HomeMy Public PortalAbout2019.050 (06-04-19) RESOLUTION NO. 2019.050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AUTHORIZING AN AGREEMENT WITH RAMBOLL, INC. FOR ENVIRONMENTAL STUDIES AND SERVICES REQUIRED TO PROCEED WITH PROPOSED AFFORDABLE HOUSING PROJECT(S), AT A LOCATION COMMONLY KNOWN AS THE ALAMEDA TRIANGLE, FOR A NOT TO EXCEED AMOUNT OF $57,000 WHEREAS, in 2013, a Remedial Action Plan ("RAP")for the Alameda Project Area was drafted for submittal to the Department of Toxic Substances ("DTSC") for review and approval. Due to funding constraints, the review process and approval of the RAP was not completed; and WHEREAS, in order for DTSC to finalize the review for the Alameda Triangle Site, a Remediation Response Plan ("Response Plan") must be updated with current environmental data and refined to include only City-controlled properties; and WHEREAS, the City desires to utilize the services of Ramboll ("Consultant"), as an independent contractor, to provide environmental consulting services to the City as set forth in the Scope of Work ("Exhibit A") to the attached proposed Professional Services Agreement for Environmental Consulting Services ("Agreement") including but not limited to services provided in connection with the completion of a Response Plan; and WHEREAS, the Consultant represents that it is fully qualified to perform such consulting services by virtue of its experience and the training, education and expertise of its principals and employees; and WHEREAS, employees of the Consultant have been providing like services to the City commencing approximately in January 2010 and are uniquely qualified to provide said services to the City in part due to contractor's in depth knowledge of environmental conditions within the area around the Alameda Triangle Project, as well the Alameda Triangle Project itself; and WHEREAS, based on history and intimate knowledge of the City's environmental challenges at said site, it is recommended that the City enter into an agreement with the Consultant to prepare the revised Response Plan and compete the review of it with DTSC; and WHEREAS, a vote of a four-fifths (4/5) majority will be required to by-pass the Request for Proposal (RFP) process and the historical knowledge and experience of the Consultant's team provides a unique situation that is both economically feasible and more efficient than the process of engaging potential new consultants to assist the City on projects that have taken years to develop; and WHEREAS, in an effort to proceed with the completion of the Response Plan for the Alameda Triangle Project Site, the cost to prepare said Response Plan is $57,000 from the 2011, which will be requested from the Lynwood Housing Authority, as said services ae directly related to the production of needed affordable housing; and WHEREAS, the preparation of technical environmental documents for completion of the Response Plan is critical for the proposed future affordable housing development on the City-controlled Alameda Triangle properties and therefore an agreement for said services is in order. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council herby authorizes an Agreement for environmental consulting services provided in connection with the Alameda Triangle for the completion of the Response Plan and other tasks as further described in Exhibit A under the proposed Agreement with the Consultant. Section 2. The City Council authorizes an agreement with the Consultant for a "not to exceed" amount of $57,000 for a period from June 4, 2019 to December 31, 2019, in a form approved by the City Attorney, unless brought back to the City Council for amendment and extension as described in Section 3, et al of Agreement. Section 3. This resolution shall be effective immediately upon adoption by a four-fifths (4/5) vote of the City Council. Section 4. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect.
