Amendment to Chapter 235. Chapter 235, Zoning, of the Code of the Town of Irondequoit, is hereby amended to add a new Article, Article XXVIII, as follows: Section 235-181. Legislative purpose and intent. The intent and purpose of this article is to preserve the character and safety of residential neighborhoods while mitigating potential adverse impacts of short term rentals. Section 235-182. Definitions. When used in this Article, unless otherwise expressly stated or unless the context or subject matter otherwise requires, the following words shall have the meanings therein: CODE ENFORCEMENT OFFICIAL. Full- and/or part-time employees of the Department of Community Development, including any Director of Community Development, Building Inspector, Fire Marshal, Code Enforcement Officer, or others designated by the Director of Community Development. DWELLING UNIT. Shall have the meaning as set forth in Section 235-4 of this Chapter. For purposes of this Article, the term “dwelling unit” shall also include a tiny house as that term is defined in Section 235-4 of this Chapter. HOSTED SHORT TERM RENTAL USE. A short term rental where the primary resident lives and sleeps in a dwelling unit on the same tax parcel of the rented dwelling unit throughout the duration of the short term rental. NON-HOSTED SHORT TERM RENTAL USE. A short term rental where the primary resident does not live and sleep in a dwelling unit on the same tax parcel as the short term rental unit throughout the duration of the short term rental. OWNER. The person, persons, or entity shown to be the owner or owners on the current assessment records of a dwelling unit or of a property including one or more dwelling units. PRIMARY RESIDENT. The person or persons living at the property where the short term rental unit is located. SHORT TERM RENTAL. The rental by an owner of a resident-occupied dwelling unit, or portion thereof, for a period of no more than thirty (30) consecutive days. For the purposes of this Article, the term “short term rental” shall not include bed-and-breakfast, boarding/lodging house, hotel, motel, or DRAFT - for discussion purposes only Dec 9, 2022 1 7 ongoing month-to-month tenancies. Short term rental shall exclude the use of recreational vehicles. SHORT TERM RENTAL UNIT. The dwelling unit or portion thereof rented out for use as a short term rental. PROPERTY. The real property tax parcel upon which the short term rental unit is located. SHORT TERM RENTAL REGISTRATION CERTIFICATE. A certificate issued by the Town in accordance with this Article. Terms not defined in this Article but otherwise defined in this Chapter 235, Zoning, shall have the meanings set forth in Section 235-4 of the Code of the Town of Irondequoit. Section 235-183. Registration required. It shall be unlawful and a violation of this Chapter for any owner of property within the Town to establish, maintain, use, let, lease, rent, or permit the occupancy and use thereof as a short term rental without first obtaining and thereafter maintaining in full force and effect a revokable certificate of registration from the Town, as herein provided. Section 235-184. Allowed districts. Notwithstanding any provision of the Code of the Town of Irondequoit to the contrary, short term rentals shall be permitted in single family dwellings, two-family dwellings, three-family dwellings, condominiums, or tiny houses in any zoning district where such uses are permitted. Section 235-185. Application for short term rental registration. A. Applications for a short term rental registration certificate shall be made in writing on a form provided by and to be filed with the Town Department of Community Development. A separate application shall be made for each dwelling unit. The application shall be executed by each owner of the property where the short term rental unit(s) is located. Such application shall include the following: 1) The name, date of birth, address (both street and mailing if different), telephone number and email address of each owner; 2) The street address of the short term rental property, including the apartment or unit number of the short term rental unit, if applicable; 3) A description of the building or structure, including (a) the number of short term rental units in the building or structure, and (b) the number of bedrooms in each short term rental unit; 2 8 4) A statement of whether the entire dwelling unit or only individual rooms within the dwelling unit, or both, are to be offered for short term rentals; 5) The proposed maximum overnight and daytime occupancy limits for each short term rental unit; 6) A statement and map of the off-street parking provided demonstrating that it will be in compliance with the requirements of this Article; 7) Copy of instrument survey map associated with the subject property; 8) A floor plan indicating the placement and size of each bedroom, exit and fire- protection system; and 9) If no owner lives within and/or maintains an office or place of business within the Town, the name, address (street and mailing), telephone and email address of the local managing agent of each property used for the short term rental use. For the purposes of this Article, local is to mean residing in Monroe or adjoining counties; 10) A notarized statement that the short term rental property is resident-occupied (as such term is used in this Article).; 11) A statement authorizing Code Enforcement to inspect the property to ensure compliance with all requirements and standards contained within this Article; and 12) Evidence of property insurance and a certificate of liability insurance indicating the premises is rated as a short