A SPECIAL ORDINANCE AMENDING CHAPTER 154 OF THE RICHMOND
CODE, COMMONLY KNOWN AS THE ZONING ORDINANCE
WHEREAS, the Zoning Map designates the area bounded by Toschlog Road on
the west, Southwest 21st Street on the east, National Road West on
the North and portions of Hidden Valley Sub -Division and the
corporate boundary on the South as R-2 Single Family Residence
District, and
WHEREAS, it is desirable to change the zoning district to R-1 Single Family
Residence District for said area,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning classification of the area more particularly described below is hereby changed to R-
1 Single Family Residence District, to -wit:
Beginning at the point of intersection of the South boundary of C-2 zoning on the South side of
National Road West and the center of S. W. 21st Street, thence Westward along the South
boundary of C-2 zoning on the South side of National Road West to a point in the center of
Toschlog Road at the point of intersection of Toschlog Road and the South boundary of C-2
zoning on the South side of National Road West; thence South along the center line of Toschlog
Road to the point at the intersection of the center line of Toschlog Road and the Richmond
corporation Iimit; thence Eastward along the Richmond Corporation limit to the point at the
intersection of the Richmond Corporation limit and the Southeast comer boundary of Wayne
County auditor taxation map 49-01-440, parcel 417; thence North along the East boundary of
Wayne County Auditor taxation map 49-01-440 parcel 417 to the point of intersection of the East
boundaries of Wayne County Auditor taxation map 49-01-440 parcel 417 and Wayne County
Auditor taxation map 49-01-420 parcel 414; thence North along the East boundary of Wayne
County Auditor taxation map 49-01-420, parcel 414; thence North along the center of S. W. 21st
Street to the point of beginning.
PASSED AND ADOPTED this day of , 1992, by the Common Council of

Mrs. Carnes:
The Richmond Advisory Plan. Commission conducted a public hearing on
Tuesday, February 25, 1992 on the petition of the owners of 50% or more
of the property bounded on the West by the center line of Toshlog Road, on
the East by South West 21 st.Street on the North by the C-2 zoning line
behind Frich's restaurant and extending South to the City Corporate
boundary.
Letters were sent to 34 property owners 23 were returned in favor of the
requested rezoning.
THE PLANNING STAFF REPORT IS AS FOLLOWS:
Preunt Use: R-2 single family residential 8,000 square foot lot size.
PROPOSED U,,$E: R-1 single family residential 12,000 Square foot lot size.
The area involved in this petition is, for the most part, built up homesites
which exceed the requirements for R-2 residential, which is the zone
classification they presently carry. The practical effect of this request is
to demand larger lots from the developer who presently has a
subdivision request before the Planning Commission. The subdivision
proposed has generally set up lot sizes averaging 10,500 square feet
which is 2,500 square feet more than is presently required by ordinance

and 1500 square feet per lot less than would be required if this rezoning
is passed.
We, as City officials, are charged with the responsibility of zoning
property in a manner which will allow its widest possible use without
infringing on the rights of neighboring property to be utilized and enjoyed
while at the same time protecting the value of the neighbors property. To
the extent that good zoning can accomplish that task we must ask
ourselves, what benefit will be derived by the petitioners by rezoning
their properties? I cannot think of any direct benefit to them. However,
feel many of them think that R-2 zoning means low income housing or
inexpensive single family homes. What benefit is there to the developer
who is not one of the petitioners but whose property is included in the
request ?
Obviously ,the developer will be punished by this _action. He
purchased the property zoned R-2 with the intention of using and
developing the ground consistent with what the zoning allowed, that is,
home sites of 8,000 square feet or more.
Oakpark, Crestdale and Meadow Park subdivisions, are all zoned R-2.
These homes are some of the finest this community has to offer and they
continue to appreciate in value. The developer has testified before the
Planning Commission that they are projecting home values in the
$100,000 range which translates to about 1800 square foot homes.
feel that we must be sympathetic to the concerns of the residents any
time they feel threatened by actions of a developer or by City government.
In this instance, I can see no legitimate reason to share their concern. To
the contrary, the drainage problem which plagues many of the properties
along Toschlog road will be greatly improved as a result of the drainage
controls implemented through consultations with the City Engineer and
the developers engineers.
The traffic congestion noted at the intersection of South West 21 st. and
National Road is primarily the result of traffic along National Road which
handles thousands of cars per/day. The addition of the difference between
the number of homes allowed in an R-2 development and an R-1
development making a turning movement at that intersection is not
statistically significant.
In the past few days the State has announced their intentions to install a

"L;'affic signal at Toschlog and National which will platoon Eastbound
traffic on National allowing more time for side streets and business lots
to empty.
The City Master Plan, adopted just recently, calls for this area to be
developed as low density residential. Low density residential is defined as
2-5 residential units per acre. The proposed development is approximately
9 acres and contains 25 building lots. Well within the guidelines of the
Master Plan
The Planning Commission voted 10-1 to recommend that Council
deny this request.

Dear Mr.Elstro, Members of Common Council and
Mrs. Carnes:
The Richmond Advisory Plan Commission conducted a public hearing on
Tuesday, February 25, 1992 on the petition of Birthright of Richmond Inc.;
seeking a Special Use designation of their property located at 303 South
6th. Street.
4 letters were sent to adjacent property owners regarding this request
and none were returned opposed. Many neighbors from the area attended
the meeting and spoke in favor of the proposed change. No one spoke in
opposition to the request.
The petitioners are requesting a special use ,as permitted under Article
48 of the zoning ordinance, to establish an office use in the structure
located at 303 South 6th. Street. The building is currently vacant and has
been used as a residence in past years .The ordinance allows for such use
if it will not be detrimental to, or impair the natural growth of, the
neighborhood. Parking for this office has been granted by Saint Andrews
Church ,immediately across the street, for as long as the office remains
at that location.
The Planning Commission voted 11-0- to recommend passage of
this ordinance by Council.
