ORDINANCE NO.540
AN ORDINANCE AMENDING ORDINANCE NO.528;
REPEALING A MORATORIUM ON THE CONSTRUCTION
OR EXPANSION OF WIND ENERGY CONVERSION SYSTEMS
THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS:
Section 1. Background.
1.01. On June 5, 2012, the city of Medina (the "City") adopted Ordinance No. 528, an
interim ordinance establishing a moratorium on the acceptance, review, processing or approval
of applications for the establishment, construction, or expansion of wind energy conversion
systems.
1.02. The City's purpose in adopting the interim ordinance was to preserve the planning
process and to protect the health, safety and welfare of the citizens of the community by studying
the City's official controls regarding wind energy conversion systems to determine if they
needed to be modified or supplemented.
1.03. Since the adoption of the interim ordinance, the City has finalized its review of
regulations related to wind energy conversion systems. This effort has resulted in the adoption
of an ordinance which amended City regulations related to wind energy conversion systems.
The ordinance was adopted by the City on November 7, 2012, and was effective upon
publication.
Section 2. Findings Repeal of Moratorium.
2.01. In light of the conclusion of the planning process regarding the regulation of wind
energy conversion systems, it is hereby found and determined by the City that the moratorium is
repealed.
2.02. City staff may henceforth accept and process applications regarding the
establishment, construction, or expansion of wind energy conversion systems, subject to such
restrictions and processes now in effect in the City's ordinances and other laws.
Section 3. Effective Date.
3.01. This ordinance shall be effective upon its adoption and publication.
