HomeMy Public PortalAbout2021.09.08 Workshop Packet WORKSHOP MEETING SEPTEMBER 8, 2021 4:00 PM AGENDA 09-08-2021 PLEDGE OF ALLEGIANCE ROLL CALL REVIEW OF AGENDA ITEMS FOR THE SEPTEMBER 14, 2021 RTB MEETING ITEM(S) FOR BOARD ACTION 9WS2021-1 RESOLUTION Establishing a Salary for the Deputy Supervisor During Periods of Vacancy in the Office of the Supervisor 9WS2021-2 RESOLUTION to Enter into a Memorandum of Understanding Between the Town of Irondequoit and Drug-Free Irondequoit for Use of Office Space Within the Irondequoit Community Center **NEXT REGULAR TOWN BOARD MEETING…TUESDAY, SEPTEMBER 14, 2021 @ 7 pm ** Resolution No. 2021-________ EXTRACT OF MINUTES OF MEETING OF THE TOWN BOARD ADOPTING A RESOLUTION ESTABLISHING A SALARY FOR THE DEPUTY SUPERVISOR DURING PERIODS OF VACANCY IN THE OFFICE OF THE SUPERVISOR At the Workshop Meeting of the Town Board of the Town of Irondequoit, Monroe County, New York held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 8th day of September, 2021, at 4:00 P.M. local time; there were: PRESENT: Patrina Freeman Town Board Member John Perticone Town Board Member Kimie Romeo Town Board Member Peter Wehner Town Board Member Harter Secrest & Emery LLP Attorney for the Town Town Board Member _____________________ offered the following resolution and moved its adoption: WHEREAS, the Town Board has established the office of the Deputy Supervisor, and the Deputy Supervisor upon a vacancy in the office of the Supervisor assumes the powers and duties of the Supervisor; and WHEREAS, the powers and duties of the Supervisor are substantial, and the Supervisor—when his or her office is not vacant—ordinarily receives a salary commensurate to his or her substantial duties; and WHEREAS, there is currently no salary established for the office of the Deputy Supervisor, despite the fact that the Deputy Supervisor during the vacancy of the office of the Supervisor assumes all of the responsibilities of the Supervisor; and WHEREAS, the Town Board wishes to establish a salary for the office of the Deputy Supervisor for those periods of time when the office of the Supervisor is vacant and the Deputy Supervisor assumes the powers and duties of the Supervisor for such period of vacancy; and WHEREAS, pursuant to Town Law Section 42, the “town board shall fix the compensation which the deputy supervisor shall receive, which compensation may be in addition to any other compensation he [or she] may receive as a town officer, town official or town employee”; and WHEREAS, funding for such salary will be drawn from account #001.1220.0104.1144. NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby establishes a salary for the office of the Deputy Supervisor during a period of a vacancy in the office of the Supervisor, in the amount of $1,000, payable on a bi-weekly basis. Such compensation shall be in addition to any other compensation the Deputy Supervisor may receive as a Town officer, Town official, or Town employee. AND, THEREFORE, BE IT FURTHER RESOLVED, that for the sake of clarity, the Deputy Supervisor shall receive such salary only during periods when the office of the Supervisor is vacant and the Deputy Supervisor therefore assumes the powers and duties of the Supervisor. Such salary shall not apply during periods of temporary absence or inability to act of the Supervisor that do not create a vacancy in the office of the Supervisor. This resolution shall take effect immediately upon its adoption. Seconded by the Town Board Member ____________________ and duly put to vote, which resulted as follows: Town Board Member Wehner voting __________ Town Board Member Freeman voting __________ Town Board Member Romeo voting __________ Town Board Member Perticone voting __________ Resolution No. 2021-____________ EXTRACT OF MINUTES OF MEETING OF THE TOWN BOARD ADOPTING A RESOLUTION TO ENTER INTO A MEMORANDUM OF UNDERSTANDING BETWEEN THE TOWN OF IRONDEQUOIT AND DRUG-FREE IRONDEQUOIT FOR USE OF OFFICE SPACE WITHIN THE IRONDEQUOIT COMMUNITY CENTER At the WORKSHOP meeting of the Town Board of the Town of Irondequoit, Monroe County, New York held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 8th day of September, 2021 at 4:00 P.M. local time; there were PRESENT Patrina Freeman Town Board Member John Perticone Town Board Member Kimie Romeo Town Board Member Peter Wehner Town Board Member Harter, Secrest & Emery, LLP Attorney for the Town Town Board Member ________________________ offered the following resolution and moved its adoption: WHEREAS, the Town wishes to enter into a Memorandum of Understanding with Drug-Free Irondequoit (“D-FI”) to allow DF-I to use excess office space at the Irondequoit Community Center; and WHEREAS, the Town desires to provide such office space use as an in-kind donation to D-FI in support of D-FI’s charitable mission and to assist with exploration of possible future collaboration between the Town and D-FI; and WHEREAS, a copy of the Memorandum of Understanding is attached hereto and made a part hereof (the “MOU”). NOW, THEREFORE BE IT RESOLVED, that the Town Board authorizes the Supervisor or Acting Supervisor to enter into the MOU with D-FI in substantially the form attached hereto and in final form as approved by the Attorney for the Town. This resolution shall take effect immediately upon its adoption. Seconded by Town Board Member __________________ and duly put to vote, which resulted as follows: Town Board Member Wehner voting ___________________ Town Board Member Perticone voting ___________________ Town Board Member Romeo voting ___________________ Town Board Member Freeman voting ___________________ Memorandum of Understanding Between the Town of Irondequoit and Drug -Free Irondequoit As the Town of Irondequoit (the "Town") is interested in providing an in -kind donation of excess office space at the Irondequoit Community Center to Drug -Free Irondequoit ("D-FI") in order to support D-FI's charitable mission and allow for the possibility of future collaboration between the Town and D-FI, the following will outline the donation of excess office space: • Office Space — D-FI is entitled to use excess office space within the Irondequoit Community Center, as designated by the Town. • No Furniture, Equipment, or Personnel - The Town's in -kind donation of excess office space to D-FI is in no way intended to obligate the Town to provide furniture, equipment, or personnel to D-FI. • No License — At all times, D-FI is a guest of the Town. The Town's in -kind donation of excess office space to D-FI in no way creates a license or any other property interest in favor of D -Fl. • Rules and Regulations- At all times, D-FI will comply with all rules and regulations of the Town of Irondequoit, the Irondequoit Community Center, and any other relevant governmental body. • Termination - Either party may terminate this Memorandum of Understanding at any time without notice to the other party. • Indemnification— D-FI will indemnify, defend, and hold harmless the Town for all claims brought against the Town related to this Memorandum of Understanding or D-Fi's use of the excess office space. The signatures below indicate the acceptance of the conditions outlined above and the intention of both parties to move forward with those actions. It is also the intention of both parties, that should the results of the above actions indicate that the project/partnership should continue and be further developed, additional Memorandums of Understanding can/will be drafted as the project is developed.
