HomeMy Public PortalAbout045-1995 - GENERAL ORDINANCE AMENDING CHAPTER 154 OF THE CITY OORDINANCE NO. 45-1995 A GENERAL ORDINANCE AMENDING CHAPTER 154 OF THE RICHMOND CODE TO AUTHORIZE PUBLIC UTILITY AND PUBLIC SERVICE USES AS PRINCIPAL PERMITTED USES IN CERTAIN DISTRICTS WHEREAS Chapter 154 of the Richmond Code authorizes public utility and public service uses except general offices, garages, warehouses and outdoor storage yards as special uses in all four residence districts, the limited commercial district, the commercial district, the central business district, and the general business district, and WHEREAS public utility and communications buildings necessary for the furnishing of adequate service to the area but not including general offices, garages, warehouses, outdoor storage, sewage disposal plants and disposal of garbage or refuse are special uses in the agricultural district and are principal permitted uses in the greenbelt district, and WHEREAS it is desirable to change public utility and public service uses from special uses to principal permitted uses in limited commercial, commercial and general business districts, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that Chapter 154 of the Richmond Code be amended as follows: 154,20,01.08- "o) Electric power substations (k) Other similar uses" 154.24.00.05 in the third line of the paragraph - "warehouses, outdoor storage, sewage disposal plants and disposal of garbage" 15425.01.03 in the third line of the paragraph - "warehouses, outdoor storage, sewage disposal plants and disposal of garbage" 154.30.00.06 "Public utility and public service uses including general offices, garages, warehouses, bus turn- arounds, fire stations, police stations, public art galleries, railroad facilities, telephone exchanges, water filtration plants, water pumping stations, water reservoirs, electric power substations, and other similar uses except outdoor storage yards." 154.31,00.12 . "The uses described in Section 154.30.00.06 of this Code" 154.33.00,07 "Public utility and public service uses including general offices, garages, warehouses, outdoor storage yards, bus turnarounds, fire stations, police stations, public art galleries, railroad facilities, telephone exchanges, water filtration plants, water pumping stations, water reservoirs, electric power substations, and other similar uses." GOODWIN Director Richmond Common Council President: Sally Hutton Re: Ordinance #45-1995 Dear Ms. Hutton: Ordinance #45-1995 is an amendment to the text of the zoning ordinance. The petition is in behalf of the City Planning Commission and is represented by the planning staff. This request, if granted, will allow utility substations to be permitted uses in the C-1, C-2, C-4 and our two industrial classes of M-1 and M-2. Presently, utility substations are "Special Uses" which require the two stage approval process required for special legislation. The present process adds 38 to 67 days to the utilities approval process. At this time the Wayne County Economic Development Commission has hired the American Consulting Engineers who are preparing the subdivision plans for the State Hospital acreage recently annexed The subdivision, once approved by the Planning Commission cannot be certain of the layout of utility easements in relationship to roadways or interior lot lines because the location of the substations are handled as a separate process. This amendment will allow a comprehensive approach to planning subdivision of every type and allows for the accurate platting of utility easements as part of the subdivision process. MILLIGAN City Attorney RE: Ordinance No. 45-1995 Dear Council Member. This is a general ordinance amending the text of Chapter 154, commonly referred to as the Zoning Ordinance. This ordinance is proposed by Robert Goodwin, Director of the Department of Planning and Redevelopment. Public utility and public service uses will remain as special uses in the four residence districts, the agricultural district, and the central business district. These uses will become principal permitted uses in the limited commercial, commercial, general business and industrial districts as a result of this amendment. The greenbelt district treatment of public utility and communications buildings at 154.24.00.05 remains unchanged by this ordinance. The ordinance should be referred to Plan Commission for public hearing at its meeting on July 25, 1995. The ordinance could be back to Council for second reading on August 7, 1995.
