HomeMy Public PortalAboutOrdinance 72-344ORDINANCE NO. 72 -344 AN ORDINANCE OF THE CITY OF TEMPLE CITY ENACTING AN INTERIM ZONING ORDINANCE PUR- SUANT TO THE PROVISIONS OF SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE IMPOSING A MORATORIUM ON BUILDING AND OCCUPANCY PERMITS IN A CERTAIN SECTOR OF THE CITY, PENDING PLANNING COMMISSION STUDIES WITH RESPECT THERETO. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find and determine that the Planning Department of this City has heretofore undertaken in good faith studies to determine a supplemental project area and redevelopment plan for the Community Redevelopment Agency of this City in and for the addi- tional, area described in Resolution No. 72 -446 PC and map attached thereto, which said area is described as "City of Temple City, Rosemead Boulevard Redevelopment Project." SECTION 2. The City Council finds further that the recommendations of the Planning Commission should be forth- coming within the next few months, and that to permit con- struction in such area prior to the consummation of said studies would in large measure emasculate the benefits to be derived from such studies, and would be contrary to the best interest and general welfare of the residents of this City. SECTION 3. Pending completion of such studies and the recommendations of the Planning Department and the Planning Commission, and pursuant to the provisions of Section 65858 of the Government Code, a moratorium is hereby imposed upon the construction of buildings or structures in the aforesaid area of the City of Temple City; and any and all provisions of the Temple City Municipal Code authorizing such construction are hereby suspended during the term of this Ordinance. The aforesaid area as used herein shall mean all of that territory contained within the boundaries of that certain map on f i- le in the office of the C i t y . Clerk, marked "Exhibit "A',' SECTION 4. This Ordinance shall remain in effect for 120 days, and the Building Official of this City is directed not to issue any building or occupancy permits for a building or structure in the aforesaid area during the term of this Ordinance. There shall be excepted from this Ordinance any permit involving maintenance or rehabilitation of existing buildings or structures, which does not result in an expansion thereof. SECTION 5. This Ordinance shall become immediately effective pursuant to the provisions of Section 65858 of the Government Code and for the reasons above stated, and -1- Ordinance No. 72 -344 is adopted pursuant to the authority of Anderson v. Pleasant Hills, 229 CA 3d 79; Metro Realty v. Co. of El Dorado, 222 CA 2d 508; Hunter v. Adams, 180 CA 2d 511; 44 A.G. Ops. 14; Slater v. Los Angeles, 238 CA 2d 864; West Coast Adv. v. San Francisco, 256 CA 2d 357; and Candlestick v. San Francisco Bay Conservation and Development Commission, 11 CA 3d 557. SECTION 6.
