HomeMy Public PortalAbout06-08-2015 COW Minutes cy2/ /c (/r Minutes of the Committee of the Whole Workshop of the President and the Board of Trustees Held on June 8, 2015 In the Boardroom Mayor Collins called the meeting to order at 7:00 p.m. Present were: Mayor Collins, Trustee O'Rourke, Trustee Peck, Trustee Racich, Trustee Wojowski, Trustee Bonuchi, and Trustee Lamb. Others present: Brian Murphy, Administrator; Michelle Gibas, Village Clerk; Allen Persons, Public Works Director; Jon Proulx, Planner; Joan Meyers, attorney; and John Konopek, Chief of Police. Trustee Lamb moved to approve the Minutes of the Committee of the Whole Workshop and Executive Session held on May 11, 2015. Second by Trustee Peck. Voice Vote. All in favor, 0 Opposed. PRESIDENTIAL COMMENTS No Comments. TRUSTEES COMMENTS No Comments. PUBLIC COMMENTS No Comments. WORKSHOP MEETING #1 PROPOSED CUPCAKE AND FOOD TRUCK POLICY Mr. Jon Proulx, Planner, stated that staff has been requested to bring the Village Board a proposal to adopt the "Cupcake Ordinance" which derives from a recent state law change allowing small home kitchen businesses making less than $1,000.00 a month to operate with a minimum of governmental interference. The law specifically states that a"Home Kitchen operation means a person who produces or packages non-potentially hazardous food in the kitchen of that person's primary domestic residence for direct sale by the owner or a family member, or for the sale by a religious, charitable, or non-profit organization, stored in the residence where the food is made." Mr. Proulx pointed out that the law further requires that the food is not potentially hazardous baked food and that a notice is provided that the product was produced in a home kitchen. Mr. Proulx then reviewed the Village's policy on Food Trucks. Currently, food trucks are prohibited on public right-of-way. Food Trucks are permitted on private property with the owner's consent. There are several food trucks that operate on private property. Mr. Proulx asked the Village Board for direction on maintaining the current policy or creating a specific policy to allow food trucks. Trustee Lamb stated that the cupcake ordinance makes sense and he thinks that the businesses should be licensed at least so the Village is aware of whom and where they are. In the event of reported illnesses, the County Health Department should be the jurisdiction that handles that. Trustee Racich expressed some concern regarding enforcement, but felt that the Village should have an ordinance, but not to make it too complicated. Trustee Peck expressed concern regarding enforcement potentially being an unfunded mandate on the county, however, he wants to encourage entrepreneurs and felt that the Village should adopt an ordinance. Trustee O'Rourke stated that having an ordinance seems to make sense and he thought the businesses should be licensed. Trustee Wojowski stated that he thinks that the businesses should be licensed and that the Village should regulate the business, but Village of Plainfield Meeting Minutes—June 8, 2015 Page 2 not get in the way of it. Trustee Bonuchi stated that the Village should adopt an ordinance and not over complicate this. Trustee Bonuchi stated that Naperville has a restrictive ordinance regarding food trucks and that the staff should take a look at that. She supports food trucks and feels that and Ordinance needs to be restrictive and detailed. Trustee Lamb stated that he felt food trucks could be used at events, but should not be allowed on Lockport Street. Trustee Lamb expressed concern with sanitation. Trustee Peck expressed concern with regulating where the food trucks could operate and cautioned using government property. Trustee Wojowski pointed out that Naperville uses a lottery system for food trucks. Trustee O'Rourke stated that he supports it overall, but the devil is in the details. Trustee O'Rourke suggested a trial basis first. Administrator Murphy stated that staff will work on a cupcake ordinance and monitor the food truck policy. Trustee Bonuchi moved to adjourn. Seconded by Trustee Racich. Voice Vote. All in favor, 0 Opposed. The meeting adjourned at 7:37 p.m. Michelle Gibas, Village Clerk
