AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 1996 FIREFIGHTER
SALARY ORDINANCE
WHEREAS Indiana Code 36-8-3-3 (d) requires Common Council to fix the annual compensation
of firefighters by ordinance before August 2 of each year for the ensuing budget
year, and
WHEREAS Such an ordinance was not timely adopted because a collective bargaining agreement
between the City of Richmond and Richmond Professional Firefighters, Inc.
AFL-CIO Local 1408 was still being negotiated, and
WHEREAS it is now possible to adopt a firefighter salary ordinance because the parties have
reached an agreement on salary levels for 1996, and

WHEREAS the Board of Public Works & Safety and the Firefighters Union have executed and
Mayor Roger Cornett has approved an addendum to the collective bargaining
agreement between the City of Richmond and the Richmond Professional
Firefighters, Inc. Local No. 1408 of the International Association of Firefighters
AFL-CIO, which is attached hereto as Exhibit A,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana that
the following positions be compensated not in excess of the respective sums hereafter set forth during
calendar year 1996, to wit:

Passed and adopted this 18th day of December, 1995 by the Common Council of the City of

ADDENDUM TO PROFESSIONAL NEGOTIATION
AGREEMENT BETWEEN RICHMOND
PROFESSIONAL FIREFIGHTERS, INC., LOCAL 1408
OF THE INTERNATIONAL ASSOCIATION OF
FIREFIGHTERS AFL-CIO and the CITY OF
RICHMOND, INDIANA
THIS ADDENDUM supplements that certain "Professional Negotiation Agreement"
dated the 29th day of July, 1993, and entered into between RICHMOND
PROFESSIONAL FIREFIGHTERS, INC. AFL-CIO LOCAL 1408, and the CITY OF
RICHMOND, INDIANA, and thereafter supplemented by a prior ADDENDUM dated
the ±14 day of p�' Emga, , 1995, effective as of January 01, 1996,a follows:
ARTICLE 32
Increase the annualized rates of pay provided in Article 32 by four and one-half
percent (4.50%) for the period from January 01, 1996 through December 3I, I996, and by
an additional four percent (4.00%) for the period from January 01, 1997, through
December 31, 1997, as follows:

ARTICLE 28
A. Active Employee Insurance Benefits (present contract language)
(Add a new section "B. Retiree Insurance Benefits" to Article 28 as follows:)
B. Retiree Insurance Benefits.
The City shall pay the sum of Two Thousand Dollars ($2,000.00) per year per
retiree toward the premium cost of group health insurance coverage for the benefit of
"Eligible Retirees", as herein defined, subject to the following terms and conditions:
1. No health insurance premium contribution shall be required of City for those
Eligible Retirees who obtain subsequent employment after retirement from the City, and

through which subsequent employment there is available to the retiree participation in the
subsequent employer's group health insurance program at a cost to the retiree that does
not exceed the employee/retiree's premium contribution for coverage under the City's
plan by more than ten percent (10.0%) for the comparable type of coverage selected (i.e
single member or multiple/family coverage). Each retiree shall, upon request of the City,
certify that he/she has obtained no such subsequent employment whereby he/she enjoys
an entitlement to such alternative group health insurance participation.
2. An Eligible Retiree who has obtained subsequent insurance coverage through a
successor employer and later loses that coverage for any reason may re -enroll in the
City's insurance plan and be entitled to the above annual contribution toward such
insurance. If the retiree re -enrolls during a calendar year, the City's contribution for that
calendar year shall be pro -rated on a monthly basis starting with the month that the retiree
becomes eligible for coverage under the City's plan. In any suchcase,the retiree and
his/her dependents shall not be covered for pre-existing conditions as those conditions are
then defined at the time of re -enrollment by the City's plan documents.
3. The City's contribution for retiree health insurance benefits shall continue until
the retiree becomes eligible for Medicare coverage as prescribed by 42 U.S.C. 1395,
et.seq. The amount of the City's contributions to any retiree hereunder shall be subject to
subsequent modification through the collective bargaining process and any resulting
change in the terms of this Collective Bargaining Agreement, whether such changes
occur before or after a particular retiree's effective date of retirement.
4. For purposes of this Article 28, an "Eligible Retiree" is defined to be any
member of the RICHMOND PROFESSIONAL FIREFIGHTERS, INC., Bargaining Unit
who retires from active duty on the force, in good standing, and with twenty (20) or more
years of accredited service as recognized in the particular retirement program in which
the member is a participant [i.e.The 1937 Firefighters' Pension Fund (I.C. 36-8-6-1,
et.seq.) or The 1977 Police Officers' and Firefighters' Pension and Disability Fund (I.C.
36-8-8-1, et.seq.)] or any member who, while an active member of the force, becomes
disabled as determined by the PERF Board.
5. The insurance contribution benefits hereunder shall only be available to those
Eligible Retirees whose first effective date of retirement is on or after January 01, 1996,
and to those retirees and/or dependents of a retiree who are participating in the City's
group health insurance plan as of December 31, 1995.
THIS ADDENDUM is executed and approved by the undersigned representatives of the
City and Union this , day of December, 1995, to be effective in accordance with
its terms as of January 01, 1996.

This ordinance is required by Indiana Statute and is the Firefighters Salary Ordinance for 1996.
You have previously adopted a 1996 Police Officers Salary Ordinance and the 1996 Salary Ordinance
for all other City employees whose compensation levels are set by the Mayor.
The addendum to the existing collective bargaining agreement fixes compensation for both 1996 and
1997.
The ordinance can be passed in a single meeting with motions to suspend the rules.
