TO CONSIDER THE FOLLOWING CASES: BOARD MEMBERS PRESENT: Mary Hollenbeck Member Bradley Huber Member Spencer Read Member Allan Richards Member BOARD MEMBERS ABSENT: Bernard Blocchi Chairman Michael Eveland Member Jacqueline Murray Member STAFF PRESENT: Stephen Fantuzzo Deputy Town Attorney Kerry Ivers Director Michelle Nichols Recording Secretary The meeting was called to order at 7:00 p.m. Acting Chairman Read instructed the applicants and the public as to the procedure to be followed for presentation of cases and public input. He stated that the meeting is being recorded and is not intended to be a verbatim record but only to indicate the sum and substance of the proceedings. Case No: PB2021-10-2 Upon the matter of request by Yost Neon Display, Inc., acting as agent for U-Haul, for Signage Approval to install a replacement wall mounted sign, on premises 1106 E. RIDGE ROAD, in a C-Business District. After hearing the applicant’s presentation; no one spoke at public input/closed. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: The Board classified this as a TYPE II ACTION pursuant to SEQRA. ON MOTION by Board Member Richards, seconded by Board Member Huber, carried: 4 Aye, 0 Nay, 3 Absent, the Board granted Signage Approval with the following condition: • Subject to the lighting turned on one hour prior to opening and turned off two hours after closing. TABLED ITEM: On Motion by Board Member: Richards, seconded by Board Member: Read, to remove the item from the table, Motion Carried: 4 Aye, 0 Nay, 3 Absent, 0 Abstained. Case No: PB2021-09-1 -Tabled/Adjourned/ Public Hearing remains open: Upon the matter of request by Vital Signs, acting as agent for Ridge Portland Rochester, LLC, for Signage Approval, to refurbish the existing pole sign, on premises 1233 E Ridge Road, in an C – Business District. After hearing the applicant’s presentation; no one spoke at public input and the Board left the public hearing open. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: ON MOTION by Board Member Richards, seconded by Board Member Read, carried; 4 Aye, 0 Nay, 3 Absent, 0 Abstained, The Board Tabled/Adjourned this case with the applicant/agent’s request, leaving the Public Hearing open. Case No: PB2021-10-1 Upon the matter of request by Crystal City Signs, acting as agent for Ridge Portland Rochester, LLC, for Signage Approval to install new wall & tenant panel signage on premises 1233 E. RIDGE ROAD, in a C- Business District. After hearing the applicant’s presentation; no one spoke at public input. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: The Board classified this as a TYPE II ACTION pursuant to SEQRA. Case No: PB2021-08-4 – Tabled/Adjourned/Public Hearing remains open: Upon the matter of request by Sonbyrne Sales Inc. for Preliminary & Final Site Plan Approval to construct a 4,232 +/- square foot Byrne Dairy Retail Store & Deli and Fueling Facility with a free-standing fuel canopy & fuel pump, on premises 2180 EAST RIDGE ROAD, in a C-Business District. After hearing the applicant’s presentation, the following spoke at public input: Anna Zanghi, 60 Abington Rd: • Concerns with grade and what are they going to do about the grade change. • The dumpster should be moved closer to E. Ridge Road. • Ehrlich does not trap and retrieve for outdoor use regarding rodent control. • Would like to know their plan for rodent control. • Expect them to go above and beyond. • HVAC sound concerns, was a study done? • Suggest moving the HVAC units to the front of the building. • What are they doing for security or additional security? • Neighbor Mabel Campbell, 29 Abington Rd asked her to speak on her behalf. • Her concern is that would like to see the fence moved closer to her property line to keep the trash from coming over onto her property. • She also has a dead tree behind her house and was concerned that would commit to be taking that tree down. Christine McGuire, 15 Ridgewood Dr: • My home is about 5’ away from the driveway. • Live directly next door to Walgreens. • No fence going up will block my view. • No response to my property values. • Just purchased this home that’s directly across the street. • All the shrubberies you want to put up will not stop the lights. • This is a direct impact on my home. • This is an eyesore and will ruin my property value. Irene