AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 1996 POLICE
OFFICER SALARY ORDINANCE
WHEREAS Indiana Code 36-8-3-3 (d) requires Common Council to fix the annual
compensation of all police officers by ordinance before August 2 of each
year for the ensuing budget year, and
WHEREAS the City of Richmond through its Board of Public Works and Safety and
John Hennigar Lodge No. 63 of the Fraternal Order of Police have reached
an agreement on salary levels for 1996.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the following positions be compensated not in excess of the respective sums hereafter set forth
during calendar year 1996, to wit:

In addition to the bi-weekly salaries set forth in Section 1 above, the members of
the Police Department bargaining unit shall receive overtime pay, paid holidays,
longevity pay, a clothing allowance, shift pay, education incentive pay, and
certification -acceptance pay as more fully set forth in the current collective
bargaining agreement between the City of Richmond and John Hennigar Lodge
No. 63 of the Fraternal Or er of Police.

Dear Council Member:
Indiana Code 36-8-3-3(d) requires Common Council to adopt a police officer's salary ordinance
each year for the ensuing budget year.
All civilian employees of the Police Department, the two Majors and the Chief will be included in
the regular City Salary Ordinance to be introduced with the 1996 budget later this year.
The attached collective bargaining agreement was approved by the Board of Public Works and
Safety on June 15, 1995. Ordinance No. 37-1995 implements the agreement for 1996.
This ordinance can be adopted in a single meeting with motions to suspend the rules.

BARGAINING TENTATIVE AGREEMENT - MAY 18,1995
I. Term of Agreement
a. Two (2) years (from January 01, 1996 through December 31, 1997) as to those
matters contained in Article 16 - "Wages" and in Article 29 - "Insurance". Bargaining on
a successor agreement for Articles 16 and 29 shall begin by no later than March 01, 1997.
b. Four (4) years (from January 01, 1996 through December 31, 1999) as to those
matters contained in all other Articles of the Contract.
II Article 16 - Wages
a. Patrolman's Base Pay
1996......................$25,989.00 (increase of 7.50%)
1997......................$25,989.00 (increase of 0%)
b. Permanent Wage Differentials per year in ranks over Patrolman as follows
(effective 01-01-96):
Investigator ........... $1,200.00
Sergeant ................$2,050.00
Lieutenant .............$3,050.00
Captain ................. $4,000.00
III. Article 15 - Grievance Procedure
a. Insert "Major" as anew 4th step in process after "Captain" and before "Chief'.
IV. Article 27 - Educational Incentive
a. Additional yearly compensation to those with advanced educational degrees as
follows (effective 01-01-96):
Associate Degree .....$ 500.00
Bachelors Degree ....$1,000.00
Masters Degree .......$1,600.00
V. Article 34 - Body Armour
The City of Richmond shall replace each members personal body armour as
prescribed by the manufacturer's warranty. All body armour shall conform to level two
(2) threat, be of current state of the art design constructed of a "Kevlar" fiber and include
trauma plate and side panels. All replacement shall occur prior to the expiration of the
manufacturer's warranty applicable to the armour being replaced.

VI. Article 29 - Insurance
(Status Quo on current language with the addition of the following new
paragraph)
The City shall pay the sum of Two Thousand Dollars ($2,000.00) per year per
retiree toward the premium cost of group health insurance coverage for the benefit of
"Eligible Retirees", as herein defined, subject to the following terms and conditions:
1. No health insurance premium contribution shall be required of City for those
Eligible Retirees who obtain subsequent employment after retirement from the City, and
through which subsequent employment there is available to the retiree participation in the
subsequent employer's group health insurance program at a cost to the retiree that does
not exceed the employee/retiree's premium contribution for coverage under the City's
plan by more than ten percent (10.0%) for the comparable type of coverage selected (i.e
single member or multiple/family coverage). Each retiree shall, upon request of the City,
certify that he/she has obtained no such subsequent employment whereby he/she enjoys
an entitlement to such alternative group health insurance participation.
2. An Eligible Retiree who has obtained subsequent insurance coverage through a
successor employer and later loses that coverage for any reason may re -enroll in the
City's insurance plan and be entitled to the above annual contribution toward such
insurance. If the retiree re -enrolls during a calendar year, the City's contribution for that
calendar year shall be pro -rated on a monthly basis starting with the month that the retiree
becomes eligible for coverage under the City's plan. In any such case, the retiree and
his/her dependents shall not be covered for pre-existing conditions as those conditions are
then defined at the time of re -enrollment by the City's plan documents.
3. The City's contribution for retiree health insurance benefits shall continue until
the retiree becomes eligible for Medicare coverage as prescribed by 42 U.S.C. 1395,
et.seq. The amount of the City's contributions to any retiree hereunder shall be subject to
subsequent modification through the collective bargaining process and any resulting
change in the terms of this Collective Bargaining Agreement, whether such changes
occur before or after a particular retiree's effective date of retirement.
4. For purposes of this Article 29, an "Eligible Retiree" is defined to be any
member of the F.O.F. Bargaining Unit who retires from active duty on the force, in good
standing, and with twenty (20) or more years of accredited service as recognized in the
particular retirement program in which the member is a participant [i.e. The 1925 Police
Pension Fund (I.C. 36-8-6-1, et.seq.) or The 1977 Police Officers' and Firefighters'
Pension and Disability Fund (I.C. 36-8-8-1, et.seq.)] or any member who, while an active
member of the force, becomes disabled as determined by the PERF Board.

5. The insurance contribution benefits hereunder shall only be available to those
Eligible Retirees whose first effective date of retirement is on or after January 01, 1996,
and to those retirees and/or dependents of a retiree who are participating in the City's
group health insurance plan as of December 31, 1995.
VII. Article 32 - Prevailing Rights
Delete phrase, "...and when approved by the Chief of Police" from the last
sentence of the current contract language.
VIII. Article 36 - Effective Date
This agreement shall become effective January 01, 1996 and shall continue in full
force and effect until 12:00 Midnight, December 31, 1997 as to Articles 16 and 29, and
until 12:00 Midnight December 31, 1999 as to all other Articles. In the event that a new
agreement is not signed by the City and the F.O.P. Negotiating Committee by the
respective contract expiration dates set forth above, this agreement shall remain in full
force and effect until a new agreement shall be signed by both parties.
The exceptions to the term of this agreement as stated above are:
(a) The parties agree to an automatic re -opener for the purpose of negotiating salaries
(Article 16) and insurance benefits (Article 29) for the years 1998 and 1999. Bargaining
on a successor agreement in those articles shall begin no later than March 01, 1997.
(b) Either parry may request to re -open this agreement for the purpose of resolving a
mutual problem not anticipated at the time of ratification and execution of this agreement.
(c) The parties further agree to work together in an attempt to control health insurance
costs while maintaining adequate benefit coverage. The parties agree to begin dialogue
on this issue as early as possible in 1996, and each understands that such discussions may
result in a need to amend Article- - In r
All other provisions of the agreement would be "status quo" - unchanged, except where
textual change necessary to reflect the time and term of this new agreement.
