TO CONSIDER THE FOLLOWING CASES: BOARD MEMBERS PRESENT: Bradley Huber Member Jacqueline Murray Alt. Member Spencer Read Acting Chairman / Member Allan Richards Member BOARD MEMBERS ABSENT: Bernard Blocchi Chairman Michael Eveland Member Mary Hollenbeck Member STAFF PRESENT: Andrew Dean Town Attorney Nathan Vander Wall Deputy Town Attorney Donna Martello Planning Assistant The meeting was called to order at 7:00 p.m. Acting Chairman Read instructed the applicants and the public as to the procedure to be followed for presentation of cases and public input. He stated that the meeting is being recorded and is not intended to be a verbatim record but only to indicate the sum and substance of the proceedings. Case No: PB2021-08-1 Upon the matter of request by Nixon Peabody, acting as agent for Bell Atlantic Mobile Systems LLC – Verizon Wireless for Preliminary & Final Site Plan Approval for the installation of a small cell wireless telecommunications unit attached to a newly placed utility pole, located in the Town’s Right-of-Way (in front of 359 Cascade Place / AKA 361 Cascade Place) in an R-3 Residential District. After hearing the applicant’s presentation, the following spoke at public input: Reginald Lane, 361 Cascade Place: • Questions about the health concerns with cancer. • Prefer it not to be there at all. • May have issues selling the property in the future with the pole there. Luke Leege, 400 Cascade Place: • What is the power source to the pole? • It will change the esthetics of the neighborhood. • Consider another back spot around there. • There are several poles on Echo. • The contractor did not finish restoring the ground on other poles that have been installed. Public input closed. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: The Board classified this as a TYPE II ACTION pursuant to SEQRA. ON MOTION by Board Member Richards, seconded by Board Member Huber, carried: 4 Aye, 0 Nay, 3 Absent; The Board granted Preliminary & Final Site Plan Approval with the following conditions: • Utility Boxes on the utility pole shall be painted, if allowed. • Applicant shall coordinate with the utility pole provider to fix landscaping to existing conditions after the utility pole is installed. After hearing the applicant’s presentation; the following spoke at public input: Elizabeth Balentine, 154 Grantham Road: • Live across the street from the proposed zone. • Speaking on the behalf of the owner of 220 Lafayette Road. • The proposed location paperwork supplied did answer some of our questions. • The zone at this property already has a stop sign, a tree and a dead-end sign, it’s very full. • Concerned about emergency services being able to see the address of this parcel. • Propose to put the pole in the green island which is unused. • There are other strips of property that are not front facing properties that can be considered. Jake Patterson, 238 Lafayette Road: • There will some coring to get this project going and are some better locations on this road. • Its pretty tight around that dead end area. • Had quite a few issues with people running the stop sign. • Can we have access to the plans and some time to review. • Ultimately would like more information on it. • There is stop sign right where the pole is proposed. Dionne Woodley, 162 Grantham Road: • It doesn’t seem logical to me. • Makes no sense to put it with all the stuff that is already at that corner. • Against the project all together. • It falls right in front of 220 Lafayette. • Would be more open for it to be put in the island right of way. Valerie Irrig, 220 Lafayette Road • Do not want this in front of my house. • There is a lot of land behind the houses, or the circle would be alright for me. The Chairman left the public hearing open for the moment. The applicant addressed the comments: • Supplied the Board with a larger picture. • We can explore installing the pole in the green island area. The Chairman now closed the public hearing. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: The Board classified this as a TYPE II ACTION pursuant to SEQRA. ON MOTION by Board Member Richards, seconded by Board Member Murray, carried: 4 Aye, 0 Nay, 3 Absent; The Board Adjourned the application with the consent of the applicant. Case No: PB2021-08-3 Upon the matter of request by Bergmann Engineers, acting as agent for Irondequoit Senior Living, LLC for Signage Approval, to install a monument sign for Irondequoit Senior Housing Project, on premises 2590 CULVER ROAD, in an R-5 Residential District. After hearing the applicant’s presentation; no one spoke at public input. Monroe County Department of Planning Referral: N/A After Board discussion, the Board determined: The Board classified this as a TYPE II ACTION pursuant to SEQRA. ON MOTION by Board Member Read, seconded by Board Member Richards, carried: 4 Aye, 0 Nay, 3 Absent; The Board granted Signage Approval with the following conditions: • Lighting of the sign shall be shielded, and no lighting shall spill beyond the sign location. • Maximum of 4,000 Kelvins for the lighting of the sign. Case No: PB2021-08-4 Upon the matter of request by Sonbyrne Sales Inc. for Preliminary & Final Site Plan Approval to construct a 4,232 +/- square foot Byrne Dairy Retail Store & Deli and Fueling Facility with a free-standing fuel canopy & fuel pump, on premises 2180 EAST RIDGE ROAD, in a C-Business District. After hearing the applicant’s presentation, the following spoke at public input: Anna Zanghi, 60 Abington Rd: • Have put together a petition in opposition. • Major concerns are traffic. • Very high volumes of traffic in this area. • The