HomeMy Public PortalAbout077-1995 - REZONING - 245 SOUTH 4TH STREETORDINANCE NO. 77-1995 A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 245 SOUTH 4TH STREET WHEREAS the zoning map designates the property at 245 South 4th Street as R-3 One to Eight Family Residence District, and WHEREAS it is desirable to change the zoning designation to R-3 One to Eight Family Residence Special Use District to accommodate the installation of a professional office on the ground floor and a professional office and residential apartment on the second floor, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation at 245 South 4th Street, being Auditor's Map No. 50-05-230-205.000-29, Richmond, Indiana, be and is hereby changed to R-3 One to Eight Family Residence Special Use District to accommodate the installation of a professional office on the ground floor and a professional office and residential apartment on the second floor pursuant to Richmond Code 154.22.01.02. Street, Thomas D. and Christina M. Seal, requesting a "Special Use" classification for a law office and an apartment. The Commission found after listening to all who wished to speak that the proposal was in compliance with the Master Plan and voted 7 to 0 to recommend passage of this Ordinance to Common Council. MILLIGAN City Attorney This ordinance proposes a zoning change at 245 South 4th Street from a four apartment residence in the R-3 District to R-3 Special Use District to accommodate the use of the premises as a professional office on the ground floor and a professional office and a residential apartment on the second floor. The ordinance should be referred to Plan Commission for public hearing at its meeting on October 24, 1995. The ordinance could be back to Council on second reading on November 6, 1995. The Special Use District does not stand by itself but shall be combined with an existing zoning district. The Special Uses that may be allowed within the Special Use District are specifically enumerated in each zoning district classification. The Richmond City Plan Commission meets on the fourth Tuesday of each month at 7:30 P.M. in the City Council Chambers. The following is the Petitioner's response demonstrating the manner in which the requested Special Use rezoning complies with said standards: 1 . The establishment, maintenance, or operation of the Special Use will not be detrimental fz to or endanger the public health, safety, morals, convenience, or general welfare for the IIocjyiRRiI%n�a, especially South 4th Street, has become a favorite haven for law offices. The public's health, safety, and morals will all be carefully protected. Off street parking (cone) 2. The Special Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood for the following reasons: _It is the general thought of the neighbors that we have substantially raised all of our property values by this major renovation of the property. 3. In fact, this is one of the last properties in the immediate area to be renovated. 4. Adequate utilities, access roads, drainage, buffering and other necessary facilities will be provided Lfor the•following reasons: Our contractor has totally cooperated with the city's inspectors, most particularily Chris Barker, so anything that has need to be done had been done. 5. Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets for the following reasons: Off street parking for our staff, and the simple fact that our home is across the street so that we shall walk to work leaves only one or two clients coming or going on South 4th Street at any one time. C. SPECIAL USE -NARRATIVE: The Special Use established by Ordinance of the Common Council within the Special Use District shall be limited to that specific Special Use and shall not be altered, converted, modified or substituted in any way without an amendment to said Special Use being granted in accordance with Article 62 of the Zoning Ordinance. The following narrative is the Petitioner's detailed description of the Special Use being requested: The special use of the building at 245 South 4th Street, former housing four apartments, will now be a law office consisting of foul large rooms and two half baths (one handicap accessible) downstairs, and a large 3 room apartment upstairs; with another large office across the front of the building. We shall use the downstairs law office exclusively and shall rent our the apartment and upstairE office. Since this building is across the street from our home, (cant.) we shall maintain it with the utmost care, as we are located conveniently to the structure. Tom Seal has been in,practice in Richmond for four years. He will move his office from the inconvenience of our home to the new law office across the street. There is a room for Tina Seal if she at some future date chooses to practice. Each of our two secretaries will also have their own offices. We have kept the buildin 's integrity by replacing what was removed, ie windows, doors, and the staricase. Neither the law office, nor the apartment will be detrimental to this neighborhood in any way. The Site Plan submitted is to be drawn on unlined paper at an engineering scale, with a north arrow and shall show the following: 1. All property lines 2. Location of existing building(s) 3. Location of proposed building(s) and/or additions 4. Location of off street parking and loading spaces 5. Existing and proposed dimensions shall be given for the following: a. Property lines b. Existing building(s) C. Proposed building(s) and/or additions d. Building setbacks from all property lines 6. Location of existing and proposed utilities lines and sewers 7. Location of existing and proposed curb cuts 8. Arrows indicating the direction of flow of surface storm water and location of existing and proposed storm water drainage facilities 5. Location and type of existing and proposed fencing, screening, and landscaping 10.
