March 10, 1976
The Tiffin City Council held a regular meeting on March 10,
1976 at 8:00 p.p. in City Hall. Open forum began at 7:30 p.m.,
Mayor Brotherton presiding. Councilmembers present: Morgan,
Potter, Janssen, Formanek and Stratton. Absent: None. Also
present; Atty. Neuzil, Gary Biles, Superintendent of Clear Creek
Schools and Alan Rowe, Principal of Clear Creek High School.
Morgan moved to approve the minutes of the February 24th
special meeting. Janssen seconded and motion carried unanimously.
Janssen moved to approve the minutes from the budget hearing held
March 5, 1976. Potter seconded and motion carried unanimously.
The motion to approve the minutes from the regular session
February llth was made by Potter, seconded by Janssen and carried
unanimously.
Formanek moved to transfer $1948.83 from Federal Revenue
Sharing Trust Fund to General Investment Fund. Janssen seconded
and motion carried unanimously. Formanek moved and Stratton
seconded to accept the financial statements. Motion carried
unanimously.
Potter moved to fncreauthe Clerk-Treas. salary from $170.00
per month to $225.00 per month beginning April 1, 1976. Stratton
seconded and motion carried unanimously.
Potter moved to direct the Clerk-Treas. to notify and
certify delinquent sewer accounts to the Johnson County Auditor
for collection on the tax rolls. Formanek seconded and motion
carried unanimously.
An application from James Morehead, dba The Corral, Hwy. #6
was denied by motion from Potter, seconded by Formanek and
carried unanimously. The application was for a Sunday Liquor and
Beer sales permit.
Potter moved to hear the seconds=reading of Ordinance #73, adopt-
ing a solid waste disposal and removal service for residential users.
Seconded by Janssen and said Ordinance was read.
Formanek moved to set aside $4000.00 from the Water fund
investments for future development of the water system. Potter
seconded and motion carried unanimously. A motion to set aside
$8500.00 from the General fund investments for land acquisition for
park space and public use was made by Formanek, seconded by Potter
and carried unanimously.
Formanek moved to approve the 1976-1977 budget as proposed.
Janssen seconded and motion carried unanimously.
Janssen moved to pay the following bills and accept the following
receipts, seconded by Morgan and carried unanimously.

Council ftiscussed topics of rratual concern: between the City and the
Clear Creek Schools. Supt. Riles and High School Principal Rowe
xpressed their concern with traffic violators and vandalism of school
property. Ccun.cil shared the sane ccncern about City property,, but
advised. that the enforcement of the law is under the jurisdiction of
the Johnson County Sheriff's Office, Clarification was made on owner-
ship and./or responsibility- of certain problem areas: The high school
parking. lot and, driveways are school property not city -owned. The
adjacent Sadler Addition has a gravelled area on private property
which is access for the apartment dwellers and is not a public through-
14a•y. It is illegal to enter Highway #6 from this property,, according
to information obtained from the Iowa State Highway Commission„The
portion of Third St. West was built by the City to give access to and
from the high school parking lot for motor vehicles and pedestrians,
t Is city, -.owned and maintained. It was agreed that the walkways
des: gnated by yellow cement baxtiers and sign is hefting to provide
a safe access to sbbool property for school children. Futueeconsid.er-
ation wi,l'± be given to installing a. sidewalk ifvthe school decides to
install a sidewalk on school property to join the City's.

St-reetsa Sev;ral pot holes will be rdpaired, Tom Mittman will contact
Tom "organ to evaluate and recommend needs for a street program. Roger
Formanek opened a discussion on street o%7jership. Atty. Neuzil advised
that street rigbt-of-ways can be dedicated by owners to the City. The
City decides whether to accept or not. If the City accepts, it is then
Oesponsible for b dIding and maintaining the street,
Recreation Janis Stratton is to check on the possibility of a Kite
Flying Contest to be held in April or May, She will. report .later on
the purchase of a merry-go-round for the City Park.
Environment- Stratton reported that the animal innoculation program
will be held in April, the Mayor has ordered forms and tags, The
Clerk will be a.dvilsed if a flyer is to be atailed with the April ist
utility loills, Atty. Neuzil reported on: the program used by North
Liberty, Iowa for controlling animals which are running at large,
It w*as suc-leested that if the City is going to plant trees this year
on City property that it shoaid be done soon.
Sanitation- A report" was read from the Dept. of Environmental Quality,
Hawkey° Engineeri.qg will becontacted to investigate and. report to
Council concern.in the DEQ_ recommendations that the effluent ponds be
sealed, ;hat GY e ;gain sewer p3.ant be re -seeded aid necessici ty of pur-
chasing an e* erU�:1cy electrical system for the sevier plant. The Mayor
will write to LEQ outlining the steps the City has taken in these areas.
Atty, Ne zzil will write to Havkeye Engineering requesting that they In--
Vestiga.te this matter a.zd respond. to Council. The Clerk will sent?. a
copy of the DES report to Atty, Nevxil,

Formanek read some bills that are in the State Legislature at
this time concerning 4unicival General Fund cash balances Council
members recommended that the City set aside funds for specific pur-
poses. The recommendations were $8500.00 for land purchase as park
and public use space, $4000,,00 for water improvements and $8000.00
for a 3/4 To Truck with blade. Council acted by resolution choosing
the land purchase and water improvement,
