A SPECIAL ORDINANCE AMENDING THE ZONING MAP AT THE
NORTHWEST CORNER OF THE INTERSECTION OF NORTH SALISBURY
ROAD AND WEST MAIN STREETS
WHEREAS the zoning map designates a 4.637 acre tract in Center Township, Wayne County,
Indiana at the Northwest corner of North Salisbury Road and West Main Street
extended as part C-2 Commercial District and part R-1 One Family Residence
District, and
WHEREAS it is desirable to change the zoning designation of the entire tract to C-2 Commercial
District,
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana,
that the zoning designation of the following described real estate is hereby changed to C-2
Commercial District, to -wit: Being a part of the northeast quarter of the fractional Section 22,
Township 16 North, Range 14 East in Center Township, Wayne County and more particularly
described as follows: Commencing at the Southwest Corner of Fractional Section 36, Township
14 North, Range 2 West; thence south 11 degrees 50 minutes west along the Greenville Treaty
Line 35.8 feet; thence north 88 degrees 36 minutes west 30.52 feet to a point in the west right of
way of Salisbury Road which is in the place of beginning of this description: Thence north 88
degrees 36 minutes west 169.02 feet; thence south 89 degrees 54 minutes west 24.31 feet along a
chord of a circular curve to the left having a radius of 465.00 feet; thence south 209.48 feet;
thence north 88 degrees 36 minutes west 438.23 feet; thence north 1 degree east 232.20 feet;
thence north 67 degrees 51 minutes east 311.34 feet; thence north 74 degrees 35 minutes east
247.73 feet; thence southeasterly and at right angles to the west line of Salisbury Road to said
west line 170 feet more or less; thence southwesterly on and along the west line of Salisbury Road
to the point of beginning, containing 4.637 acres more or less.

Dear Mr.Elstro, Members of Common Council and
Mrs. Carnes:
The Richmond Advisory Plan Commission conducted a public hearing on
Tuesday, July 28,1992 on the petition of David L. Mullins agent for Lucille A.,
Clarence H. and Florence Toschlog owners; requesting a rezoning from C-2
Commercial District and R-1 One Family Residence District to C-2 to permit
construction of two 18 hole miniature golf courses, a video arcade and
batting cages. This request was amended from C-4 General Business District
to C-2, the more restrictive zoning at the request of the petitioner.
Eight (8) notices were sent to surrounding property owners. One (1) was
returned in favor of the petition, three (3) in oppositon. A petition opposing
this request was signed by twenty-eight (28) residential property owners.
Planning Staff recommended approval of the request siting the request was
in compliance with the Master Plan and a natural continuation of the existing
Commercial District. The terrain of this land precludes residential
development and a swimming club presently adjoins this area.
The Plan Commission voted 8 to 1 to deny approval of the petition to
Common Council.
