ORDINANCE NO. 565
AN ORDINANCE REGULATING THE SURFACE USE OF LAKE INDEPENDENCE BY CREATING A TEMPORARY EMERGENCY NO WAKE ZONE
The city council of the city of Medina
ordains as follows:
Section 1. Statutory Authority. Pursuant to Minnesota Statutes, section 86B.205 and 459.20, the city is authorized to adopt an ordinance regulating the surface
use of bodies of water lying within the city.
Section 2. Purpose. The purpose of this ordinance is to regulate the water surface use of Lake Independence by declaring the lake subject
to a slow no-wake restriction.
Section 3. Definitions.
a) “Lake Independence” means the body of water commonly known by that name and designated by the Minnesota department of natural
resources as lake #27-176.
b) All terms used in this ordinance related to boating, including “slow no-wake” shall have the meanings given to them in Minnesota Statutes, section 86B.005.
Section
4. Slow No-Wake. No person shall operate a watercraft on any portion of Lake Independence lying within Medina in excess of slow no-wake speeds when high water slow no-wake restrictions
are in effect. High water slow no-wake restrictions shall be in effect when the lake elevation reaches the ordinary high water level established by the Minnesota Department of Natural
Resources for Lake Independence. The ordinary high water level of Lake Independence is 957.8 feet.
Section 5. Termination of Slow No-Wake. The slow no-wake restrictions of this
ordinance shall be in effect until the water elevation of Lake Independence has been at least 0.1 feet below the level which triggered the restriction under section 4 hereof for three
successive days but in no event for more than 30 days unless an extension is authorized by the Minnesota Department of Natural Resources.
Section 6. Action by Independence. This
ordinance shall not become effective unless an ordinance containing identical water surface use restrictions for Lake Independence is adopted by the city of Independence.
Section 7.
Notice to DNR. The city shall give notice to the Commissioner of the Minnesota Department of Natural Resources upon adoption of this ordinance.
Section 8. Notice to the Public. The city shall notify the public of the implementation and termination of the slow no-wake restrictions on Lake Independence by publishing a notice
in the city’s official newspaper, posting on the city’s website, and such other means as the city administrator shall deem reasonable.
Section 9. Exemption. Law enforcement, resource
management and emergency personnel, while in performance of their official duties, are exempt from the provisions of this ordinance.
Section 10. Enforcement. The Hennepin County
sheriff’s department shall have primary responsibility for enforcing the provisions of this ordinance but nothing herein shall preclude other licensed peace officers from enforcing this
ordinance.
Section 11. Penalties. Any person found guilty of violating this ordinance shall be guilty of a misdemeanor.
Section 12. This ordinance shall become effective upon its
adoption and publication.
