TO CONSIDER THE FOLLOWING CASES: BOARD MEMBERS PRESENT: Bernard Blocchi Chairman Michael Eveland Member Mary Hollenbeck Member Bradley Huber Member Jacqueline Murray Member Spencer Read Member Allan Richards Member STAFF PRESENT: Andrew Dean Town Attorney Stephen Fantuzzo Deputy Town Attorney Kerry Ivers Director Michelle Nichols Recording Secretary The meeting was called to order at 7:00 p.m. Chairman Blocchi instructed the applicants and the public as to the procedure to be followed for presentation of cases and public input. He stated that the meeting is being recorded and is not intended to be a verbatim record but only to indicate the sum and substance of the proceedings. ITEMS FOR BOARD ACTION: ON MOTION by Board Member Richards, seconded by Board Member Murray, carried: unanimously, the Board removed this case from the table for discussion: Case No: PB2021-08-2 – Tabled/Adjourned: Upon the matter of request by Nixon Peabody, acting as agent for Bell Atlantic Mobile Systems LLC – Verizon Wireless for Preliminary & Final Site Plan Approval for the installation of a small cell wireless telecommunications unit attached to a newly placed utility pole, located in the Town’s Right-of-Way (in front of 220 Lafayette Road) in an R-1 Residential District. Nixon Peabody & Kris Boyce & Mike Crosby, of Verizon in attendance. On motion to reopen the public hearing by Board Member Read, seconded by Richards, Motion Carried: unanimously: Elizabeth Balentine, 154 Grantham Road: • Thank you for moving this pole to the current location. • Super appreciative. • Neighborhood group would be willing to add landscaping to the island. • Would not see significant damage with snow. Public Input Closed. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: State Environmental Quality Review Act (SEQRA) Determination: The project is a Type II Action pursuant to S.E.Q.R.A. ON MOTION by Board Member Richards, seconded by Board Member Read, carried: unanimously. The Board approved the application as presented with the earth work to be put back into it place. Case No: PB2021-09-1 Upon the matter of request by Vital Signs, acting as agent for Ridge Portland Rochester, LLC, for Signage Approval, to refurbish the existing pole sign, on premises 1233 E Ridge Road, in an C – Business District. After hearing the applicant’s presentation; no one spoke at public input. The Board opted to keep the Public Hearing Open. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: State Environmental Quality Review Act (SEQRA) Determination: The project is a Type II Action pursuant to S.E.Q.R.A. ON MOTION by Board Member Richards, seconded by Board Member Blocchi, carried: unanimously. The Board Tabled the application until the October meetings. Case No: PB2021-09-2 Upon the matter of request by Irondequoit Family Dentistry, for Signage Approval, to replace existing signage with new logo, on premises 753 Titus Avenue, in a MUC – Mixed Use Commercial District. After hearing the applicant’s presentation, the following spoke at public input: Ann Burns, HIPP Group: • Applaud Dr. Park continue the dental business at this location. • Like the graphics of the proposed sign. • Appreciate the lights turned on and off as a condition. • Proposed to use Led lighting. • Happy to welcome Dr. Park to the neighborhood. Public Input Closed. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: State Environmental Quality Review Act (SEQRA) Determination: The project is a Type II Action pursuant to S.E.Q.R.A. ON MOTION by Board Member Richards, seconded by Board Member Eveland, carried: unanimously; The Board granted Signage Approval subject to the following conditions: • Turn lights on one hour prior to opening and turned off two hours after closing. • Subject to the kelvin wattage is a maximum of 4000K. Recommendation to look into top lighting the sign versus ground lighting. Case No: PB2021-08-4 – Tabled/Adjourned/Public Hearing Left Open: Upon the matter of request by Sonbyrne Sales Inc. for Preliminary & Final Site Plan Approval to construct a 4,232 +/- square foot Byrne Dairy Retail Store & Deli and Fueling Facility with a free-standing fuel canopy & fuel pump, on premises 2180 EAST RIDGE ROAD, in a C-Business District. On Motion By Richards, Seconded by Blocchi, to remove the case from the table, Motion carried: unanimously. Kerry Ivers reiterated that the Town