HomeMy Public PortalAbout11-08-2017 Minutes BOA Regular MeetingVN N OF HILLSBOROUGH Minutes Board of Adjustment 7 p.m. Wednesday, November 8, 2017 Town Barn, 101 East Orange Street, Hillsborough, NC 27278 Present: Chairman David Remington, Vice Chairman Dan Barker, James Czar, Rob Bray, Randy Herman and Dustin Williams Staff: Senior Planner Tom King Guests: None Item 1: Call the meeting to order; confirm presence of a quorum. Chairman Remington called the meeting to order at 7:0 p.m. Mr. King confirmed a quorum was present. King noted that since five regular members were present, that Mr. Bray, being an ETJ Alternate Member, would not be allowed to vote. Item 2: Consideration of changes and addition to the agenda. There were no changes. Item 3: Approval of August 9, 2017, meeting minutes. Motion: Mr. Williams moved approval of the minutes as submitted. Discussion: Chair Remington stated that he wanted the minutes to be amended as to a comment he made during the hearing. On Page 8 of the draft minutes, third line from the bottom of the page, he requested that "...and tulip poplars that will grow to 200 feet" be changed to "...tulip poplars have the potential to grow to 200 feet." The Board agreed to this amendment. Amended Motion: Mr. Williams moved to approved the minutes as amended. Second: Mr. Czar seconded. Vote: Unanimous Item 4: Case #BA -04-2017: Appeal: Valley Forge Professional Center. Mr. King stated that the hearing needed to be opened and immediately tabled to a date certain. This was due to the fact that proper notice of the hearing had not been given to the Appellant or neighboring property owners as required by the UDO (Unified Development Ordinance). Mr. King informed the Board that he had accidentally mailed the notices without attaching postage. A sign advertising the hearing had been posted on the property as required by Ordinance, so, only partial notice had been given. Motion: Vice -chair Barker moved to open the public hearing. Second: Mr. Czar seconded. Vote: Unanimous. Motion: Vice -chair Barker moved to continue the hearing to Monday, November 20, 2017. Second: Mr. Herman seconded. Vote: Unanimous Item 5: Committee and Staff Report Mr. Czar and Mr. Barker briefly discussed the recent public hearing on the West End Heights project rezoning and Special Use Permit request. Mr. King stated that he had no staff reports to present, but advised the Board to expect at least two more site plan appeal cases in the very near future. Mr. King informed the Board that he had misspoken at the August 9, 2017 hearing regarding Case #BA -03-2017 (Eno River Academy Campus Addition Conditional Use Permit Modification). King said that he had stated in the hearing that the existing lighting for the Orange Charter School complied with the Town's lighting standards. He said he thought they had, but on a recent visit to the site he noted that the lens of the freestanding light fixtures in the parking areas extend/hang slightly below the light fixture housing, which is not allowed under the Town's UDO. He said he would be in contact with the School regarding correcting the matter. Mr. Czar recognized new Board member Randy Herman and the Board welcomed him. Item 6: Adjourn Motion: Vice Chairman Barker moved to adjourn at 7:20 p.m. Second: Mr. Herman seconded.
