Wilson, Troy Hampton, Mary Jane Hampton and Mount Olive Baptist Church of Richmond, Indiana, have petitioned the Common Council of the City of Richmond, Indiana, requesting vacation of an alley in William Baxter's Addition, and WHEREAS The Common Council, pursuant to I.C. 36-7-3-12 conducted a public hearing on said petition July 6, 1992, and WHEREAS A public hearing pursuant to R.C. 155.04(B) was conductd by the Richmond Advisory Plan Commission, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the presentation of easements for existing utilities, the public right-of-way described below is hereby vacated: A certain alley, 10 feet in width, contiguous to the east ends of lots 29 through 32 and the west line of lot 33 in William Baxter's Addition to the City of Richmond, Indiana. Wilson, 825 North 11 th Street, owner of 26.25 feet off the south side of lot 29 and 8.25 feet off the north side of lot 30 in William Baxter addition; Troy and Mary Jane Hampton, 900 Sheridan Street, owners of 29 feet off the south side of lot 30 and 5.75 feet off the north side of lot 31 in Willam Baxter's addition; and Mount OIive Baptist Church, 1108 North H Street, owner of 34.25 feet off the south side of lot 32 in William Baxter's addition requesting the vacation of an alley 10 feet in width which is contiguous to the east ends of lots 29 through 32 and the west line of lot 33 in William Baxter's addition to the City of Richmond. Five (5) notices were sent to surrounding property owners. No comments to the petition were returned. Planning Staff recommended approval of the request siting that vacating the alley does not deny owners access to their property and that two other alleys serve the properties of the petitioners. The alley is unimproved and has been maintained as rear yards of adjoining property owners for many years. The nine (9) voting members of the Plan Commission voted unanimously to recommend approval to Common Council. Respectfully submitted, Robert B. This petition is filed pursuant to Indiana Code 36-7-3-12 and Common Council of the City of Richmond is requested to conduct a public hearing on this petition within 30 days of the filing hereof and initiate a vacation ordinance to effectuate the purpose of this petition. Petitioners are the owners of all property that abuts said alley which has never been improved and is a part of the yards of each owner for all practical purposes. Petitioners hereby designate Etta Lundy as their agent to represent them in this Vacation proceeding. Wherefore petitioners request that said public way be vacated subject to the preservation of any existing utility easements. Executed at Richmond, Indiana, this 17th day of June, 1992.
