A GENERAL ORDINANCE AMENDING CHAPTERS 72, 73 AND 74 OF THE
RICHMOND CODE
Whereas it is desirable to clarify the understanding and enhance the enforcement of
provisions of Chapter 72 entitled "Pedestrians", Chapter 73 entitled `Bicycles", and
Chapter 74 entitled "Parking", all of which chapters are part of the traffic
regulations set forth in the Richmond Code, and
Whereas certain inconsistencies should be removed and the penalty provisions standardized,
Now, therefore, be it ordained by the Common Council of the City of Richmond, Indiana, that the
Richmond Code be amended to read as follows:
A. Add "72.00 Definitions"(See text in Exhibit A).
B . Add "72.05 Penalty" (See Text in Exhibit A).
C. Add "73.00 Definitions" (See Text in Exhibit B).
D. In 73.01 (a) replace "misdemeanor" with "violation".
E. Change the first line of 73.01 (b) to "The parent or guardian of any child shall not
authorize or".
F . Change the first line of 73.11 (a) to "The owner, if 18 years or older, or the".
G . Change the first and second lines of 7 3. 11 (b) to "The provisions of this section
shall apply to all persons acquiring bicycles hereafter, whether the".
H . Add "73.15 Penalty" (See text in Exhibit B).
1. Add "74.00 Definitions" (See text in Exhibit Q.
J. Change 74.01 to text in Exhibit C.
K. Change the third line of 74.02 to "within the City unless the Indiana
Department of Transportation has determined by resolution entered in its".
L. Change 74.03 to text in Exhibit C.
M. Change 74.04 (a), (b) and (c) to text in Exhibit C.
N. Delete 74.04 (d).
O. Change 74.04 (e) to 74.04 (d) and to text in Exhibit C.
P. Add to first line of 74.11 "...designated streets except for Section 74.21 it"
and change last word of section from "offense" to "violation".
Q. Change 74.12 and 74.13 to text in Exhibit C.
R. Change first line of 74.14 to "No vehicle shall be stood or parked, except
when necessary to avoid conflict with", and add "The operator of a vehicle
or the owner of an unattended vehicle shall be liable for violation of this
section and fined $10.00" at the end of 74.14.
S . Change 74.15, 74.16, 74.17, 74.18, 74.19, 74.20, 74.21 and 74.22 to text
in Exhibit C.
T. In 74.23 delete "of Public Works and Safety" from subsections (a), (b), (c)
and (d) and change (h) to "Any vehicle owner violating this section shall be
subject to a fine of $10.00 plus being responsible for the cost of towing and
impounding the vehicle".
U . In 74.24 delete "of Public Works and Safety" from the first line of (a), change
the second line of (b) to "thereof, no vehicle shall be stopped, stood or parked
in a manner inconsistent with the", and replace (d) with "The operator of the
vehicle or the owner of an unattended vehicle shall be liable for violation of
this section and fined $10.00".
V . In 74.25 delete (b), (e) and (f) and change remainder of section to text in
Exhibit C.
W . In 74.26 and 74.27 change to text in Exhibit C.
X . There is no change in 74.28.
Y. The only change in 74.29 is the last sentence in (f) to "The operator of a
vehicle or the owner of an unattended vehicle parked in violation of this section
shall be fined $50.00".
Z. In 74.30 change to text in Exhibit C.
AA. There is no change in 74.35.
BB. In 74.36 and subsection (e) "The operator of a bus or taxicab who violates this
section shall be fined $10.00".
CC. Change 74.37 to text in Exhibit C.
DD. In 74.40, change first and second lines of (a) to "where signs are erected
designating loading zones, no vehicle shall be stopped, stood or parked unless
for the express purpose of loading or unloading multiple or heavy items" and
replace (e) with "The operator of a vehicle or the owner of an unattended
vehicle shall be liable for violation of this section and fined $10.00".
EE. In 74.45 add "(g) The penalty for violation of this section is a $10.00 fine".
FF. Delete 74.46.
GG. Replace 74.47 with the text in Exhibit C.
HH. Delete 74.48 and 74.49.
II. Replace 74.50 with the title and text in Exhibit C.
JL Delete 74.99.
KK. This ordinance shall take effect immediately upon publication as required by
Indiana Code 5-3-1-2 (h).
Passed and adopted this 18th day of December, 1995, by the Common Council of the City of
Richmond, Indiana.
