HomeMy Public PortalAbout2019.084 (07-16-19) RESOLUTION NO. 2019.084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AUTHORIZING THE MAYOR TO EXECUTE, IN A FORM SATISFACTORY TO THE CITY ATTORNEY, A LICENSE AGREEMENT BETWEEN THE CITY AND M & D PROPERTIES FOR THE USE OF CITY-OWNED LAND (ASSESSOR PARCEL NUMBERS: 6169-002-904, 6169-002-905, 6169-001-900, AND 6169-002-908) AS A TEMPORARY PARKING LOT WHEREAS, the City owns three (3) parcels of land that are located at the southwest corner of Fernwood Avenue and Imperial Highway within the City of Lynwood. These parcels are identified as Assessor Parcel Numbers 6169-002-904 (approximately 2.61 acres), 6169-002-905 (approximately 0.40 acres); and 6169-001-900 (approximately 1.43 acres); and WEHREAS, the City owns one (1) parcel of land that is located at the southwest corner of Fernwood Avenue and State Street within the City of Lynwood. The parcel is identified a Assessor Parcel Numbers 6169-002-908 (approximately 0.76 acres); and WHEREAS, the City recognizes that M & D Properties (a California Corporation) has a need for temporary parking facilities in the area where said City-owned parcels are located; and WHEREAS, the City is willing to lease said City-owned parcels to M & D Properties for use as temporary parking facilities. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council authorizes the Mayor to execute a License Agreement, for a term of three months (August 1, 2019 to October 31, 2019), substantially in the form attached to this resolution as Exhibit A and Exhibit B, subject to termination by either party by giving a seven days' written notice to the other party. Section 2. The City Council agrees to allow M & D Properties, at its sole cost, to install a driveway and curb cuts (subject to approval by the City Manager) on said City—owned parcels to allow for ingress and egress of vehicular traffic. Section 3. In lieu of a monthly lease payment, the City Council directs M & D Properties to install crushed gravel on any portion of said City-owned parcels that will be used for parking and maintain all parcels in a clean and sanitary condition. Section 4. The City Council authorizes the City Manager to extend the term of the License Agreement for an additional three periods of three months each for a maximum of nine months. Section 5. The License Agreement shall be in a form satisfactory to the City Attorney. Section 6. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect.
