NOW, THEREFORE, BE IT RESOLVED, that the Town Board approves the 2022 Organization, Workshop and Regular Town Board Meeting Schedule as follows: Organization Meeting: January 4, 2022 @ 4:00 p.m. in the Broderick Room. Workshop Meetings (4:00 p.m. Tuesdays) January 11, 2022 February 8, 2022 March 8, 2022 April 12, 2022 May 10, 2022 June 14, 2022 July 12, 2022 August 9, 2022 September 13, 2022 October 11, 2022 November 8, 2022 December 13, 2022 Regular Town Board Meetings (7:00 p.m. Tuesdays) January 18, 2022 February 15, 2022 March 15, 2022 April 19, 2022 May 17, 2022 June 21, 2022 July 19, 2022 August 16, 2022 September 20, 2022 October 18, 2022 November 15, 2022 December 20, 2022 This resolution shall take effect upon its adoption. Seconded by the Town Board Member and duly put to vote, which resulted as follows: Town Board Member Wenner voting Town Board Member Romeo voting Town Board Member Freeman voting Town Board Member Perticone voting Resolution Number 2021 -- EXTRACT OF MINUTES OF MEETING OF TOWN BOARD ADOPTING A RESOLUTION APPROVING THE SPECIAL EVENT LICENSE FOR THE SEA BREEZE ANNUAL VOLUNTEER FIRE DEPARTMENT WINTER PARADE AND FIREWORKS At a workshop meeting of the Town Board of the Town of Irondequoit, Monroe County, New York held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 14th day of December 2021 at 4:00 P.M. local time; there were: PRESENT: John Perticone Patrina Freeman Kimie Romeo Peter Wehner Town Board Member Town Board Member Town Board Member Town Board Member Harter Secrest & Emery LLP Attorney for the Town Town Board Member offered the following resolution and moved its adoption: WHEREAS, the Town Clerk's Office received an application from Sea Breeze Volunteer Fire Department to conduct its Annual Winter Parade and Fireworks on Saturday, December 18, 2021 from 5:30 p.m. to 7:30 p.m.; and WHEREAS, the County of Monroe Department of Transportation has approved Sea Breeze Volunteer Fire Department to assemble at Topper Drive and disband at 4657 Culver Road; and WHEREAS, proof of current insurance, which expires on June 1, 2022 has been reviewed and approved by the Town Insurance carrier. NOW, THEREFORE, BE IT RESOLVED, that the Town Board approves the Special Event License to conduct the Annual Sea Breeze Volunteer Fire Department Winter Parade and Fireworks on Saturday, December 18, 2021 from 5:30 p.m. to 7:30 p.m. from Topper Drive to the Sea Breeze Volunteer Fire Department, upon the following conditions: 1) that the Sea Breeze Volunteer Fire Department notifies all affected residents before the event; and 2) that Sea Breeze Volunteer Fire Department obtains a fireworks permit from the Office of the Fire Marshal. This resolution shall take effect immediately upon its adoption. Seconded by Town Board Member and duly put to vote, which resulted as follows: Town Board Member Wehner voting Town Board Member Romeo voting Town Board Member Freeman voting Town Board Member Perticone voting Resolution No. 2021-________ EXTRACT OF MINUTES OF MEETING OF THE TOWN BOARD AUTHORIZING A SETTLEMENT AND RELEASE AGREEMENT At the workshop meeting of the Town Board of the Town of Irondequoit, Monroe County, New York held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 14th day of December, 2021, at 4:00 P.M. local time; there were PRESENT: Patrina Freeman Town Board Member John Perticone Town Board Member Kimie Romeo Town Board Member Peter Wehner Town Board Member Harter Secrest & Emery LLP Attorney for the Town Town Board Member _____________________ offered the following resolution and moved its adoption: WHEREAS, Excel Boat Sales, Inc. d/b/a McMillan Marine (“McMillan”) owns real property located at 1070 Empire Boulevard within the Town (the “Premises”); and WHEREAS, McMillan delivered a demand upon the Town, dated November 12, 2021, seeking damages and attorneys’ fees against the Town concerning the Town’s administration certain floodplain regulations concerning the Premises (the “Claim”); and WHEREAS, the Town denies and makes no admission of liability concerning the Claim, but wishes to settle the Claim to avoid further expense, inconvenience, burden and uncertainty of litigation; and WHEREAS, McMillan and the Town have agreed to enter into a Settlement and Release Agreement pursuant to which, and as more fully described therein, the Town will pay $19,000 in full satisfaction of the Claim and McMillan shall release all claims against the Town (the “Settlement Agreement”); and WHEREAS, the Town Board determines that it is in the best interests of the Town to authorize settlement of the Claim and to authorize entry into the Settlement Agreement. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Irondequoit formally approves the Settlement Agreement between the Town and McMillan, and authorizes the Town to pay McMillan $19,000 in full satisfaction of the Claim and for a general release of all other claims against the Town, in such final form as approved by the Attorney for the Town, and further authorizes the Supervisor or Acting Supervisor to execute the Settlement Agreement and any documents related thereto. This resolution shall take effect immediately upon its adoption.
