Jones, Larry E. Fox, Phyllis L. Fox, Irene France, Triangle Realty, Inc., James P. Hartig, Roberta Adams, Lawrence Habschmidt and Catherine Habschmidt have petitioned Common Council of Richmond, Indiana, requesting vacation of two unimproved alleys between North 5th Street and Fort Wayne Avenue in the triangular block bounded on the north by North C Street, the same being Vacation Petition No. 11-1995, and Whereas the owners of all land abutting the above described public way have joined in said ......... ......... ........petition.requesting..vacation,..except.Ro.bert.Dean..Ullery,..Sr..who_has received........... notice of the pendency of same from the City Clerk as required by statute, and Whereas said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition November 6, 1995, after publishing legal notice thereof at least 10 days in advance of said hearing as required by statute, and Whereas the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition October 24, 1995, after publishing legal notice thereof at least 10 days in advance of said hearings as required by ordinance, and Whereas it is desirable to vacate said public ways, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public way described below are hereby vacated and the abutting property owners shall acquire ownership of the land heretofore dedicated as a public way as indicated below, to wit: (1) the first alley south of North C Street between Fort Wayne Avenue on the east and North 5th Street on the west in the City of Richmond, Indiana, Shirley A. Jones acquiring a strip equal to one-half of the width of said alley abutting the south side of Auditor's Map No. 46-32-430-102.000-29; Lawrence Habschmidt and Catherine Habschmidt, as tenants -by - the -entireties, acquiring a strip equal to one-half of the width of said alley abutting the south side of Auditor's Map No. 46-32-430-111.000-29; Larry E. Fox and Phyllis L. Fox, as tenants -by the entireties, acquiring a strip equal to one-half of the width of said alley abutting the north side of Auditor's Map No. 46-32-430-103.000 and 110.000-29; (2) the second alley south of North C Street between Fort Wayne Avenue on the east and North 5th Street on the west in the City of Richmond; Irene France and Robert Dean Ullery, Sr. as tenants -in -common, acquiring a strip equal to one-half of the width of said alley abutting the south side of Auditor's Map No. 46-32-430-105.000-29; James P. Hartig, as record owner, and Roberta Adams, as contract purchaser, acquiring a strip equal to one-half of the width of said alley abutting the south side of Auditor's Map No. 46-32- 430-107.000-29, and Triangle Realty, Inc. acquiring a strip equal to one-half of the width of said alley abutting the north side of Auditor's Map No. 46-32-430-106.010 and 106.020-29. q� Passed and adopted this bth day of November, 1995, by the Common Council of the City of Richmond, Indiana.' resident Sarah L. MILLIGAN City Attorney This ordinance responds to the request for vacation of public ways sef forth in Vacation Petition I1-1995, appearing on your agenda for public hearing at Item 6. All but one of the abutting property owners have signed the petition and the property owner who did not sign the petition has been given notice by the City Clerk as required by Statute. I will present the petition at your meeting. The Advisory Plan Commission conducted a hearing on this request at its October 24th meeting and its favorable recommendation has been furnished to you in this packet.
