HomeMy Public PortalAbout026-1992- AMENDING THE ZONING MAP AT 102 SOUTH 18TH STREETA SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 102 SOUTH 18TH STREET WHEREAS the zoning map designates the property located at 102 South 18th Street as R-2 SU One Family Residence Special Use District for an architectural office, and WHEREAS it is desirable to change the zoning district to R-3 SU One To Eight Family Residence Special Use District, to permit the installation of a professional office building, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning classification of 102 South 18th Street, more particularly described as follows: Part of lots 5 and 6 W.D. Foulke; part of lot 1 Jackson Sub -division, and lot 11 of Anna M. Jackson Sub- division, is hereby changed to R-3 SU One To Eight Family Residence Special Use District to permit the installation of a professional office building as provided in Article 22.012-I-B and in accordance with the provisions of Article 48 of Chapter 154 of the Richmond Code. Be it further ordained that the site plan marked Exhibit A and the conditions of approval marked Exhibit B be made a part herof. Create PDF files without this message by purchasing novaPDF printer (ht .//www.novapdf.com) RICHMOND ADVISORY RICHMOND, May 28, 1992 Mr. Jack Elstro, President Members of Common Council and Mrs. Norma Carnes, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance 26-1992 PLAN COMMISSION INDIANA Dear Mr.Elstro, Members of Common Council and Mrs. Carnes: The Richmond Advisory Plan Commission conducted a public hearing on Tuesday, May 26,1992 on the petition of H R B Realty, Fred Harvey, Terry Robinson, and James Backmeyer owners of 102 South 18th Street, requesting a rezoning from R-2 Special Use for an architectural office to a Special Use to permit construction of a professional office building as described in Article 22.012 of the Zoning Ordinance. The petition incorrectly requested another R-2 Special Use designation. It should have requested an R-3 Special Use designation. Notices were sent to surrounding property owners. Twenty six (26) were returned in favor and one (1) in oppositon to the petition. The master plan calls for this area to be reserved for residential use. Also the master plan recognizes the unique differences in those properties deep within the zone and surrounded by like uses, and those properties which make up the perimeter of any neighborhood which is the case with 102 South 18th Street. Perimeter houses are faced with the problems associated with higher volumes of traffic making them less desirable for raising a family. In Create PDF files without this message by purchasing novaPDF printer (ht .//www.novapdf.com) reality the value of the property decreases making it available to less affluent families that, when times get hard, are less able to maintain the same level of maintenance as their more affluent neighbors. In recognition of this propensity to decline in value as a result of their location, the master plan and its enforcement ordinances authorizes the Planning Commission to recommend and the Council to approve a special use for the house or bare land which will halt the decline of the property and the resultant gradual decay which can creep into the neighborhood. A special use should not be granted as a favor to business but as a means of controlling and sometimes reversing the gradual decline in residential values which takes place. The special use must be one which can realize an economic return and at the same time provide an aesthetic buffer to the interior properties. Council may attach conditions to make a positive impact on adjacent residential properties . Article 48 of the zoning ordinance sets forth general standards to be used by the Commission and Council as guidelines in considering "Special Use" zoning. 1.) The "Professional Office Use" will not be detrimental to or endanger public health and safety. 2.) The "Professional Office Use" will not be injurious to the use and enjoyment of adjacent properties for the purpose normally permitted in the area. 3.) The "Professional Use Office" will not substantially diminish property values. 4.) The "Profession Office Use" shall provide for adequate utilities, drainage, landscaping and buffering: and 5.) Adequate measures are to be taken to provide ingress and egress to the property to minimize traffic congestion. Our previous experience with professional offices located in residential areas has been very good. Generally, offices of this nature, such as the medical office at North 15th & A Street, are located at the perimeter of the residential area. In many instances, we have professional offices located in the heart of neighborhoods because they have a positive affect on those remaining residential structures around them. The Planning Commission recommends the following conditions be made a part of the ordinance: 1. The site plan showing parking, landscaping, egress and ingress is to be made a part of the ordinance. 2. A drainage plan is to be submitted to the the City Engineer for approval. 3. The building is to be two stories and constructed of brick & stucco in order to conform with the surrounding residential structures. 4. Sidewalks and curbs are to be installed by the developer pursuant to the site plan.
