HomeMy Public PortalAbout2019.098 (08-08-19 • RESOLUTION NO. 2019.098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS AND REBUTTALS REGARDING A CITY MEASURE FOR THE NOVEMBER 5, 2019 LYNWOOD SPECIAL ELECTION AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a. Special Municipal Election is to be held in the City of Lynwood, California; on November 5, 2019, at which there will be submitted to the voters the following measure: Lynwood Public Safety and Vital City Services Protection Measure To protect and maintain vital city police services, fire protection, street and YES pothole repair, parks and recreation programs; and other essential services, shall the City of Lynwood remove the 10 year sunset provision from the - existing one cent sates and use tax? All funds remain in Lynwood. NO . • NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Council authorizes the following member(s) of its body Mayor Jose Luis Solache (Councilmember In Favor) Mayor Pro Tem Aide Castro (Councilmember In Favor) Councilmember Salvador Alatorre (Councilmember In Favor)' Councilmember Jorge Casanova (Councilmember In Favor) Councilmember Marisela Santana (Councilmember In Favor) to file (a) written argument(s) not exceeding 300 words regarding the City measure specified above, accompanied by the printed name(s) and signature(s) of the author(s) submitting it, in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State.of California. The arguments may be changed or withdrawn until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. .SECTION2. The arguments shall befiled with the City Clerk, signed, with the printed name(s).and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization', the name of the organization, and the printed name and signature of at least one of its principal officers who is the authorofthe argument. The Form of Statement to be Filed by Author(s) of Argument(s) shall accompany the argument(s), as required by Section 9600-of the Elections Code of the State of California. 1 SECTION 3. The City Council directs the City Clerk to transmit a copy of the measureto the City Attorney. The City Attorney shall prepare an impartial analysis of the. measure not exceeding 500 words showing the effect of the measure on the existing law and the operation of the measure. The impartialanalysisshall be filed by the date set by the City Clerk for the filing of primary arguments. . SECTION 4. The deadline to submit arguments to the City Clerk for or against the City Measure pursuant to this Resolution is declared by the City Clerk to be Monday, August 19, 2019, at 5:00 p.m. Each argument shall not exceed three hundred (300)words and shall be filed with the City Clerk, signed; and- include the printed name(s) and signature(s) of the author(s).submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at .least one of its principalofficers who is the author of the argument. SECTION 5. Rebuttal Arguments. When the City Clerk has selected the primary arguments for and against each of the City Measures which will be printed and distributed to the voters, the Clerk shall send copies of the primary argument in favor of each Measure to the authors. of.the primary argument against, and copies of the primary argument against to the authors of the primary argument infavor. The authors or persons designated by,them may prepare and submit rebuttal arguments not exceeding two hundred fifty (250) words. The rebuttal arguments shall be filed with the City Clerk not - later.than Thursday, August 29, 2019 at 5:00 p.m. Rebuttal arguments shall be printed in the same manner as the primary arguments. Each rebuttal argument shall immediately • follow theprimary argument which it seeks to rebut. SECTION 6. That this Resolution shall take effect immediately upon adoption. SECTION 7. In all particulars not recited in this resolution, the election shall be. held and conducted as provided by law for holding municipal elections. SECTION 8. Notice of the election is hereby given. Additionally, the City Clerk is authorized, instructed and-directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 9. The City Clerk shall certify to the passage and adoption of this City: • Council Resolution and enter it into=the-book of original Resolutions.