traffic study was not completed while school in attendance. • The increased traffic will reduce our quality of life. • Concerns about the general maintenance pollution and from the fuel tanks. • This gas station will be pretty much in the neighbors back yards. • Concerned about crimes. • Submitted the petition. Patty Burke, 122 Worthington Rd: • Live at the very end of Ridgewood. • Concerns with traffic. • There are tons of children in the neighborhood. • Worried about the parade of cars going through my neighborhood. • Concerned about the tankers supplying the gas and then end up traveling down Ridgewood. Jeremy McGuire, 15 Ridgewood Dr: • Live across the street from the proposed project. • Concerns about lighting coming into my home. • The traffic issue will be backed up in front of my driveway. Mary Jo Sandy, 46 Abington Rd: • When Wegmans was built, we were told that no traffic will access our street. • And they have been very accommodating and have been good neighbors. • There should be no traffic that comes down Ridgewood at all. • The cars will end up being lined up, turn around in driveways. • If Wegman’s accommodated that rule and I don’t know why they haven’t gotten that rule. • It would be horrendous for our area. Sandy Orem, 20 Salem Rd: • When comparing the Greece site to this site, you can’t even compare them at all. • It’s not a good place to put a gas station. • We have gas stations all around. • There are similar sites that have the same items to sell. • Concerns about the gas tanks going in the ground. • This will be right in our backyard. • Walgreens does not have 80 to 85 customers per peak hour. • The neighborhood is really quiet with a nice loop to walk the dog. • We end up having to walk in the street during the winter months because our sidewalks are not plowed. • The principal of Eastridge High School did not know this was happening and expressed concerns. • Concerned about cars doing U-turns in the neighborhood driveways. Adam Field, 54 Abington Rd • Main concerns is the outlet into Ridgewood. • They will cut through our neighborhood to get over to Culver Road. • Concerned about light pollution. There is no way there won’t be. • Concerned about the noise especially from air conditioner units. • These items can’t be controlled, and we will be stuck with them. Chad Wright, 59 Salem Rd: • Concern comes around the need for another gas station. • Don’t understand this need to have an additional one. • Auto makers will be going all electric soon. • The signage will have illuminated gas prices like at the Greece site, there is no way to dim those lights. • Looking for canopy clarification. • Safety concerns for traffic in the area. • Have trouble now getting my 38-foot camper out of my driveway now. • Walgreens has three exits/entrances that exist. • The Ridgewood curb cut is the primary concern. Herma Volpe-Van Dijk, 66 Orland Rd: • Recently found out about this project. • Has this already been decided or is there a possibility this will get turned down? Larry VanderMolen, 13 Abington Rd: • Live right behind where they are proposing to put the gas tanks and concerned about this. • Frustrated about the inability to even access the plans for this project. • This will decrease the value of my home. • Will not be able to use my sleeping porch in the back of my house ever again. • Concerned with the closeness and noise to the residential area. • There are already 11 gas stations in the area. • Almost impossible to turn left already. • Concerned about cars cutting through. • Major concerns about the traffic and the traffic study that was done. • The neighborhood should have the ability to get a variance to stop whatever they do not want. Michael Donohew, 12 Salem Rd • Lot of the pieces have already been said. • There would be no benefit to the business because it is already offered in the area. • Will consider moving if it goes in. • It is not a good fit for the area. • Concerned about cars cutting through out neighborhood. Robin Winters, 63 Ridgewood Dr: • Sent an email to the Town Board. • Major concerns getting out of Ridgewood Dr either way anytime during the day now. • Do not believe the traffic study was done appropriately. • None of the other Byrne Dairy’s but up to a residential neighborhood. • This is not a good spot, it is too residential. • The entrance onto Ridgewood Drive is not a good thing. Dillion Dwyer, 105 Salem Rd: • Share the same sentiments as my neighbors. • Three words came to mind necessity, irresponsibility, action, and opportunity. • There are currently 10 to 11 gas stations within two square miles. It is not a necessity for this use, it’s not a commodity needed. • This irresponsibility shows the lack of concerns for the consequences for one’s actions. Putting grocery sources in unnecessary efforts towards something that’s not necessary. • There is an opportunity here, to open it up and replace this space with something that would be a benefit. Patty Burke, 122 Worthington Rd: • Had not one of the neighbors gone around and handed out information we wouldn’t have known about this. Public Hearing will remain open. Rebuttal by Erin Brown: • Provide a photo of the parapets style canopy at another location showing the building in a residential neighborhood. • The illuminated gas lights, the zoning requires a specific setback. • Will make sure there is pedestrian access to the site. • Property values were evaluated at other similar sites within the town and the assessor confirmed the values of those homes have increased. Can’t speak to the fact if a different circumstance were happening like it is now.