term rental. Such insurance shall be maintained throughout the term of registration. B. The application shall include an affidavit by at least one owner affirming that the short term rental unit(s) meet the conditions set forth in Section 177-5(B)(1), Application for rental occupancy registration, of this Chapter 235. C. Such application shall be signed by the owner, or by each owner, of the property, and each such signature shall be notarized. D. Applications for short term rental registrations shall be accepted year-round by the Town Department of Community Development. Section 235-186. Review of application for short term rental registration. The Code Enforcement Official shall review each application for completeness and accuracy. The Code Enforcement Official shall also review all available information and 3 9 inspect such property to confirm that the rental property and all rental dwelling units thereon are in compliance with the Town Code and the New York State Uniform Fire Prevention and Building Code at the time the application is made. The application shall be accepted and a certificate of short term rental registration shall be issued if, based on all such available information, such application is found to be complete and accurate and if, based on all such available information, the property and all short term rental units thereon are in compliance with the Town Code and the New York State Uniform Fire Prevention and Building Code. Applications shall be rejected if they are deemed incomplete or inaccurate in any way or if the property and all short term rental units thereon are determined not to be in compliance with the Town Code or the New York State Uniform Fire Prevention and Building Code. Notice to the owner of acceptance or rejection of the application shall be made in writing. Section 235-187. Short term rental registration certificates; general provisions. A. Short term rental units shall be resident-occupied. For purposes of this Article, the term “resident-occupied” shall mean that there is at least one primary resident of the property who occupies the short term rental property for at least eight months of each calendar year as his or her residence all or part of the dwelling unit that contains the short term rental unit. The primary resident need not be the owner of the property. B. A certificate of short term rental registration shall be valid for as long as the information in the application remains complete and accurate, but in no case for more than a period of one year from the date on which the certificate is issued. A new application for a certificate of short term rental registration must be completed each year if the owner wishes to continue short term rental use at the property. C. Short term rental registration certificates are non-transferrable. If the property is sold during the calendar year, the new owner must apply for a new short term rental certificate. D. A nonrefundable application fee shall be paid to the Town upon filing each application for a certificate of short term rental registration, in an amount to be set from time to time by the Town Board by resolution. The Town Board resolution may, in its discretion, but subject to applicable law, establish a schedule or schedules setting different application fees for different categories of applicants or properties. E. Should an applicant not meet the permitted building type, parking requirements, or occupancy requirements set forth in this Article, they may seek an area variance from the Zoning Board of Appeals in accordance with Chapter 235, Article XVIII Board of Appeals. Section 235-188. Short term rental standards and requirements. A. The following requirements shall apply to both hosted and non-hosted short term rental uses: 4 10 1) All short term rental units shall have an operational smoke detector in each bedroom. Carbon monoxide detectors shall be installed as required by the New York State Uniform Fire Prevention and Building Code. 2) Off-street parking shall be provided. A minimum of 1.5 1 (one) parking spaces per bedroom of the short term rental unit(s) shall be provided on the property. Additional parking shall be provided for accommodating the host in cases of hosted short term rentals in the amount of one (1) parking space per host bedroom. 3) Any property used for a short term rental shall be subject to and requires compliance with quiet hours between the hours of 10 PM to 87 AM daily. 4) Short term rental units shall have a maximum occupancy of two people per bedroom within the short term rental unit, plus two. For example, if a short term rental unit contains two bedrooms, the maximum occupancy shall be six people. Maximum occupancy will be determined per owner’s submitted floor plan. Only legal habitable space meeting the definition of “bedroom” per Section 235-4 shall be used to calculate occupancy. 5) Garbage must be secured and stored in sufficient receptacles for receiving and containing garbage that may accumulate or be created or used on the property. 6) Exterior signage related to short term rental operations shall not be permitted. B. Additional requirements for non-hosted short term rental use. The following requirements shall apply to non-hosted short term rental uses: 1) Non-hosted short term rental uses shall be limited to rental of the dwelling unit(s) on the property to no more than one hundred twenty (120) days out of the calendar year. For purposes of this section, if there is more than one short term rental unit on the property, no single unit or combination of units shall be rented out for more than one hundred twenty (120) days out of the calendar year. 2) Non-hosted short term rentals shall only be permitted for a minimum of a three two (2) consecutive nights and a maximum of thirty (30) consecutive nights. 