HomeMy Public PortalAbout536 Ordinance Establishing the Enclave at Brockton Storm Sewer Improvement Tax DistrictCITY OF MEDINA ORDINANCE NO.536 AN ORDINANCE ESTABLISHING THE ENCLAVE AT BROCKTON STORM SEWER IMPROVEMENT TAX DISTRICT THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA ORDAINS AS FOLLOWS: Section I. Background: Findings. 1.01. The City is authorized by Minnesota Statutes, Sections 444.16 — 444.21 (the "Act") to establish a storm sewer improvement tax district (the "District") to acquire, construct, reconstruct, extend, maintain and otherwise improve storm sewer systems and related facilities within the District in accordance with the Act and to levy a tax on all taxable property within the District to finance such activities. 1.02. It is found and determined that it is in the best interests of Medina and its storm water management program that the District be established for the property being developed as The Enclave at Brockton. The District shall be comprised of the nine parcels of land within Medina legally described as follows: Parcel 1 The West 1/2 of the North 345 feet of the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 1354413). Parcel 2 The East %2 of the North 345 feet of the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 1034871). Parcel 3 The North 172.50 feet of the South 345 feet of the North 690 feet of the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 1354412). Parcel 4 The South 172.50 feet of the North 690 feet of the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 1354411). Ordinance No. 536 1 October 2, 2012 Parcel 5 That part of Lot 1, Block 1, Navajo Hills Addition, embraced within the Southeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23; and That part of Lot 1, Block 1, Navajo Hills Addition, embraced within the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23 (C/T 1151755). Parcel 6 Lot 2, Block 1, Navajo Hills Addition embraced within the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T1220701). Parcel 7 The South 382.00 feet of the North 1072.00 feet of the East 607.00 feet of the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 701251). Parcel 8 Torrens: That part of Lot 1, Block 2, Navajo Hills Addition embraced within the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 1345391); and Abstract: Lot 1, Block 2, Navajo Hills Addition, Hennepin County, Minnesota. Parcel 9 Torrens: That part of Lot 2, Block 2, Navajo Hills Addition, embraced within the Northeast Quarter of the Northeast Quarter of Section 13, Township 118, Range 23, Hennepin County, Minnesota (C/T 847904); and Abstract: That part of Lot 2, Block 2, Navajo Hills Addition, embraced within the Southeast Quarter of the Northeast Quarter of Section 13, Township 118 North, Range 23, West of the 5th Principal Meridian, Hennepin County, Minnesota. Section II. Establishment: Authorizations. 2.01. The Enclave at Brockton Storm Sewer Improvement Tax District is established. The city shall have all powers and authority conferred by the Act in the operation and financing of the activities of the District. 2.02. The boundaries of the District are as described above. Ordinance No. 536 2 October 2, 2012 2.03. The City Administrator -Clerk is authorized and directed to file a certified copy of the ordinance with the Hennepin County Auditor, the Office of the Hennepin County Recorder and the Office of Registrar of Titles of Hennepin County. Section III. This ordinance shall become effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 2nd day of October, 2012. c T.M.