Board has continued the public hearing subject to the SUP for the gas pumps. Under the assumption to make a decision at their October meeting. It is a permitted use in this district but allows special conditions to be added. For this Board it is for site plan approval on how the physical land is developed. This is a permitted use under the zoning code where a gas station and convenience store can be located. Physical relocation of the property. And how building and landscaping is located on the site. After hearing the applicant’s presentation, the following spoke at public input: Sandy Orem, 20 Salem Rd: • All our comments are related to the gas station. • Went around to the neighborhood about this meeting. • This is still a gas station and has a curb cut onto Ridgewood Dr. • This will make sixteen gas stations. • Why is it a good investment for another gas station with the future of electric vehicles coming. • If this gas station is put in will pollute our air and soil. • The traffic in our neighborhood will be crazy. • We don’t need another gas station here. • The curb cut on Ridgewood Dr. will be the biggest mistake. • Nothing against Byrne Dairy but this is the wrong spot. Anna Zanghi, 60 Abington Rd: • In opposition of the gas pumps. • The property site is higher, about five feet. • Arborvitaes are very sensitive to salt. • Don’t really want to see the exit on Ridgewood Dr. • Point the traffic onto E. Ridge Road. • Propose to move the compressors to the front of the property along with the dumpster. Laura Akins, 125 Worthington Rd: • Concerned the gas pumps will cause light pollution. Especially over the gas pumps. • Increased traffic through the neighborhood and headlights shinning in the houses. • Light pollution is a major environmental and health problem known to the associated with depression and other health disorders. • Noise pollution and the added music and ads played at the gas pumps. • These effects taken together long term are associated with a risk of heart disease. • It’s great that we have more green space but that also means there are more poorest matters for runoff to absorb to. • Every time gas it is leaked onto the ground and then the rain rinses it off into this pond and then our neighborhood. • Benzine is a toxic chemical and will be released from the gas stations like this one. • Do not want to feed cancer causing chemicals to my loved ones. • Gas stations workers have had higher levels of these chemicals in their body. • These pollutants will be added into the air. Lauren Sharp, 39 Ridgewood Drive: • Concerned about the 24 hours during the night and how they can’t speak to the lighting situation. • Any type of lighting will impact my sleep. • Concerned about the increase of traffic. • Safety and the 24 hours. Christina Fodor, 109 Walzford Rd: • Here to support my Irondequoit resident friends. • Concerned about this being opening 24 hours. • Concerned about the maintenance of these fences and trees. • What makes spruce trees a barrier of sound? • Is there a biased testing that been done outside of Byrne Dairy? • Selling our home and have to go through a phase one physical study. • Concerned about the traffic. Robert Sandy, 46 Abington Rd: • Lived here 47 years. • No one has come up to me and said that we need a gas station on Ridge Road. • Making all these adjustments indicates it’s in the wrong place to begin with. • Traffic will be a huge concern and increased in our neighborhood. • Wegmans enters all their customers and truck through E. Ridge Road. • It’s in the wrong place and not needed at all. Patty Burke, 122 Worthington Rd: • Ridgewood ends at my driveway. • No right on red at the light at Worthington and Culver, will cars end up stacking? • Will have to end up selling my home. • This isn’t the spot for this gas station or convenience store. • Consider if this was in your neighborhood. Michael Donohew, 12 Salem Rd: • Common sense states we don’t need this. • Have not heard a single voice pro for this project. • Will streetlights and speed bumps be added to Ridgewood? • Consider all the litter that will be at the site and in our neighborhoods. Adam Field, 54 Abington Rd: • Biggest concern is the curb cuts. • Will have numerous cars cutting through our road. • It’s a neighborhood and do not want it here. Jeremy McGuire, 15 Ridgewood Drive: • This curb cut is almost across my driveway. • Why can’t they make two curb cuts onto E. Ridge Road, it would solve a lot of problems. • Headlights will come right into our home. • Biggest concern is our bedroom faces that curb cut. Larry VanderMolen, 13 Abington Rd: • Blindsided because this is something totally different than what was at the last meeting. • Way happier with this plan. • There are just so many other things to consider. • Every meeting we have been to are all different things. • We don’t have the option to say we don’t want a 24 hour business in our area. • We want to be able to review these revised plans. Bob McCorrmick, 3092 Culver Rd: • The curb cut on Ridgewood is kiddy corner to little kids. • Would love to know the terms of this sale of this property. • Was the Town the owner of this property. • If the town is the owner that is a little shady. • What will happen to property values? • Three or four of our streets of homes will plummet. • There is no way you should have gasoline here, we do not need it. Jennifer Kantar, 111 Salem Rd: • Moved here because it was a nice quite neighborhood. • Get enough light and noise pollution from the area. • My kids grew up here. • Electric is the way of the future. • Smart cars are the way of the future. • Have solar panels on our camper. • A lot of traffic will be coming through our neighborhood. • Have people already cutting through. • There will be lots of cars lined up at the red light on Worthington Rd. • Love this neighborhood. • The shrubs proposed will end up dying because of the salt. • Already have convenient stores nearby. Robin Winters, 63 Ridgewood Drive: • Speaking for 47 Ridgewood Drive as well. • Has a blind daughter and is very concerned about the traffic. • Opposed to the traffic that will be coming down our street. • The arborvitaes for sound, no discussion for brick retaining wall to help with the noise. • This parcel was promoted as being a high traffic area. • There should be no curb cut. • The gas station is not needed. • Why can’t we get any nice fine dining? • Need to consider whether we really need more gas stations. Sandy Orem, 20 Salem Rd: • Taking about no curb cut on Ridgewood Rd. • If access off E. Ridge Road with no curb cut, Ridgewood Dr. will still be used as a curb cut. • It’s kind of just a mess. Christine Winter, 26 Salem Rd: • Implore the board to please reconsider. Public Hearing will remain open. Rebuttal, Christian Brunelle: • Have a pest control company that comes. • No music, audio, or advertisements at the pumps. • Lighting plan will come back with zero-foot candles and dark sky friendly. • Regards to environmental meet or exceed all guidelines. • No permit required for air quality for gas stations even with cars idling. • This does not require an air permit from NYS DEC. • Curb cut is directly lined up with Walgreens. • Old plan had a variance, but this site plan meets all the Town’s zoning regulations. • The grade will stay similar to the grade it is now. • Music is not played at the pumps. • Maintenance and care will be used by our own company along with spring and fall clean ups. • Approximately four cars queuing on Ridgewood Dr. and is in the traffic study. Monroe County Department of Planning Referral: IR21011 After Board discussion, the Board determined: ON MOTION by Board Member Richards, seconded by Board Member Read, carried: 7 Aye, 0 Nay, 0 Absent, 0 Abstained, the Board Tabled the application pending submission of updated plans. • Subject to move south sidewalk in East 2 feet and relocate the air station Southwest in between the 2-foot green space and new relocated sidewalk. • Subject to the Commissioner of PW add truck travel signage heading North on Ridgewood Drive by either weight or class. • Subject to adding arborvitaes enclosing the dumpster on the north, East and West sides. • Subject to contain and kill program with rodent control. • Town Board review for the gas pumps and hours of operation at the site. • Pending Town Engineers comments, • Submit lighting, landscaping, signage and updated site plan. • Substantial concerns about the curb cut onto Ridgewood Drive. Is it not possible to add additional curb cut onto E. Ridge Road even without a gap in the median? • Do not see the necessity for the curb cut onto Ridgewood Drive. • Decrease the size of the curb cut and add a no right turn out of the Ridgewood Drive curb cut.
