said the ordinance allows up to 10 months to allow people who may find a failing system in the fall to wait until spring to replace it since it is very difficult to replace a system in the winter. Loren Kohnen said there are several provisions where the city is requiring standards that are more restrictive than the PCA requires. He said the city would require a 1000 gallon tank instead of a 500 gallon tank. The city would also require a two -tank system rather than a one - tank system. Kohnen said that alternative and experimental systems would only be allowed on lots with existing homes. Moved by Carolyn Smith, seconded by Phil Zietlow, to approve the ordinance as presented. Motion passed unanimously. A resolution approving this ordinance by title and summary will be included on the next consent agenda. 16. Metro Greenways Planning Grant Paul Robinson said that he, Jim Dillman, and Loren Kohnen met with representatives of the Hennepin County Conservation District and the Department of Natural Resources about a grant application for a Metro Greenways program. Robinson said that previously Mr. Kohnen and Jim Dillman presented the possibility of working with the Hennepin County Conservation District to create a detailed wetland and natural features analysis of the city. At that time the cost of this Medina City Council Meeting Minutes February 16, 1999 34 project seemed prohibitive. With this grant the city can offset a large portion of that cost if not all the cost of that analysis. This analysis could be used by the city to designate areas of the city that the city may want to protect or at least make landowners aware of significant natural features on their properties. Robinson said that a partner to the planning grant was a grant for $4,000,000 for acquisition of conservation easements. He said that once the city did the initial natural feature analysis they could then get together with landowners who had properties in these areas to see if they would be interested in having a portion of their property placed into a conservation easement. There was a significant amount of discussion concerning whether or not this analysis would be significantly different than the analysis the city has currently. Phil Zietlow referenced a 1992 satellite map of woodlands in the city. He also referenced the soils and wetland maps. He said that the soils map is very accurate and designates all of the wet soils and wetlands in the city. He said he was not sure that this analysis would provide any additional information that would be useful to the city. Robinson said that during the comprehensive planning process the planning commission and residents have stated that protecting the natural features of Medina was a significant issue. He and other staff members felt that this grant would be a good way for the city to begin a more comprehensive analysis of those natural features. After some additional discussion, it was proposed that a representative of the DNR and the Hennepin County Conservation District come to clarify the difference between the existing data and the analysis that would be gained as a part of this grant, as well as further clarification of the Metro Greenways grant and the monies available for acquisition of conservation easements. There was some concern on the council that private property owners not be required in any way to participate in this program. Moved by Carolyn Smith, seconded by Jim Johnson, to have this issue be tabled until the next city council where the presentation could take place. Motion passed unanimously. 17. Copier Purchase Paul Robinson said that extensive research was done on purchasing a copier for city hall. He said they tested several different copiers over the past few months. He said in an ideal world city hall would only require one copier, however, the way the city hall is arranged two copiers work best. He said he recommended Xerox even though they were not the cheapest to purchase or maintain. He said they have the best product and reputation and have a product that provides all of the benefits that the new digital copiers include. Robinson said that some of the new features of the digital copier include, scanning documents onto the file server or to work stations, scanning a document one time to get multiple prints eliminating the need for sorting bins. Robinson said these copiers will also act as network printers. Jim Johnson said that this is a lot of money. He thought that the city should look into leasing versus purchasing the copiers. Medina City Council Meeting Minutes February 16, 1999 35 Robinson said that he had not looked into leasing. He said when he had looked into leasing in the past, it was more expensive than purchasing. Moved by Jim Johnson, seconded by Carolyn Smith, to approve the purchase of Xerox copiers for $22, 157.00 pending the city clerk and the mayor's research on whether to lease or purchase. If leasing is a better option, this motion would authorize the mayor and clerk to proceed with leasing instead of purchasing. Motion passed unanimously. 18. Pav the Bills Moved by Jim Johnson, seconded by Carolyn Smith, to approve the bills, order check numbers 19355-19415 for $166, 718.03 and payroll check numbers 15909-16005 for $15, 340.36. Motion passed unanimously. 19. Adiournment Moved by Jim Johnson, seconded by John Ferris, to adjourn the meeting at 9:05 p. m. Motion passed unanimously. B.
