RESOLUTION NO. 2006-35
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
ADOPTING A MITIGATED NEGATIVE DECLARATION
FOR APPLICATION NO. 06-024 (ALDER DRIVE AFFORDABLE HOUSING
OPPORTUNITY SITE ZONING MAP AMENDMENT)
WHEREAS, the Truckee Community Development Department prepared an Initial Study
to identify potentially significant effects that may result from the rezoning of the Alder Drive
Affordable Housing Opportunity Site to RM-10 (Multi-Family Residential, 10 dwelling units per
acre); and
WHEREAS, the Initial Study identified that the rezoning and anticipated development
may have several potentially significant effects on the environment; and
WHEREAS, mitigation measures have been identified in the Initial Study to avoid the
potentially significant effects or mitigate the effects to a point where clearly no significant effects
would occur, and these mitigation measures have been incorporated into the project; and
WHEREAS, the Community Development Department prepared a proposed Mitigated
Negative Declaration based on the findings of the Initial Study; and
WHEREAS, the Community Development Department released the Initial Study and
proposed Mitigated Negative Declaration for public review and provided a notice of intent to
adopt a Mitigated Negative Declaration in accordance with Section 15072 of the CEQA
Guidelines; and
WHEREAS, the Community Development Department provided a public review period of
no less than 30 days and sent copies of the proposed Mitigated Negative Declaration to the
State Clearinghouse in accordance with Section 15073 of the CEQA Guidelines; and
WHEREAS, the Planning Commission reviewed the Initial Study and proposed Mitigated
Negative Declaration and recommends that the Council adopt the proposed Mitigated Negative
Declaration with no modifications; and
WHEREAS, the Town Council, as the lead agency, considered any and all comments
received during the public review process; and
WHEREAS, the project is located within the boundaries of the Truckee Tahoe Airport
Compatibility Land Use Plan, and the Council considered whether the project will result in a
safety hazard or noise problem for persons using the airport or for persons residing or working
in the project area.

NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee
hereby adopts the Mitigated Negative Declaration, and the Initial Study used as the basis for the
Mitigated Negative Declaration, for Application No. 06-024 (Alder Drive Affordable Housing
Opportunity Site Zoning Map Amendment).
BE IT FURTHER RESOLVED, the Town Council hereby finds on the basis of the whole
record before the Town Council, including the Initial Study and any comments received, that
there is no substantial evidence that the Zoning Map amendment will have a significant effect on
the environment.
BE IT FURTHER RESOLVED, the Mitigated Negative Declaration, Initial Study, and
other documents and materials constituting the record of proceedings are located in the
Community Development Department, 10183 Truckee Airport Road, Truckee, California under
the custody of the Town Planner.
BE IT FURTHER RESOLVED, the Town Council hereby determines that the project will
have an adverse impact on wildlife resources and, pursuant to Section 21089 of the Public
Resources Code and Section 711.4 et seq. of the Fish and Game Code, is subject to the
Department of Fish and Game environmental filing fee.
BE IT FURTHER RESOLVED, the Town Council hereby adopts the following as the
mitigation monitoring and reporting program for the Mitigated Negative Declaration:
a. The mitigation measures shall be adopted as conditions of approval of the
Zoning Map amendment and shall be incorporated into Town Ordinance No. 2006-03 as
conditions for future development.
b. The Community Development Director shall review all land use and development
permit applications for future development on the property and shall verify that the mitigation
measures are addressed in the application and the development complies with the mitigation
measures. This shall be done at the time of approval of the land use and development permit
application as a finding, at the time of issuance of construction and building permits, and at the
time of issuance of certificates of occupancy.
The foregoing Resolution was introduced by Council Member Green,
seconded by Council Member Threshie, at a Regular Meeting of the Truckee Town
Council, held on the 1s1 day of June 2006 and adopted by the following vote:
