HomeMy Public PortalAbout031-1992- ORDINANCE AMENDING THE ZONING MAP FROM 200 S 9TH STREA SPECIAL ORDINANCE AMENDING THE ZONING MAP FROM 200 SOUTH 9TH STREET TO 435 SOUTH 9TH STREET VVHEREAS the zoning map designates the property located along the east and west sides of South 9th Street between South B Street and the C-1 zoning boundary north of South E Street as R4 Multi -Family District, and WHEREAS it is desirable to change the zoning district to C-4 General Business District for said area, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning classification of the area more particularly described below is hereby changed to C- 4 General Busyness District, to -wit: Starting at the centerline of South "B" Street at a point which also is the centerline of the north south alley between South 9th Street and South loth Street; thence West along the centerline of South "B" Street to the intersection of the centerline of the north -south alley between South 9th Street and South 8th Street; thence, South along the centerline of the north -south alley to the centerline intersecting with the C-1 zoning boundary; thence East along the C-1 zoning boundary line to the center line of the north -south alley between South 9th Street and South loth Street; thence North to the point of beginning. I,, 4 ,President (Howard I&Elstro) ATTES , City Clerk (No Carnes) PRESENTED to the Mayor of the City of Richmond, Indiana, this. 2nd day of June, 1992, at 9:00 a.m. City Clerk Norma Carnes) APPROVED by me, Roger Cornett, Mayor of the 'ty of 'chmond, Indiana, this 2nd day of June, 1992, at 9:05 a.m. Mayor mqpr Cornett) ATTES , City Clerk (Norma Carnes) RICHMOND ADVISORY PLAN COMMISSION RICHMOND, INDIANA May 28, 1992 Mr. Jack Elstro, President Members of Common Council and Mrs. Norma Carnes, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance 31-1992 Dear Mr. Elstro, Members of Common Council and Mrs. Carnes: The Richmond Advisory Plan Commission conducted a public hearing on Tuesday,May 26,1992 on the petition of Dan Stiffler, owner of property at 328 & 330 South 9th Street, and agent for properties at 205, 207, 208, 209, 210, 212, 224, 226, 228, 232, 233, 235, 301, 302, 305, 306, 307, 310, 314, 318, 321, 323, 324, 325, 333, 335, 400, 401, 405, 408, 410, 412, 414, 417, and 421 South 9th Street requesting a rezoning from R-4 Multi- Family Residence District to C-4 General Business District to increase the market value of said property. The petitioner, who represents owners in excess of 56% of the property states that the purpose of this re -zoning is to "appreciate value of property" and the reason is "higher value of real estate", except 316 and 318 South 9th Street currently being used as a home improvement company and 328 and 330 South 9th Street, which are proposed to be used for a used car lot known as D & M Auto Sales. Thirty. five (35) notices were sent to surrounding property owners. Four (4) were returned in favor of the petition, none in oppositon. The request extends east & west of South 9th Street to the alleys on each side. This request is in keeping with the Master Plan which calls for special attention to this area along South 8th Street and South 9th Street. The character of this area has changed over the years largely because of the volume of traffic along South 9th Street. The vacant lots simply are not attractive to residential development and have sat empty over the years. A re -zoning to C-4 will allow development to occur in the area and will attract investment dollars to the remaining structures. The Plan Commission felt the owners concerns were legitimate. The highest and best use in their opinion is commercial. Planning Staff recommended approval of the request to the commission. Plan Commission voted unanimously 11 to 0 to recommend approval to Common Council. Respectfully submitted, Robert B.
