HomeMy Public PortalAbout02.01.2021 - ZBA Minutes MINUTES OF A REGULARLY SCHEDULED MEETING OF THE ZONING BOARD OF APPEALS OF THE TOWN OF IRONDEQUOIT, WAS HELD REMOTELY DUE TO PUBLIC GATHERING RESTRICTIONS AND EXECUTIVE ORDERS IN PLACE BECAUSE OF COVID-19, THIS ZONING BOARD OF APPEALS MEETING WAS CONDUCTED REMOTELY, ON MONDAY, FEBRUARY 1, 2021 AT 7:00 P.M. TO CONSIDER THE FOLLOWING CASES: BOARD MEMBERS PRESENT: James Hinman Chairman Charlsey Bickett Member Issac Elliot Member Sean Hart Member Joseph Intini Member Bradley Upson Member Ryan Trevas Member STAFF PRESENT: Nathan Vander Wal Deputy Town Attorney Kerry Ivers Director Michelle Nichols Recording Secretary The meeting was called to order at 7:00 p.m. Chairman Hinman instructed the applicants as to the presentation of their cases and stated that this meeting was being recorded. He stated that these minutes are intended to reflect the sum and substance of the comments made by Board Members, applicants and the public and not intended as a verbatim transcript or official record. Case No: ZB2021-02-1 Upon the matter of request by Latimore Physical Therapy, for AREA VARIANCES, to install two (2) wall signs, on premises 1404 PORTLAND AVENUE, in an R-2 Residential District. Adam Frank MSPT, Part of Lattimore Ownership Group, Sworn In: • Requesting a variance to for a lit sign on west side and an unlit sign on Buell Rd. • The signage proposed fits with the surrounding neighborhood. • The signage is similar to our Hudson Avenue location. • Excited about the move and to be part of the community. PUBLIC INPUT: None/Closed Monroe County Department of Planning Referral: N/A State Environmental Quality Review Act (SEQRA) Determination: The project is a Type II Action pursuant to S.E.Q.R.A. ON MOTION by Board Member Upson, seconded by Board Member Trevas, carried: unanimously, the Board Approved the Area Variances as submitted. Case No: ZB2021-02-2 Upon the matter of request by Jeffrey M. Loson, Architect, acting as agent for Luke Laporta, for an AREA VARIANCE, to construct an attached garage, with less than required side setback, on premises 348 ORLAND ROAD, in an R-2 Residential District. Adam Tellier, Contractor; Luke Laporta, H.O., All Sworn In: • Requesting a variance for an attached garage. • Currently do not have one. • Would like to shelter my car, jet ski and garbage cans from the elements. • Pushed the garage back 8’ to not obstruct the neighbor’s views. ON MOTION by Board Member Hart, seconded by Board Member Elliot, carried: unanimously, the Board Approved the Area Variance as submitted. Case No: ZB2021-02-3 Upon the matter of request by Matthew Denker, for an AREA VARIANCE, to construct a new single-family dwelling with less than required street-side setback on a corner lot, on premises 55 SEACLIFFE ROAD, in an R-3 Residential District. Matthew Denker, Parcel Owner, Sworn In: • Requesting an area variance for street side setback. • Requesting to build the home in line with others on the street. • Plan to sell the home after construction is completed. • Hired an arborist which stated the tree is healthy and does not need to be taken down. ON MOTION by Board Member Hinman, seconded by Board Member Bickett, carried: unanimously, the Board approved the Area Variance as submitted. Case No: ZB2021-02-4 Upon the matter of request by Parrone Engineering, acting as agent for Episcopal Senior Life Communities, for AREA VARIANCES, to construct three (3) connected apartment buildings totaling 74 units, with less than required front, rear & side setbacks, parcel size, lot width and parking and exceeding maximum permitted height (the two three-story structures), on premises 2732 CULVER ROAD (St. Cecilia Church), in an R-5 Residential District. Paul Schreiner, Parrone Engineering; Ed Parrone, Parrone Engineering, Scott Fiske, Pardi Architects, Sworn In: • Requesting numerous variances as provided in the submission packet. • Proposing to subdivide 6.1 acres of land into two lots. • Have received Planning Board approvals. Variances Requested: PUBLIC INPUT: None / Closed Monroe County Department of Planning Referral: N/A State Environmental Quality Review Act (SEQRA) Determination: ON MOTION by Board Member Hinman, seconded by Board Member Upson, carried: unanimously. The Board classified this as an UNLISTED ACTION and made a NEGATIVE DECLARATION as its Determination of Significance pursuant to SEQRA. Lead Agency: Planning Board Co-ordinated Review: Yes _ No X_ ON MOTION by Board Member Hinman, seconded by Board Member Intini, carried: unanimously, the Board approved the Area Variances subject to the following condition: • Zero lot line variance is limited to the existing structures. APPROVAL OF MINUTES: ON MOTION by Board Member Upson, seconded by Board Member Hinman, carried: 6 Aye, 0 Nay, 0 Absent, 1 Abstained , the DECEMBER 7, 2020, Zoning Board of Appeals Minutes were APPROVED. ON MOTION by Board Member Hinman, seconded by Board Member Elliot, carried: 6 Aye, 0 Nay, 0 Absent, 1 Abstained , the JANUARY 4, 2021, Zoning Board of Appeals Minutes were APPROVED.
