HomeMy Public PortalAbout2019.062 (06-18-19) RESOLUTION NO. 2019.062 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING THE FOURTH OF JULY STREET CLOSURE REQUESTS FROM THE NEIGHBORHOOD BLOCK WATCH CAPTAINS OF 12100 BLOCK OF CORNISH AVENUE, 3900 BLOCK OF CORTLAND STREET, AND 3800 BLOCK OF PLATT AVENUE AND WAIVING ALL SPECIAL EVENT PERMIT FEES WHEREAS, the Neighborhood Block Watch Captains for the 12100 Block of Cornish Avenue, 3900 Block of Courtland Street, and 3800 of Platt Avenue have submitted a Special Event Permit application for the closure of a portion of their respective streets for a Fourth of July Neighborhood Block Watch celebration; and WHEREAS, the City Council established Neighborhood Block Watch Group Street Closure Request Guidelines in 2014 for this type of event. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council approves a Special Event Permit for the closing of the following streets on July 4, 2019, between the hours of 12:00 p.m. to 10:00 p.m., to each of the respective Neighborhood Block Watch Captains. • Cornish Avenue between Agnes Avenue and Magnolia Avenue • Cortland Street between Muriel Drive and Gertrude Drive • Platt Avenue between Ernestine Avenue and Gertrude Drive Section 2. The City Council approves the waiver of all fees related to the issuance of a Special Event Permit to each of the respective Neighborhood Block Watch Captain for said date and time. Section 3. The City Council finds, per V.C. 21101 (e), that the closure of these streets on July 4, 2019, during the approved event times, are necessary for the safety and protection of persons in attendance at the neighborhood parties and hereby approves such street closures. Section 4. The City Council further finds that all City and County laws and regulations must be obeyed and complied with during all activities of the event including but not limited to the following: a) Each Special Event Permit is for July 4, 2019 between the hours of 12:00 p.m. and 10:00 p.m., only. b) Each Block Watch Captain will be responsible for ensuring at no time during the street closure that there is any discharging, possessing, and/or selling of illegal fireworks. If any such violation is observed and City staff or the Los Angeles County Sheriffs Department is unable to determine the violator, then the citation will be issued to the Block Watch Captain. Each citation carries a $5,000 fine per violation. c) Each Block Watch Captain must provide proof of a policy or policies of comprehensive general liability insurance with minimum limits of two million dollars ($2,000,000) per occurrence, combined single limit coverage and four million dollars ($4,000,000) in the aggregate against any injury, death, loss or damage as a result of wrongful or negligent acts or omissions by the applicant, with an endorsement naming the City as an additional insured. d) All barricades must be manned for the duration of the event. The barricades will be provided by the City's Public Works Department, which will be placed at both ends of the authorized event location on the business day prior to the event. Each Neighborhood Block Watch Group is responsible for properly placing the barricades out at the authorized street closure times and must return the barricades to the same drop-off points at the conclusion of the event. Public Works staff will pick up the barricades on the next business day. No other barricades other than what is provided by the City may be used to block any approved street closure. e) Each Block Watch Captain will be responsible for ensuring that their respective street, as well as the public right-of-way, is cleaned at the conclusion of the event in a manner that is to the satisfaction of the Public Works Director or his designee. f) No alcohol or cannabis consumption shall be allowed on the street or within the public view. g) Each approved street closure must allow access to public and/or emergency vehicles at all times. h) No outside vendors shall be allowed within the designated street closure at any time during the duration of the event. i) No blocking of driveways and/or sidewalks, and each Block Watch Captain must comply with all NPDES regulations. j) Parking on unpaved areas is prohibited Section 5. This resolution becomes effective immediately upon adoption. Section 6. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect.
