HomeMy Public PortalAbout056-1995 - REZONING - 2302 FLATLEY ROAD AND SECOND LOCATION ONORDINANCE 56-1995 A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 2302 FLATLEY ROAD AND A SECOND LOCATION ON FLATLEY ROAD WHEREAS the zoning map designates real estate 2302 and a second location on Flatley Road as R-1 One Family Residence District, and WHEREAS it is desirable to change the zoning designation to M-2 General Industrial District to accommodate business development, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of the real estate at 2302 Flatley Road, which is Auditor's Map Number 48-24-000-405.000-29 and a second location on Flatley Road which is Auditor's Map No. 48-24-000-408.000-29 be and is hereby changed to M-2 General Industrial District. MILLIGAN City Attorney This ordinance is a rezoning suburban residential property at two locations on Flatley Road from R-1 One Family Residence District to M-2 General Industrial District to accommodate business development. The property is owned by Ella Shaffer who resides at 34 Northwest 5th Street and is selling on contract to Productivity Fabricators, Inc., manufacturers of signs. The ordinance should be referred to Plan Commission for public hearing at its meeting on September 26, 1995. The ordinance could be back to Council for second reading on October 2, 1995. MILLIGAN City Attorney The United Pentecostal Church of Richmond has obtained primary plat approval of Whispering Valley Estates, a subdivision of a portion of approximately 58 acres it owns at the southeast corner of the intersection of South 23rd and L Streets. The portion being subdivided is shown in solid black on the attached vicinity map. The portion designated by diagonal lines is the remainder of the acreage included in this voluntary annexation proceeding. The Church owns all of the land being requested for annexation. It currently is in the Wayne Sanitary District taxing unit and is surrounded by Wayne Township on the east and south and the City of Richmond on the north and west. The requirements of a voluntary annexation are set forth in the petition which appears at item 6 of your agenda. The ordinance that the petition requests appears on first reading and can be adopted in a single meeting with motions to suspend rules and advance to second and third readings. WHEREAS Indiana Code 36-4-3-5(a) provides that if the owners of land located outside of but contiguous to a municipality want to have territory containing that land annexed to the municipality, they may file with the legislative body a petition signed by at least 51 percent of the owners of land in the territory sought to be annexed requesting an ordinance annexing the area described in the petition, and WHEREAS an ordinance adopted under said section of the Indiana Code must assign the territory annexed by the ordinance to at least one municipal legislative body district, and WHEREAS the owner of 100 percent of the territory described in attached Exhibit A has signed a petition requesting an ordinance annexing said territory to the City of Richmond, Indiana, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that: A. the territory described in attached Exhibit A is hereby annexed to the City of Richmond, Indiana; B . said territory shall become a part of Common Council District 4; C. the zoning classification for the territory shall remain R-1 One Family Residence District and R-1 Special Use as it is currently zoned; D. the City Clerk shall publish and file this ordinance pursuant to Indiana Code 36-4-3-7(a), and E. this ordinance shall take effect 60 days after its publication.
