BE IT ORDAINED, BY THE o[N CO".:i TO ,iISSION OF THE TOYTiti OF GULF STREAiv1, FLORIDA: Section 1. Qualifications of electors. In order to be an elector qualified to vote in any general, or special election held in and for the town, a person must possess the following qualifications: (a) Citizenship. He must be a citizen of the United States of America twenty -one years of age or older, and must have been a bona fide resident and inhabitant of the State of Florida for at least twelve months and of the town for six months preced- ing the date of his registration. (b) Registration. He must have registered with the town clerk at least ten days before the date of such.election at which he votes, and shall have been furnished a certificate of registration by the town clerk setting forth his name, address, date of registration, age, occupation, color, sex, nativity, if freeholder, and space for signature. Section 2. Oath on registration, certain information. Any person who is a citizen of the United States and who has been a bona fide resident and inhabitant of the State of Florida for twelve months, and of the town for six'months pre- ceding the registration, shall be registered by the town clerk as an elector of the town,. provided he first take and subscribe to -1 - '_11 _� an oath'to be administered by the town clerk or deputy clerk, in words and figures as follows: "I do solemnly swear that I am a bona fide resident of the Town of Gulf Stream; that I am at least twenty -one (21) years of age, and have been a resident of the State of Florida for twelve (12) months, and of the Town of Gulf Stream for six .(6) months; that I have not voted elsewhere during said time; that I am a citizen of the United States of America, and that I am qualified to vote under the con- stitution and the laws of the State of Florida." The applicant for registration shall be required to give to the town clerk or deputy clerk the following information: His full name, the state or county of birth, the day, month and year of birth, the address (street and number, if known) or ( section, quarter- section,•township and range) and occupa- tion. If the registrant is naturalized, he shall give the date of naturalization, the sex, color and whether or not he is a freeholder, and when and where he last voted. Section 3. Registration books -- T,'Then kept open. The town clerk shall keep the registration books open at the town hall from 10:30 A.1'% to 12:00 A.M. on every day of the week from i.ionday through Friday, in- clusive, except holidays, and except during the ten days period prior to any general or special election to be held in the town, during which time any person eligible to registration shall have the privilege of registering and thereby becoming a qualified elector. Section 4. Same -- Examination, revision. The town commission shall, at its first regular meeting in February of each year, examine and revise the registration books of the town, removing therefrom the names of all voters who have died, moved from the town, or who' are otherwise disqualified to vote, and restoring the names of all voters whose names have been erroneously removed. Immediately thereafter, there shall be posted on the door of the tozm hall a list of the names of all electors whose names.have been removed, and such list shall also be kept by the town clerk. Section S. Election by proclamation of mayor. It shall be the duty of the mayor to issue his proclama- tion announcing every election, both general and special, which proclamation shall be published at least one week prior to each election in some newspaper of general circulation in the town, or posted during such period of time at the town hall. Section 6. Appointment of election inspectors. At least two weeks before any election held in the town, the town council shall appoint at least two inspectors and one clerk to hold and conduct such election. Section 7. State election laws to govern town elections. Except as otherwise provided in this ordinance and the charter for the town, all elections in the town shall be controlled, held, and conducted, as far as practicable, according to the pro- visions of the laws of the state governing general state elections. Section 8. Duty of town clerk after registration. After the registration has been closed as hereinabove pro- vided, the town clerk shall furnish a certified copy of the registra- tion records of the town to the clerk and inspectors designated by the town commission to conduct the election to be held in and for the town. Section 9. Improper registration -- Notice to registerers. At least thirty days prior to any election held in and for the town in which no electors except freeholders are permitted to vote, the town clerk shall check the registration records, together with the tax roll, and ascertain whether any-electors are registered as freeholders who, in fact, are not freeholders. If such investiga- tion should disclose that there are persons registered as freeholders who, in fact, are not freeholders, then the clerk shall give written notice by mail to such persons that their names as freeholders will be stricken from the registration books unless such persons furnish satisfactory evidence that they are entitled to vote as freeholder, which evidence must be furnished the clerk at least ten days before such freeholders' election is to be held. ,The notice shall be sent to the last known address'of such person. In_the event such person shall fail to furnish satisfactory proof of his qualifications within the time herein specified, the registration records of the town shall be so corrected to show that the person is not, in fact, a freeholder in the town, and they shall not thereafter be.entitled to vote at any freeholders' election with- out giving proof that they are freeholders. Section 10. Canvass of returns. Within three days after each general and special election has been held in and for the town, the town commission shall meet and canvass the returns of such election and certify the results thereof. required. Section 11. Placing name on ballot - Electors signatures Any person who is qualified to hold office as commissioner of the town and who desires to become a candidate for such office, shall be entitled to have his name placed upon the official ballot to be used in any general or special election held for the purpose of electing such officer, providing he shall file with the town clerk, at least twenty days before such election is to be held, a petition signed by at least four qualified electors of the town, requesting such person r to become a candidate for such office. Section 12. Qualifying fee. Every person who desires to qualify to run for the office of town commissioner shall pay a qualifying fee of five dollars ($5.00) to the town clerk at the.time that he . -Liles his petition to qualify. Section 13. Official ballot forms - Clerk responsible for. It shall be the duty of the town clerk of the town to have printed proper forms of ballots to be used in every general or special r municipal election of the toi,m,'and to place thereon the name of every -on who is qualified under the town charter to hold an office of the town, and who has complied with the provisions of sections 11 and 12 hereof within the time therein specified. Section 14. Candidates elected.- The five candidates for the town commission who receive the highest number of votes shall be declared elected as tovm commission- ers. In the event of a tie, a runoff election shall be held on the second Tuesday in !,:arch of the election year. Section 15. Absentee ballots. The casting of absentee ballots shall not be permitted in totim elections. Section 16. Preservation of previous registrations. The list of registered voters as of the time this ordinance takes effect shall remain in full force and effect and it shall not be necessary for those i.Tho have registered previously to reregister under the provisions of this ordinance. Section 17. Effective date. This ordinance shall become effective immediately upon its passage and proper posting according to the charter act of the Toum. FIRST READING IN FULL October 10, 1959.