3) The owner shall provide all property owners and/or tenants within one hundred (100) feet of the property line with a point of contact designated to respond to any issues with respect to the short term rental. be responsible for notifying, by first-class mail, all property owners of record within 100 feet of the outside perimeter or boundary line of the property. Notification to include physical address of STR unit and relevant Town Staff contact information. 5 11 Notice shall be deemed to have been given if mailed to the property owner at the tax billing address listed on the property records of the Town Assessor or at the property address. Section 235-189. Record of registrations. The Code Enforcement Official or his or her designee Community Development Department staff shall maintain a record of registrations pursuant to this Article. Such register shall be kept by owner name and by street address, showing the name and address of the owner(s), the number of short term rental units at such street address, and the date of expiration of registration for such property., and code violations associated with the property related to short term rental operations. Record of registrations shall be kept up-to-date and shared with relevant departments and officials. Section 235-190. Enforcement; penalties for offenses. A. Any person or entity which fails or refuses to comply with the requirements of this Article or violates any provision of this Article shall be guilty of a violation punishable, for a conviction of any offense, in each instance by a fine fee of not less than $950. Each week's continued violation shall constitute a separate additional violation. unless such entity has made a good faith effort to remedy violation(s) and meet requirements of this Article as determined by the Code Enforcement Official. B. Violations issued by the Town shall be considered at annual registration renewal. All violations shall be remedied prior to renewal. C. A certificate of registration shall be revoked when three or more violations have been issued under this Section 235-91 with respect to a property within any 12-month period from the date of first issuance. Once revoked, a permit shall not be issued sooner than twelve months after the date of revocation. Section 2. Severability. The invalidity or unenforceability of any section, subsection, paragraph, sentence, clause, provision, or phrase of the aforementioned sections, as declared by the valid judgment of any court of competent jurisdiction to be unconstitutional, shall not affect the validity or enforceability of any other section, subsection, paragraph, sentence, clause, provision, or phrase, which shall remain in full force and effect. Section 3. Effective Date. This act shall take effect upon its filing with the Secretary of State as required by § 27 of the Municipal Home Rule Law. 6 Resolution No. 2022- EXTRACT OF MINUTES OF MEETING OF THE TOWN BOARD ADOPTING A RESOLUTION CORRECTING A DATE IN THE APPROVED 2023 REGULAR TOWN BOARD MEETING SCHEDULE At the workshop meeting of the Town Board of the Town of Irondequoit, Monroe County, New York held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 13th of December 2022 at 4:00 P.M. local time, there were: PRESENT: Rory Fitzpatrick Town Supervisor Patrina Freeman Town Board Member John Perticone Town Board Member Kimie Romeo Town Board Member Peter Wehner Town Board Member Harter Secrest & Emery LLP Attorney for the Town Town Board Member _____ offered the following resolution and moved its adoption: WHEREAS, the 2023 Town Board Meeting Schedule for Organizational, Workshop and Regular Town Board Meetings was been submitted by the Town Clerk’s Office and approved (Resolution 2022-324) by the Town Board on November 15, 2022; and WHEREAS, a date in the 2023 Town Board Meeting Schedule for the January 2023 Regular Town Board Meeting contained a typo indicating January 19, 2023 as the date of that meeting and this resolution is being submitted by the Town Clerk’s Office for approval by the Town Board. Seconded by Town Board Member ____________ and duly put to vote, which resulted as follows: Town Board Member Wehner voting_____________ Town Board Member Romeo voting_____________ Town Board Member Freeman voting_____________ Town Board Member Perticone voting ___ _________ Town Supervisor Fitzpatrick voting_____________ EXTRACT OF MINUTES OF MEETING OF THE TOWN BOARD AUTHORIZING THE TOWN TO UNDERTAKE THE RECONSTRUCTION AND STABILIZATION OF CERTAIN ROADS WITHIN THE HUNTINGTON HILLS NEIGHBORHOOD; STATING THE MAXIMUM ESTIMATED COST THEREOF IS $300,000; AND AUTHORIZING THE ISSUANCE OF UP TO $300,000 IN SERIAL BONDS OF THE TOWN TO FINANCE SAID APPROPRIATION At a workshop meeting of the Town Board of the Town of Irondequoit, Monroe County, New York, held at the Town Hall, 1280 Titus Avenue, in said Town of Irondequoit, on the 13th day of December, 2022 at 4:00 P.M. local time, there were PRESENT: Rory Fitzpatrick Town Supervisor John Perticone Deputy Town Supervisor Kimie Romeo Town Board Member Patrina Freeman Town Board Member Peter Wehner Town Board Member Harter Secrest & Emery LLP Attorney for the Town Town Board Member ______________________________________ offered the following resolution and moved its adoption: WHEREAS, the Town Board of the Town of Irondequoit, Monroe County, New York (the “Issuer” or the “Town”) proposes to authorize the issuance of up to $300,000 in serial bonds of the Town to finance the reconstruction and stabilization of