RE: Ordinance No. 39-1995
Dear Council Member.
ROGER CORNETT
Mayor
THOMAS S. MILLIGAN
City Attorney
This ordinance fulfills a Statutory Mandate set forth in Indiana Code 36-1-8-5 (b) (2) which
provides "whenever the purposes of a tax levy have been fulfilled and an unused and
unencumbered balance remains in the fund, the fiscal body (Common Council) of the political
subdivision shall order the balance of that fund to be transferred... to the general fund of the
municipality."
Dormant balances of $29,369.73 in the City Gas Fund and $4,702.05 in the Central Garage Fund
are being transferred to the General Fund.
This ordinance also appropriates this money in the Department of Finance Telephone & Facsimile
account in the amount of $29,369.73 and the Department of Finance Computer Equipment account
in the amount of $4,702.05.
Due to the fact that this is an Additional Appropriation, a public hearing has been advertised, as
required by state statute, for your July 17th meeting.
This ordinance can be adopted in a single meeting on two motions to suspend rules since the
advertised public hearing will take place on first reading.
Sincerely yours,
Thomas S. Milligan
City Attorney