Doktor, 11 Salem Rd: • Echo my neighbor’s concerns. • Concerned with esthetics. • Corner stores are very open, and it is not pretty or attractive, they should shield the corner, so the E. Ridge Rd entrance is used more often. • Concerned about the landscaping. • Suggest adding a wall to the southwest corner and along the west side of the site. • Make it look more park like. • The landscaping trees are small and never grow. • Add landscaping that is attractive. • Suggest having the entire dumpster enclosed. • The HVAC units need to be screened. • Concerned about rodents. Patricia Burke, 122 Worthington Rd: • Live at the end of Worthington Rd. • Concerned with traffic lights shinning into my home. • If traffic is not an issue, why have the curb cut on Ridgewood Dr? • How will trucks not bottle neck that curb cut? • Our neighborhood does not have street lights. • What will happen when the road is slippery? • Concerned about the additional traffic in my neighborhood. • Make it an in and out onto E. Ridge Road only. • Our property values will not increase. Sandy Orem, 20 Salem Rd: • Echo neighbors’ concerns. • Come to the meetings and not feel like we are being heard. • This is about on exit. • Ridgewood Dr. has no double yellow line. • Asking for a problem by asking for this curb cut. • Homes will depreciate. • At nighttime you can’t see the no right on red at Worthington & Culver. • Our neighborhood is very quiet. • Concerned for our safety regarding car chases through our neighborhood. Adam Field, 54 Abington Rd: • The entrance doesn’t work. They purchased the property this way. • They did nothing to make the front entrance work for trucks. • Why can you guys make them do something from the front road. • Have them make it work. Jennifer Kantor, 111 Salem Rd: • Chose this neighborhood because of the quiet and safe for our kids. • We don’t need another gas station. • The shrubs will end up dying. • Will have more traffic through our neighborhood. • We do not have sidewalks and the children walk in the road. • Fuel trucks will have a difficult time exiting. • Already have right turns driveways where people do not stop. • Have not heard about an electric charging station being installed. • Will have issues exiting with our camper. • There will be more people cutting through. Robert Sandy, 46 Abington Rd: • Curious to have traffic information. • Want to maintain the low level of traffic. • Worthington to Ridgewood serves as a back door path. • We don’t need another gas station. • The town let down residents by allowing this to go up for auction. • Asking this board not to approve the curb cut to eliminate the traffic. Philip Dodds, 195 Avondale Rd: • One of the reasons moving here is for quality of life. • We had a library; it was wholesome and positive. • Now we are putting in something that is a nuisance. • There is already a traffic issue on Ridgewood Dr.. • Any additional traffic increases issues. • They knew what they were buying. • Hope our leaders will think about the quality of life for its residents. Mary Jo Sandy, 46 Abington Rd: • No way they should be allowed to use Ridgewood Dr., especially trucks. • Should not be interrupting our neighborhood. • If it weren’t auctioned, we would have control of it. The Board closed the public hearing portion of the meeting. Rebuttal, Christian Brunelle: • The grade and berm is approximately 2-3 feet, with the yews will be 8-9 feet. • Will use trap and kill devices regarding the rodents. • The HVAC study from another site was shared with this board. • Security cameras will be on site. • More than happy to take Ms. Campbell’s tree down, just need something in writing from her. • Town staff will need to look at the tree before removal. • Ridgewood Dr. will have buffering of 3’ yews and 3’ berms. • Proposing a stacked stone wall into the southwest corner design. • All the dumpster enclosures have swing gate doors. • Fuel trucks exiting Ridgewood Dr., have been discussed by our engineer and stacking of 100 feet of room. • Per research with town appraiser, the property values went up and a letter was submitted several weeks ago. • Ridgewood Dr. has had three different engineers review and agree this is the best design for this site. As well as Monroe County DOT. • Labella, the town engineer has also agreed this is the best design.