certain roads within the Huntington Hills neighborhood including, as necessary or appropriate, the construction or reconstruction of sidewalks, curbs, gutters, drainage, landscaping, and grading or right of way improvements in connection therewith (collectively, the “Project”), at an estimated maximum cost of $300,000; and WHEREAS, by resolution dated October 18, 2022, the Town Board of the Town, acting as lead agency under the State Environmental Quality Review Act and the regulations of the New York State Department of Environmental Conservation adopted thereunder (collectively, “SEQRA”), determined that the Project constitutes an “Unlisted” action within the meaning of SEQRA, that it will not have a significant impact on the environment; and adopted a negative declaration under SEQRA to such effect; and WHEREAS, the Town Board now wishes to appropriate funds for the Project and to authorize the issuance of the Town’s serial bonds and bond anticipation notes to be issued to finance the aforementioned class of objects or purposes. 2 NOW, THEREFORE, UPON NO LESS THAN A TWO-THIRDS VOTE OF THE BOARD, BE IT RESOLVED: SECTION 1. The Town is hereby authorized to undertake the reconstruction and stabilization of certain roads within the Huntington Hills neighborhood including, as necessary or appropriate, the construction or reconstruction of sidewalks, curbs, gutters, drainage, landscaping, and grading or right of way improvements in connection therewith. It is hereby determined that the maximum estimated cost of the aforementioned specific object or purpose is $300,000, said amount is hereby appropriated therefor and the plan for the financing thereof shall consist of (i) the issuance of the $300,000 in serial bonds of the Town authorized to be issued pursuant to this resolution, or bond anticipation notes issued in anticipation of such bonds, or statutory installment bonds, and (ii) unless paid from other sources, the levy and collection of taxes on all taxable real property of the Town to pay the principal of such bonds or notes and the interest thereon as the same become due and payable. SECTION 2. Serial bonds of the Town in the principal amount of $300,000 are hereby authorized to be issued pursuant to provisions of Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (the “Law”) to finance the aforementioned class of objects or purposes. SECTION 3. It is hereby determined that the period of probable usefulness of the aforementioned class of objects or purposes is fifteen (15) years, pursuant to subdivision 20(c) of paragraph a. of Section 11.00 of the Law and serial bonds authorized herein shall have a maximum maturity of five (5) years computed from the earlier of (a) the date of the first issue of such serial bonds or (b) the date of the first issue of bond anticipation notes issued in anticipation of the issuance of such serial bonds. SECTION 4. The final maturity of the bonds herein authorized to be issued shall not be in excess of five (5) years measured from the date of issuance of the first serial bond or bond anticipation note issued pursuant to this resolution. SECTION 5. The temporary use of available funds of the Town, not immediately required for the purpose or purposes for which the same were borrowed, raised or otherwise created, is hereby authorized pursuant to Section 165.10 of the Law, for the capital purposes described in this resolution. The Town shall reimburse such expenditures with the proceeds of the bonds or bond anticipation notes authorized by this resolution. This resolution shall constitute a declaration of official intent to reimburse the expenditures authorized herein with the proceeds of the bonds and bond anticipation notes authorized herein, as required by United States Treasury Regulations Section 1.150-2. SECTION 6. Each of the serial bonds authorized by this resolution and any bond anticipation notes issued in anticipation of said bonds shall contain the recital of validity prescribed by Section 52.00 of the Law and said serial bonds and any bond anticipation notes issued in anticipation of said bonds shall be general obligations of the Town, payable as to both principal and interest by a general tax upon all the real property within the Town subject to applicable statutory limits, if any. The faith and credit of the Town are hereby irrevocably 3 pledged to the punctual payment of the principal and interest on said serial bonds and bond anticipation notes and provisions shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and bond anticipation notes to mature in such year and (b) the payment of interest to be due and payable in such year. SECTION 7. Subject to the provisions of this resolution and of the Law, pursuant to the provisions of Section 30.00 relative to the authorization of the issuance of serial bonds and bond anticipation notes or the renewals of said obligations and of Sections 21.00, 50.00, 54.90, 56.00 through 60.00, 62.10 and 63.00 of the Law, the powers and duties of the Town Board relative to authorizing serial bonds and bond anticipation notes and prescribing terms, form and contents as to the sale and issuance of bonds herein authorized, including without limitation the determination of whether to issue bonds having substantially level or declining debt service and all matters related thereto, and of any bond anticipation notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes, are hereby delegated to the Town Supervisor, as the chief fiscal officer of the Town (the “Town Supervisor”). Such notes shall be of such terms, form and contents as may be prescribed by said Town Supervisor consistent with the provisions of the Law.
