Stamper has petitioned the Common Council of the City of Richmond, Indiana, requesting vacation of a portion of a public way known as Elm Place in Elizabeth Starr's Addition, and WHEREAS the Common Council, pursuant to I.C. 36-7-3-12 conducted a public hearing on said petition July 6, 1992, and WHEREAS a public hearing pursuant to R.C. 155.04(B) was conducted by the Richmond Advisory Plan Commission on July 28, 1992, and said body has NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the public right-of-way described below is hereby vacated: That portion of a 40 foot public way known as Elm Place in the City of Richmond bounded by North 10th Street on the west, the north ends of lots 304, 305 and 306 and 13.5 feet off the west side of lot 307 on the south, and the south ends of lots 332 through 337 on the north, all in Elizabeth Starr's Addition to the City of Richmond, Inda. Passed and adopted this day of August, 1992, by the Common Council of the City of Richmond, Indiana. ,President (How . ADVISORY PLAN COMMISSION RICHMOND, INDIANA July 30, 1992 Mr.Jack Elstro, President Members of Common Council and Mrs. Norma Carnes, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance 34-1992 Dear Mr. Elstro, Members of Common Council and Mrs. Carnes: The Richmond Advisory Plan Commission conducted a public hearing on Tuesday, July 28,1992 on the petition of Daniel D. Stamper, 2014 Boston Pike, requesting the vacation of a portion of a 40 foot public way known as Elm Place which is contiguous to the north ends of Lots 304, 305, 306 and 13.5 feet off the west side of lot 307 and to the south ends of lots 332 through 337 in Elizabeth Starr's addition to the City of Richmond. Eighteen (18) notices were sent to surrounding property owners. Two (2) were returned in favor. One (1) was returned in oppositon to the petition. Planning Staff recommended approval of the request siting that vacating the public way does not deny adjacent property owners access to their property. The request to vacate this -public way will ensure that the Atlas Senior apartments will not be separated by a through drive. VA- AIIQN PETITION NO. 3-1992 A PETITION TO VACATE A PUBLIC WAY IN ELIZABETH STARR'S ADDITION TO THE CITY OF RICHMOND Comes now the petitioner, Daniel D. Stamper, 2014 Boston Pike, Richmond, Indiana, owner of lots 304, 305 and 306, 13.5 feet off the west side of lot 307, and 75 feet off the south side of lots 332 through 337 in Elizabeth Starr's Addition to the City of Richmond, Indiana, and requests the vacation of that portion of a 40 foot public way known as Elm Place, which is contiguous to the north ends of said lots 304, 305 and 306 and 13.5 feet off the west side of lot 307 and to the south ends of said lots 332 through 337. This petition is filed pursuant to Indiana Code 36-7-3-12 and Common Council of the City of Richmond is requested to conduct a public hearing on this petition within 30 days of the filing hereof and initiate a vacation ordinance to effectuate the purpose of this petition. Petitioner is the owner of all lots contiguous to the portion of Elm Place which is sought to be vacated by this petition. Wherefore petitioner requests that said public way be vacated subject to the preservation of any existing utility easements. (Daniel D.
